Resolution 3526 - Annexation - Buffalo Hills Reservoir282. RESOLUTION NO. A RESOLUTION TO PROVIDE FOR THE ALTERATION OF THE BOUNDARIES OF THE CITY OF KALISPELL BY INCLUDING THEREIN, AS AN ANNEXATION CERTAIN REAL PROPERTY TO BE KNOWN . AS "BUFFALO HILLS RESER NO. 164",GOVERNMENT LOT 14 SEESN , SECTION 6, T28N, R2ivv, P.fvi, rl., FLAT- HEAD COUNTY, MONTANA, (ACCESSOR'S TRACT 6B AND THE NORTH 440 FEET OF BUFFALO HILL DRIVE) TO ZONE SAID PROPERTY AS "PUBLIC, P-1 DISTRICT AND RESIDENTIAL, R-4" DISTRICT ANb TO AMEND THE CITY ZONING MAP AC- CORDINGLY. WHEREAS, the City of Kalispell is the owner of certain real property contiguous to the City limits of the City of Kalispell, said contiguous platted tracts of land are encompassed in Exhibit "A" attached hereto and for purposes of this Resolution made a part hereof; and WHEREAS, the City of Kalispell as the owner of said tracts is desirous of having said tracts annexed to the City of Kalispell for a Reservoir Site; and WHEREAS, the City Council on the 19th day of March, 1984, adopted Resolution of Intention No. 3517 to annex said territory to be known as "Buffalo Hills Reservoir Annexation No. 164"; and pursuant thereto the City Council did set a public hearing to be held on the annexation and due and proper notice of said public hearing was given by the City Clerk -Treasurer; and WHEREAS, the City Clerk -Treasurer received expressions in writing of approval o; disapproval of the proposed extensions of the boundaries of the City of Kalispell from the freeholders of territory proposed to be embraced therein; and WHEREAS, or, the .7th day of May, 1984, the City Council of the City of Kalispell did meet and consider all expressions in writing of the approval or disap proval of the proposed extensions of the boundaries of said City of Kalispell; and WHEREAS, on the 7th. day of May, 1984, the City Council of the City of Kalispell did meet in regular session and heard public comment on the proposed annexation, and WHEREAS, the City determined that the proposed "Buffalo Hills Reservoir Annexation No. 164" is included within and conforms to the Kalispell Land Use Plan; and that the proper zone for said property to be used as a Reservoir Site is "Public P-1" and the proper zone for said property to be used as Buffalo Frills Drive is "Residential R-411. WHEREAS, the effective date of said annexation should be the date thirty days next succeeding the final passage of this Resolution and approval by the Mayor; and WHEREAS, the annexation of the "Buffalo Hills Reservoir Annexation No. 1611" is pursuant to Title 7, Chapter 2, Part 43, Annexation of Contiguous Land, Montana Code Annotated. NOW AND THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The real property as more particularly described in Exhibit "A", 'attached hereto, shall be annexed to the City of Kalispell; and the boundaries of the City is hereby altered to so provide. SECTION 11. That the City Clerk -Treasurer of the City of Kalispell is authorized and directed upon the effective date of this Resolution, which is thirty days next succeeding the passage of this Resolution and signa- tured by the Mayor, to make and certify under the seal of the City of Kalispell a copy of the record of these proceedings as are entered on the minutes of the City and file said documents with the Flathead County Clerk and Recorder upon or after the effective date hereof. SECTION[ Ill. From and after the date of said filing of said documents. in the Office of the Flathead County Clerk and Recorder of the effective date of this Resolution, whichever is later, said annexed territory is part of the City of Kalispell and said territory and its citizens and property shall be subject to all debts, laws and ordinances and regulations in force in the City of Kalispell and shall be entitled. to the same privileges and benefits as are other parts of the City. 1 1 1 283. SECTION IV. That portion of said realty annexed to the City comprising Assessor's Tract No. 6B shall be a "Public, P-1" District under the City of Kalispell Zoning Ordinance; that portion of said realty annexed to the City comprising the North 440 Feet of Buffalo Hill Drive shall be a "Residential, R.-4" District under. the City of Kalispell Zoning Ordinance. SECTION V. This Resolution shall be effective thirty days from and after its final passage by the City "ouncil and approval by the Mayor. ATTEST: Mariorie iermann, City Clerk -Treasurer I, the undersigned, City Clerk of the City of Kalispell certify that the foregoing is a true copy of the Resolution passed by the City Council of the City of Kalispell; Montana at a regular meeting held. 1 W 1 City Clem of the City of ga]ispell EXHIBIT "A" A tract of land situated, lying and being in Lot 14 or the Southeast Quarter of the Southwest Quarter of Section 6, Township 28 North, Range 21 West, M.F.P., more particularly described as follows, to -wit - Beginning at a point on the regular subdivision line 450 feet southerly from the northeast corner of said Lot 14 of Section 6, Township 28 North, Range 21 West; thence contin- uing southerly along said subdivision line a distance of 400 feet; thence westerly at a right angle a distance of 300 feet; thence northerly and parallel to the east line of said Lot 14 a distance of 400 feet; thence easterly at a right angle a distance of 300 feet to the point of beginning. and a strip of land 60 feet wide east and west, and 440 feet long north and south, extending . from the south boundary line of the reservoir tract above conveyed to the north boundary line of "Highland Park" as shown in the official Plat of said Highland Park on file and of record in the office of the County Clerk and Recorder of Flathead County, Montana, the east boundary line of which 60 foot strip is 165 feet west of and parallel with the east boundary line of said Lot 14 of said Section 6.
