We have researched the attached request by Mor4ah`& 0swood Constr6et-ion
Regarding the contract retainage and offer the following."
1. Certificates of Deposit in the City's name deposited in �ccordance with
state statute with the S . tate of Montana appear to be acceptable.
The City would reques-O'the EPA share of the r6tifiAage money, pay -its own
share, and release the money to the contractor as soon as the contractor
deposits a CD in the amount of the retainage with the State.
2. Deposit of retainage money in an ;nterest bearing account At a suitable
financial institution is acceptable if the City has complete and sole control
over the account. The City would request the EPA's share of the retain -
age and deposit that amount and the City's share in an interest bearing
account each month.
Eith er method is acceptable to the EPA and the Water Quality Bureau. Please
advise'us if you need further input from us or of a decision on this matter.
