A RESOLUTION TO ADOPT THE FEES, SCHEDULES, RATES, CHARGES AND CLASSI-
FICATION IMPOSED ON THE CUSTOMERS OF THE CITY OF KALISPELL WATER
UTILITY, AND TO AMEND THE RULES AND REGULATIONS. GOVERNING SAID UTIL-
ITY.
WHEREAS, pursuant to authority granted to municipalities operating utility
services by Section 69-7-101, M.C.A., the City of Kalispell did consider it proper to
amend the fees, schedules, rates, charges and classifications imposed for utility
services to its inhabitants and other persons served by the City of Kalispell Water
Utility: and to amend the Rules and Regulations governing the operation of said
Water Utility, and
WHEREAS, said proposed amended fees, schedules, rates, charges and classi-
fications are reasonable and just and do not contemplate the said changes will yield
more than a 12% increasein the total amount of annual revenue accruing to the City
of Kalispell Water Utility, and
WHEREAS, the City Council did, on the 5th day of March , 1984, set a
public hearing to be held on May 7, 1984 on said proposed amendments to the fees,
schedules, rates, charges and classifications and amendments to the rules governing
the operation of the Water Utility Services of the City of Kalispell and gave the
necessary Notice thereof as required by Section 69-7-111, M.C.A. and
Whereas, due and proper Notice of said Public Hearing has been given by,_the
City Clerk -Treasurer by publication and mailing as required by law; and
WHEREAS, said public hearing was duly held by the City Council at a public
meeting thereof in the Kalispell City Hall beginning at 7:30 P.M. on May 7, 1984,
and all persons appearing'at said hearing and expressing a desire to be heard were
heard, and all written comments thereon furnished to the City Clerk -Treasurer at
said meeting or prior thereto were given consideration by the Council; and
NOW THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL:
SECTION I. That the fees, schedules, rates, charges and classifications
applicable to the use of the City of Kalispell Water System and other
services performed by said utility as set forth on Exhibit "A" attached
hereto and by this reference made a part hereof, are found to be just
and are hereby established and adopted to be imposed for water utility -
services to the - inhabitants of the City of Kalispell and those other
persons served by its water utility service.
SECTION II. The Rules and Regulations for the operation of the City
of Kalispell Water Utility, adopted by Resolution No. 3385 on the
21st day of December , 19 81 and as amended by Resolution 3524
of this date as set forth in Exhibit "B" attached hereto and by this
reference made a part hereof are hereby approved as the regulations
governing the operation of the Water Utility.
SECTION Ill. This decision is final ten (10) days after filing of this
Resolution with the City Clerk -Treasurer. The City Clerk -Treasurer
shall file a copy hereof with the Public Service Commission of Montana
at that time.

MULTIPLE USERS
All users residing in multiple dwellings such as apartment houses,
condominiums, townhouses, duplexes, fourplexes, etc. and all users
residing in mobile horses or trailers within or without trailer parks
or tourist courts where more than one dwelling unit is served through
a.common meter, such service provided through such common meter shall
be reduced to a per unit basis and rates and minimums per Schedule A
and B applied thereto.
Special Terms and Conditions Multiple Commercial Units served through a common

Inasmuch as water bills are rendered bi-monthly with the service
area divided into two sections billed in alternate periods this
special sprinkling rate will be applied as follows:
Section A: (West Side) meters read in odd numbered months:
Exess usage defined above in the period after the March reading
to the November Reading, will be accorded Sprinkling Rate consideration.
Section B: (East Side) meters read in even numbered months:
Excess usage defined above: in the period after the April reading
to the December Reading, will be accorded Sprinkling Rate consideration.

All water users supplied through a separately metered, sprinkling
service as provided in the Rules and Regulations, will be billed
during the Sprinkling Season -as defined herein at a minimum rate
for the appropriate size meter in use and for all water used in
excess of that minimum the established sprinkling rate will apply
during the sprinkling season. No minimum m&aAhly fee will be
assessed against these separate sprinkling services except during
the Sprinkling Season. No Sewer Fees will be assessed against these
separate sprinkling services unless water is used for other purposes
(which is prohibited in the Rules and Regulations.)
Where usage other than during the Sprinkling Season is indicated
this separate service may be cut off and charge per Schedule A
Rendered for that usage.
Separately Metered Sprinkling Services are permitted only in
conjunction with usage through a service to a dwelling or commercial
account and will not be provided for irrigation purposes.

Commercial users, including Schools will be granted Sprinkling
Rates ONLY if Separately Metered Services are installed for that
purpose. Such services may be entirely separate from the main
to the property or separated ahead of the principal meter serving
the property. Users served in this manner for this purpose will
be billed $ .45 per 1000 gallons on all.water used for this
purpose after applying the appropriate minimum charge, during
the Sprinkling Season outlined under Residential Meters. No
Sewer Fees will be assessed against these Separate Sprinkling
Services unless water is used.for other purposes, which is
prohibited in the Rules and Regulations. The Utility will
provide 5j8" meters for these Separately Metered Services, if
larger Meters are needed the cost of said larger meter will be paid
by the user.

Proposed amendments to Rules and Regulations for the Kalispell Water
Department which were originally adopted December 21, 1981
now reads
RULE V (8) Charges not made to Customer. No charge will be made to new
customers for turning the water on or to existing,custcmers
cancelling their account for turning the water off if the turn: -on
or off is made during regular working hours. Turn -on service
required at times other than regular working hours will be charged
to the customer in accordance with the Rate Schedule. This no
charge service does not apply to temporary services or seasonal
services.
Change to read.
Turn -On or 'Turn --Off . When service' i"s requested and service to
the premises to be served is in place, no charge will be made to
new customers for turning the water on, if the turn -on is made
during regular working hours. Turn -on service required at times
other than regular working hours will be charged to the customer
in accordance with the Rate Schedule applying. Where no service
line to the premises is in place the new customer will be charged
a connection fee'as provided in Rule VII and covered in the Rate
Schedule. Which fee must be paid before connection is made.
Turn=off will be made when requested by existing customer moving
from the premises, at no cost to the customer. See Rule XIT rcr
charges made against the customer for Turn --off necessitated for
non-payment of service charges. Turn -on and Turn-off service
required at times other than regular working hours will be charged
to the customer in accordance with the Rate Schedule. Temporary
and Seasonal services will be charged for these services per
Rate Schedule

RULE VEI Paragraph 2 Change to read
When the contracting consumer is a renter; leasee, or is not the
property owner, an application for crater service shall be made in
the consumer's own name and the consumer shall be primarily liable
for payment of the water service. Billing in this manner will not
release the liability of the owner and in this instance the- Water
Department shall notify the property owner of the new service application
and place the contracting -user's name and date of service application
as an endorsement on the property owner's application.

All premises to be served which have not previously been served by
the system will be assessed a connection fee as -provided in the
current rate schedules which fee is due and must be paid before
service application may be approved.
WATER DEPT
Rule XII Para (3) Change to read
Discontinuance for non-palment. The Water Department ,shall
make a diligent effort to obtain compliance with its Rules'
and Regulations by the customer, including payment of bills.
When payment becomes delinquent as indicated on current billing
the collection department is authorized to contact the customer
by telephone or by mail giving notice that payment is past due.
The customer shall have seven days after notice is given to comply
by making payment. If payment. is not made the Water Department is
directed to place a notice upon the premises advising that, service
will be shut off and stating the date when this will be done.
The Water Department shall not be liablQ for failure c the customer
to see such notice or for disappearance of the notice from the
premises. A record shall be kept on the customers file of the
date and time and person placing the notice as well as the date
and time and person contacted of any telephone and mail notification
as directed herein. The Water Department shall not discontinue
service on Friday, Saturday or Sunday or a day prior to a holiday
or if an emergency affecting health exists. A written statement
from a physician or health agency must be presented to the Water
Department within five days if such claim of emergency is made.
