A RESOLUTION TO PROVIDE FOR THE ALTERATION OF THE BOUNDARIES OF THE
CITY OF KALISPELL BY INCLUDING THEREIN, AS AN ANNEXATION CERTAIN REAL
PROPERTY TO BE KNOWN AS "DRY BRIDGE CREEK PARK ANNEXATION NO. 152",
(ACCESSOR'S TRACTS 6J, 6, 3AB, 3A; SEC 17, TOWNSHIP 28 NORTH RANGE 21
WEST MPM) TO ZONE SAID PROPERTY AS "PUBLIC P-l" DISTRICT AND TO AMEND
THE CITY ZONING MAP ACCORDINGLY.
WHEREAS, the City of Kalispell is the owner of certain real
property contiguous to the City limits of the City of Kalispell, said
contiguous platted tracts of land are encompassed in Exhibit "A"
attached hereto and for purposes of this Resolution made a part here-
of; and
WHEREAS, the City of Kalispell as the owner of said tracts is
desirous of having said tracts annexed to the City of Kalispell for
park purposes; and
WHEREAS, the City Council on the 15-th day of November, 1982,
ad,,-�pted Resolution of Intention No. 3447 to annex said territory to
I. -le known as "Dry Bridge Creek Park Annexation No. 152"; and pursuant
thereto the City Council did set a public hearing to be held on the
and due and proper notice of said public hearing'was given
by the City Clerk -Treasurer; and
WHEREAS, the City Clerk -Treasurer received expressions in writing
of' i7:-Proval or disapproval of the proposed extensions of the bound-
arie�; of the City of Kalispell from the freeholders of territory pro-
no---ed to be embraced therein; and
'HHEREAS, on the 3rd day of January, 1983, the City Council of .
City of Kalispell did meet and consider all expressions in writing
of the approval or disapproval of the proposed extensions of the
1.,oijrei'aries of said City of Kalispell.; and
WREREAS, on the 3rd day of January, 1983, the City Council of
Lhe City of Kalispell did meet in regular session and heard public
=,,-,ment on the proposed annexation; and
,,-�HEREAS, the City determined that the proposed "Dry Bridge Creek
Pa".k Annexation No. 15211 is included within and conforms to the
E'�71i_:3pell Land Use Plan; and that the proper zone for said property
to be used as a public park is "Public P-l"; and
WHEREAS, the effective date of said annexation should be the
date thirty days next succeeding the final passage of this Resolution
and approval by the Mayor; and
WHEREAS, the annexation "of the "Dry Bridge Creek Park Annexation
No. 152" is pursuant to Title 7, Chapter 2, Part 43, Annexation of
Cositiguous Land, Montana Code Annotated.
NOW AND THEREFORE, BE IT RESOLVED 13Y THE CITY COUNCIL OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION 1. The real property as more particularly described in
Exhibit "A", attached hereto, shall be annexed to the City of
Kalispell; and the boundaries of the City is hereby altered
to so provide.
SECTION II. Th at the City Clerk -Treasurer of the City of
Kalispell is authorized and directed upon the effective date
of this Resolution, which is thirty days next succeeding the
passage of this Resolution and signatured by the Mayor,,to
make and certify under the seal of.the City of Kalispell a
copy of the record of these proceedings as are entered on the
minutes of the City and file said documents with the Flathead
County Clerk and Recorder upon or after the effective date
hereof.

SECTION Ill. From and after -the date of said filing of said
documents in the Office of the Flathead County Clerk and Re-
corder of the effective date of this -Resolution, whichever
is later, said annexed territory is part of the City of Kalis-
pell and said territory and its citizens and property shall be
subject to all debts, laws and ordinances and regulations in
force in the City of Kalispell and shall be entitled to the
same privileges and benefits as are other parts of Lhe City.
SECTION IV. All of said realty so annexed 110 the City shall
be a "Public P-l" District under the City of Kalispell. Zoning
Ordinance; the City Zoning map shall be amended te so reflect.
SECTION V. This Resolution shall be effpctive th-Ly-ty days from
an�! after its final passage by the City Council and appr-oval by
the Mayor.
