RESOLUTION NO. 3525
A RESOLUTION TO ADOPT THE FEES, SCHEDULES, RATES, CHARGES AND CLASSI-
FICATION IMPOSED ON THE CUSTOMERS OF THE CITY OF KALISPELL SEWER
UTILITY, AND TO AMEND THE RULES AND REGULATIONS GOVERNING SAID UTIL-
ITY.
WhEREAS, pursuant to authority granted to 'municipalities operating utility
services by Section 69-7-101, M.C.A., the City of Kalispell did consider it proper to
amend the fees, schedules, rates, charges and classifications imposed for utility
services to its inhabitants and other persons served by the City of Kalispell Sewer
Utility; and to amend the Rules and Regulations governing the operation of said
Sewer Utility, and
WHEREAS, said proposed amended fees, schedules, rates, charges and classi-
fications are reasonable and just and do not contemplate the said changes will yield
more than a 12% increase in the total amount of annual revenue accruing to the City
of Kalispell Sewer Utility, and
WHEREAS, the City Council did, on the 5th day of March 1 1984, set a
public hearing to be held on May 7, 1984 an said proposed amendments to the fees,
schedules, rates, charges and classifications and amendments to the rules governing
the operation of the Sewer Utility Services of the City of Kalispell and gave the
necessary Notice thereof as required by Section 69-7-111, M.C.A. and
Whereas, due and proper Notice of said Public Hearing has been given by the
City Clerk -Treasurer by publication and mailing as required by law; and
WHEREAS, said public hearing was duly held by the City Council at a public
meeting thereof in the Kalispell City Hall beginning at 7.30 P.M. on May 7, 1984,
and all persons appearing at said hearing and expressing a desire to be heard were
heard, and all written comments thereon furnished to the City Clerk -Treasurer at
said meeting or prior thereto were given consideration by the Council; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL:
SECTION 1. That the fees, schedules, rates, charges and classifications
applicable to the use of the City of Kalispell Sewer System and other
services performed by said utility as set forth on Exhibit "All attached
hereto and by this reference made a part hereof, are found to be just
and are hereby established and adopted to be imposed for sewer utility
services to the inhabitants of the City of Kali�spell and those other
persons served by its sewer utility service.
SECTION 11. The Rules and Regulations for the operation of the City
of Kalispell Sewer Utility, adopted by Resolution No. 3386 on the 21st
day of December, 1981, and as amended by Resolution 3525 of this
date as set forth in Exhibit "B" attached hereto and by this reference
made a part hereof are hereby approved as the regulations governing
the operation of the Sewer Utility.
SECTION IIIII. This decision is final ten (10) days after filing of this
Resolution with the City Clerk -Treasurer. The City Clerk -Treasurer
shall file a copy hereof with the Public Service Commission of Montana
at that time.

Ali users connected to the City Water Utility system and a-1so
connected to the Sewer System will be assessed Sewer Handling
and treatment fees of $ 1.25 ___per thousand gallons of
all water registered on the Water Meter serving the user, with
the following exceptions.
1. Water billed to the user at a Sprinki i i-Vg rate as pro-vided 'in,
Rules and Regulations governing the Water Utility.
2. Separately metered,water also billed as Sprinkling water as
provided in those same Rules and Regulations.
Water used as outlined under I and 2 above is not subject to
sewer fees.

Available for: Users of the system but NOT SERVED by the City Water
Utility but within the City Limits of Kalispell.
Premises discharging sewage into the system from Water Service
originating from other than metered City Water-, itrust instaJ_1
at users expense a meter so as to provide a measure of usage.
This provision covers all outside sources of water including
wells and outside water systems.
The charge for sewer service will. be $ 1,25 ___per 1000 gall:ns;
of usage so determined. In the case of temporary absence of
metering usage will be estimated according to number of users
on the premises served.
At the date of the adcption of this Schedule there are wells
supplyi ' ng commercia.1 and industrial premises, these are required
to be metered . Until this metering is accomplished the sewer
discharge from those premises will be determined from the
capacity of the pump delivering the water and the hours of
operation of the pump. In the case of restaurants and bars
etc. served in the same manner sewer volume may be determined
by comparison with a like situation now metered.

All users residing in multiple dwellings such as apartment houses
condominiums, townhouses, duplexes, fourplexes, etc. and all
users residing in mobile homes or trailers within or without
trailer parks or tourist courts where more than one dwelling is
served through a common meter such service provided through
such common meter shall be reduced to a per unit basis.and

Where it has.been determined that concentrations of BOD and SS are
present in se -wage discharged by any Commercial or Industrial user
a surcharge will be made as determined here -in:
The Utility will consider the averagt Residential component of
sewage to be 200 PPM BOD and 250 Prm �15-. Surcharges- be
assessed to all users discharging wastes which exceed the
compotent of residential Waste as indicated above to wit:
For each 25 PPM BOD above 200 PPM .$.16 per.M.Gallons
For each 25 PPM SS above 250 PPM *13 per M. Gal Ions
This rate does not apply to Septic Waste, which will be
assessed as follows:
Septic Sewage introduced into the sewerage system will be
charged at a rate of $2.25 per hundred gallons (100) with a
ininimum charge of $12-50 per load for bulk loads. The
volume charge will be based on the capacity of the hauling
tank, not on the volume of the contents.
