RESOLUTION NO. �1/
A RESOLUTION TO ASSUME THE ASSETS, OPERATION, MAINTENANCE AND RE-
SPONSIBILITY OF THE SUNSET DEVELOPMENT COMPANY.
WHEREAS, Oscar Olson, the owner of the Sunset Deiv-elopment
Company, a privately owned water utility, has requested that the
City of Kalispell assume all the assets, operation and mainten-
ance of the wate'r utility system supplying re'sidences located
immediately adjacent to and surrounded by the City of Kalispell,
and
WHEREAS, the City of Kalispell is capable and willing to accept
control of the water utility operated under Sunset Development Com-
pany provide said take over is approved by the Public Service
Commission of the State of Montana and further that said system
meets the appropriate requirements of the City's Public Works De-
partment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF KALISPELL THAT:
SECTION I. That the City on or before the Ist day of :
1983, shall accept the privately owned water utility, opera WeAu`ndcle'r
name of the Sunset Development Company and will assume all as -
Ls, operation, maintenance and responsibility, therefore, as part
ol the public water supply system as part of the public water util-
-1-y system operated by the City of Kalispell.
SECTION II. That the acceptance of the Sunset Development
Compai)y's system shall becontiguous upon the successful completion
uf water pressure test conducted by the City's Public Works Depart -
SECTION III. That the assumption of the Sunset Development
-Service

''mmission approval of the transfer.
