A RESOLUTION TO APPROVE, AS A SUBDIVISION OF THE CITY OF KALISPELL,
THE RESUBDIVISION OF FIRST ADDITION TO PACK ADDITION, ADDITION NO. 91,
ADDITION NO. 156 TO THE CITY OF KALISPELL.
W I T N E S S E T H:
WHEREAS, the owners of the First Addition to Pack Addition, Addition No.
91, Addition No. 156 to Kalispell have petitioned for the approval of the Resubdivision
of said premises to be known as the Resubdivision of First Addition to Pack Addition,
Addition No. 91, Addition No. 156 to Kalispell, and all persons having an interest in
said premises have, in writing, consented to the resubdivision of said premises, as
required by Section 76-3-613, M.C.A., and
WHEREAS, said resubdivision does Qualify for summary review and approval
under the provisions of the Subdivision Regulations of the City of Kalispell as now
in effect, and
WHEREAS, the Flathead Regional Development Office has reviewed and recom-
mended the City approve such subdivision, and
WHEREAS, the City Council in considering this request has found, from the
preliminary plat and evidence relating thereto, that said subdivision is in the public
interest, and in making such findings, the Council has considered and weighed (a)
the basis of the need for the subdivision; (b) expressed public opinion; (c)
effects on agriculture; (d) effects on local services; (e) effects on taxation; (f)
effects on wildlife habitat; and (g) effects on the public health and safety, and
WHEREAS, "Lot 4" is reserved to Packs Brats, Inc., one of the owners of the
property for purposes of ingress and egress, utility, signs, landscaping, lighting
and related used over and across Lot 4 as a "Private Utility and Road Easement".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA:
SECTION I. The petition of the owners for the Resubdivision of First
Addition to Pack Addition, Addition No. 91, Addition No. 156 to Kalispell
is hereby approved, subject to the following conditions:
a. Any future submittals from this applicant on his adjacent
property be accompanied by a "master plan" .for the devel-
opment/division of said property.
b. A waiver of Section 2.3 of the City Subdivisron regulations
be granted due to the prior installation of utilities, and the
applicant may proceed directly to the final plat submittal.
C. That the final plat provide the "Certificate of Director
of Public Works".
SECTION II. The classification of said premises under the Kalispell
Zoning Ordinance shall not be changed by this action.
SECTION III. That no portion of said premises need be dedicated to
the City for park purposes, and, in accord with Section 76-3-606, M.C.A.,
the park dedication requirement does not apply, in as much as this
resubdivision creates only, one additional lot.
SECTION IV. Upon proper review and filing of the final plat of said
subdivision in the Office of the Flathead County Clerk and Recorder,
said premises shall be a subdivision of the City of Kalispell, and shall
be known as the Resubdivision of First Pack Addition, Addition No. 91,
Addition No. 156 to the City of Kalispell.
