Resolution 3462 - Call for Construction Bids - SID 3361_ 1_9 RESOLUTION NO. 3462 A RESOLUTION PROVIDING FOR THE CALL FOR CONSTRUCTION BIDS FOR SPECIAL IMPROVEMENT DISTRICT NO. 336. WHEREAS, the Mayor and City Council of the City of Kalispell, in compliance with the statutes of the State of Montana, did, on the 18th day of April, 1983, create Special improvement District #336 of the City of Kalispell for the purpose of constructing a paved driving surface and gravel surface -shoulder on Eleventh Avenue West between Seventh and Eighth Streets in all of that area included in and in accordance with the terms and conditions as specified in Resolution No. 3455 and Resolution No. ; and WHEREAS, the City of Kalispell Director of Public Works has prepared plans and specifications for said construction. NOW THEREFORE, BE IT HEREBY RESOLVED: SECTION I. That the City Clerk -Treasurer forthwith call �o.r bids for.the construction in accordance with the laws of the State of Montana. SECTION II. That the Notice of said call for bids be in t..he substantial form of and contain the provisions of Exhibit "A" attached hereto. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL x '►� APPROVED BY THE MAYOR THIS l8th DAY OF April , 1`'3. cDo 1, Ma A�:� EST ri Giermann, City Clerk -Treasurer the undersigned, City Clerk of the City of Kalispell certify that the foregoing is a true :.y of the Resolution passed by the City Council of.the City of Kalispell, Montana at a ralas meeting held City Cler of the City of Kalispell EXHIBIT "A" NOTICE OF CALL FOR BIDS CITY OF KALISPELL, MONTANA SID #336 NOTICE IS HEREBY -GIVEN, that sealed proposals for the construc- tion of paved driving surface and gravel surface shoulder, and the replacement of the Water Main, on Eleventh Avenue West between Seventh and Eighth Streets for the City of Kalispell, Montana, will be received by the City Council at Kalispell, Montana, until 7:30 P.M., June 20, 1983. All proposals shall be addressed to the City Clerk, City of Kalispell, and plainly marked "SID #3.36 Construction At a meeting of said Council at said time and place said bids re- ceived will be publicly opened and read; bids received thereafter will not be considered. The work involved is for the construction of work for SID #336, created on April 18, 1983, by Resolution No. 3461 and is specified in plans and specifications as outlined and on file at the following address: Department of Public Works, P.O. Box 1035, Kalispell, Mon- tana 59901. Said Resolution and Resolution No. 3455 contain more particular description of said district and are on file in the City Clerk's Office, Kalispell City Hall. Also the job will consist of replacing the City Water Main on Eleventh Avenue between Seventh and 1::i.ghth Streets. Plans and specifications are on file and available at.: Department of Public Works, P.O. Box 1035, Kalispell, Montana '5 1 01. Each bidder must display his current Montana Contractor's License, l gas and number. All bids must expressly covenant that if the bidder shall be , arced the contract the bidder will, within 30 days after such Llward, enter into a formal contract and give good sufficient bond to secure the performance of the terms and conditions of the contract; otherwise, the bidder shall pay unto the City of Kalispell the dif- ference in money between the amount of the bid of the said bidder and ' the amount for which the City of Kalispell legally contracts with an- other party to supply said property if the latter amount is more than the former, but in no event shall the bidder's liability or the li- ab,ility of the surety -of such bidder exceed the penal sum of 10% of the bid. All bidders shall, as bid security, accompany the bid with s-1ch sum, to --wit: 10% of the bid, in lawful money of the United States, or a cashiers check, certified check, bank money order, or bank draft, in any case drawn and issued by any banking corporation incorporated lunder the laws of the State of Montana or by a national banking as- sociation located in the State of Montana, or by an acceptable bid Bond or bonds executed by a surety corporation authorized and licensed to do business in the State of Montana, or certificates of deposit or money market certificates issued by any bank or savings and loan association licensed to do business in Montana. Any such bank in- strument or bond shall be payable directly to the City of Kalispell. A bond or similar bank instrument will be required of the suc- cessful bidder in the amount of one --hundred percent (100) of the aggregate of the proposal for the faithful performance of the con- tract, pay all laborers, mechanics, sub -contractors, material, men and suppliers on said project;.and, further, said contractor must provide protection of the City of Kalispell against the liability of accidents. A successful bidder will also be required to comply with Section 39-3-703, M.C.A., also a successful bidder will have to abide by Federal and State of Montana minimum wage and fringe benefit laws, particularly Section 18-2--401, et seq., M.C.A. If a contract is awarded, the bidder whose bid is accepted and who shall thereafter refuse to enter into and execute the proposed contract, as stated in said covenant, shall absolutely forfeit such monies or bank instruments to the City of Kalispell, and becomes w 1 immediately liable on said bid bond to said sum. The money, bank instrument or bid bond, as the case may be, shall be returned to those bidders whose bid is not accepted. A reasonable charge may be made for copies of the bid documents. The successful bidder will be furnished additional copies thereof without charge as required.
