County Flathead EXHIBIT .L-- RESOLUTZON ,, 3499 RESOLUTION ON ACQUISITLO;� 'DEVELOPMENT _ _---F R-OUTD00R RECREATION UNDER THE LAND AND WATER CONSERVATION FUND PROGRAM WHEREAS, the City of Kalispell is interested in acquiring lands or ��----.- -developing outdoor recreational facil it ies on the fol :L,. in described project or the enjoyment ~of e c tiaenry of City of Kalispell and the --State o Montana: Project Title _ Total Estimated Cost $550,OLCLO.00 _ Brief Description of Project: Replace pool bottom and fiberglass pool. Replace skimmers, extend walkways. Replace building, filtration and disinfection equipment and boiler. AND, Land and Water Conservation Fund financial assistance is required for the acquisition or development of said outdoor recreational facilities, NOW THEREFORE, be it resolved by the City of Kalispell that the project described above be authorized, AND, be it further resolved that said City of Kalispell make application to the State Fish and Game Commission to seek Land and Water Conservation Fund financial assistance from the Bureau of Outdoor Recreation in the amount of 50Z of the actual cost of the project in behalf of said City of Kalispell. AND, be it further resolved by the City of Kalispell that it certifies to the following: 1. That it will accept the terms and conditions set forth in the BOR Grants -in -Aid Manual and which will be part of the Project Agreement for any grant awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the acquisition and/or development in the manner described in the proposal and any plans and speci- fications attached thereto unless prior approval for any change has been received from the Commission. 1 1 213. -2-- 3. That it has the ability and intention to finance its share of the cost of the project and that the project will be operated and maintained at the expense of said City of Kalispell__ for public outdoor recreation use. 4. That no financial assistance has been given or promised under any other Federal program or activity with regard to the proper proposed project. 5. That it will not discriminate against any person on the basis of race, color or natinal origin in the use of any property or facil-. ity acquired or developed pursuant to this proposal, and shall comply with the terms and intent of Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and of the regulations promulgated pursuant to such Act by the Secretary of the Interior and contained in 43 CFR 17. 6. That it will maintain adequate financial records on the proposed project to substantiate claims for cost sharing. This is to certify that the foregoing is a true and correct copy of a resolution duly and legally adopted by the Kalispell City Council at a legal meeting held on this 3rd day of October 1983. RESOLUTION NO. 3500 A RESOLUTION TO APPROVE,AS A.SUBDIVISION OF THE CITY OF KALISPELL, MONTANA BUFFALO HEAD TOWNHOUSES. A RESUBDIVISION OF BUFFALO HEAD ADDITION NO. 92. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA.: SECTION I. That pursuant to the petition of Stanley W. Pine filed with the City council of the City of Kalispell and the submission to said council by said petitioner of a plat reflecting the survey and designation of that territory within the City of Kali- spell which said petitioner's request be approved as a resubdivision of an existing subdivision, and pursuant to the provisions of Chapter 1 of Title 76, M.C.A., as amended, that are applicable thereto and the duly adopted and enforced subdivision regulations of the City of Kalispell, the Council and Mayor do hereby approve that said territory shall be resubdivided and as resubdivided shall be a subdivision of the City of Kalispell to be known as Buffalo Head Townhouses, a resubdivision of Buffalo Head Addition No. 92. SECTION II. The City Council in considering this request has found from the preliminary plat and evidence relating thereto that said resubdivision is in the public interest, and in making such finding the Council has considered and weighed: (a) Basis of need for the subdivision; (b) Expressed public opinion; (c) Effects on agriculture; (d) Effects on local services; (e) Effects on taxation.; (f) Effects on wildlife habitat, and (g) Effects on public health and safety. SECTION III. In addition to the conditions for approval of Buffalo Head Subdivision No. 92 set forth in Resolution No. 3201 adopted by the City of Kalispell on October 16, 1978, and as further conditions of the approval of this resubdivision, petitioner must agree to -the following terms and conditions: (a) That all public streets be named and appropriate signs posted; (b) That an adequate marking system to identify the residential units be provided; (c) That the original lot lines established by the plat of Buffalo Head Addition No. 92 be shown on each final plat effecting a resubdivision of any such lot;
