Krista,
The language does not need to be changed as long as we are all in agreement this will be how the
inspections will be done. The agreement states there will be an annual inspection, this is required
for the pedestrian rail. The visual on the bridge is a minimum of every other year. If the City wants
to complete a visual every year that is ok also.

Thanks for your email and message today checking on the status of our agreements.
Would you like us to change the language in the construction maintenance agreement as suggested
below and have the city manager sign?
We're just getting the city manager's signature on the east trailhead lease agreement and hope to
have both signed documents back to you this week.
As for the agreement with Sandry, let us know if there's anything we provide. Sandry has been on
top of things and will likely get you what you need quickly.

Were you thinking a change to the language as shown below?
1. Pedestrian Bridge
a. Upon completion of the Project, the City agrees that it is responsible, at no
cost to MDT, to service, maintain, repair, and pay the cost of operating the
pedestrian bridge within the project limits, such that it does not negatively
impact the operation of the pedestrian bridge, shared use path or the safety
of the traveling public. If all or part of the pedestrian bridge or shared use
path becomes unsafe for use, the City agrees to restrict access to the affected
area until the condition has been remedied.
b. For the purposes of this Agreement, "maintenance of the pedestrian bridge"
includes an annual inspection of the pedestrian rail and a biannual visual
inspection of the structure and any necessary repairs including the barriers
are functioning in good working order. Annual inspection report must be
submitted to the MDT Area Maintenance Chief and the MDT State Bridge
Engineer.

Hello Ladies,
Thank you again for your hard work to put these agreements together.
Jean, are we able to add language to the construction and maintenance agreement based on the
email you provided about bridge inspection: There are not really any ones that fit for Pedestrian
structures. 1 did talk to MDT Bridge and MDT Bike/Ped. The Pedestrian rail needs to be inspected
annually to make sure it is sound and there are no issues. Bridge indicated the review for the main
structure could be every other year. The inspection would be visual and looking for issues, cracks
spalling and major rust. No one has a form.
Catherine, we are working through the insurance coverage issue that we discussed earlier. We may
want to have Carol speak with Rich regarding the limitations of MMIA coverage.
