Resolution 3468 - Preliminary Plat - Fifth Avenue EastRESOLUTION NO. 3468 A RESOLUTION TO APPROVE THE PRELIMINARY PLAT OF A SUBDIVISION OF THE CITY OF KALISPELL, THE SUBDIVISION OF A "PORTION OF TRACT 2 OF THE WALKER ADDITION #96 TO THE CITY OF KALISPELL, MONTANA" TO BE KNOWN AS FIFTH AVENUE EAST. WHEREAS, William W. Walker and Kathleen D. Walker, the owners of Tract 2 of the Walker Addition #96, of the City of Kalispell, Montana, have petitioned for the approval of the subdivision of said premises to be known as Fifth Avenue East, and all persons having an interest in said premises have, in writing, consented to the subdivision of said premises, as required by Section 76-3-612, M.C.A., and WHEREAS, said subdivision does qualify for summary review and approval under the provisions of the Subdivision Regulations of the City of Kalispell as now in effect, and WHEREAS, the Flathead Regional Development Office has reviewed and recommended the City approve such subdivision, and WHEREAS, the City Council, in considering this request has found, from the preliminary plat and evidence. relating thereto, that said subdivision is in the public interest, and in making such findings, the Council has considered and weighed (a) the basis of the need for the subdivision; (b) expressed public opinion; (c) effects on agri- culture; (d) effects on local services; (e) effects on taxation; (f) effects on wildlife habitat; and (g) effects on the public health and safety. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 4F KALISPELL, MONTANA, SECTION I. The application for approval, of William W. Walker and Kathleen D. Walker, for the preliminary plat of a subdivision of a Portion of Tract 2 of the Walker Addition No. 96 to the City of Kalispell, Montana, is hereby approved and the same shall be here- inafter known as Fifth Avenue East of the City of Kalispell, Montana, subject to the following conditions: 1. That sewer extensions be in accordance with the City of Kalispell "Standards and General Provisions for Design and Construction", and meet the approval of the State Department of Health and Environmental Sciences and the Director of Public Works. 2. That the developer waive the right -of -protest to S.I.D.'s for road and right-of-way improvements, and storm drain improvements. 3. That the sanitary sewer line be located within a "private utility and sewer line easement" of a mini-. mum of 15 feet in width, and shown on the final plat. 4. That the "Certificate Waiving Park Land" on the face of the plat be corrected to reflect the name of Walker Addition #96. SECTION II.The classification of said premises under the Kali- spell Zoning Ordinance shall not be changed by this action. SECTION III. That no portion of said premises need be dedicated to the City for park purposes because park requirements as required under Section 76-3-606, M.C.A., was met and satisfied by the original subdivision in February 2, 1979. 11,31 SECTION IV. That upon proper review and filing of the final plat of said subdivision in the Office of the Flathead County Clerk and Recorder, said premises shall be a subdivision of the City of Kalispell.
