RESOLUTION NO. 3491__
A RESOLUTION LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN SPECIAL
'IMPROVEMENT DISTRICT NO. 335 TO DEFRAY THE COSTS OF MAKING THE SPECIAL
j�MPROVEMENTS AUTHORIZED THEREIN.
FiE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS.
To defray the costs of making the special improvements authori-
zt-d in that area included within Special Improvement District No. 335
ol, (-he City of Kalispell, as more particularly described in Resolution
3413, dated 21st day of June, 1982, and on file in the office of the
City Cle'rk-Treasurer, there is hereby levied and assessed against all
sa�'d property a tax in the total sum of $15,000.00, plus interest as
Y)�_�..einafter provided. Said sum includes all the costs of making said
J_Ti�provements and as allowed by Section 7-12-4169, M.C.A., and as
certified to the City Clerk -Treasurer by the Director of Public Works
upr�n completion and acceptance of said improvements.
Said levy and assessment as is made hereunder against each lot
0-r� pl��-rcel of land within said District also shall include accruing in -
thereon at the rate of 12% until paid from the date of regiS7
of bonds sold and issued in accordance with Resolution No.
dated 16th day of August, 1982, and if the same is not paid in full
wl-_,en s�> le.vied and assessed, said sum shall, with interest at 12%, be
s� Over a term of not to exceed ten (10) years, payments to be made
annual installments as provided by Resolution No. 3436, dated
lf'Ch dl�Ay of August, 1992.
Thct aforesaid cost of said improvements shall be assessed against
lot or parcel of land within the District by determining the lots
u-pon the above right of way and assessing each lot as its

The City Clerk -Treasurer is hereby directed to publish Notice
as provided by Section 7-12-4177, M.C.A. This council will meet
ai.,.` T,-,ear any objections to said levy and assessment and take final action
at- the regular meeting of the City Council at the Council

WHEREAS, the within and foreqoinq Resolution No. 3451
signed by the Mayor and City Clerk of the Council of the City of
Kalispell, Montana, was filed in the office of said Clerk of the
Council on the 20- day of December 198 2 , and has

'_nce that date been on file in said office, subject to inspection,
arid the filing of said Resolution by publication in the Daily Inter
Lake, a newspaper printed and published in the City of Kalispell,
Montana, at least five days before the date set herein for hearing
objections thereto, and the City Council having been in session
at the time and place for the hearing of objections, and no owner,
or agent of any owner of lots, pieces or parcels of land situated
within said Special Improvement District No. 3iS or any other
��e.rson, having appeared and protested against or objected Lo the
ILnal passage and adoption of.said Resolution or to any assessment
,-r tax hercby levied or assessed; and it appeariiig to the satis--
faction of the City Council 'Chat the cost of the improvements
wit;An the said Special Improvement District No. 335 was necessiry
'ind proper, and that the cost thereof should he assessed accord-

ingly as in said Resolution provided;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
"ALISPELL, MONTANA:
That the within and foregoing Resolution No. 3451 be
and the same is hereby finally passed and adopted, and tE-e—said
a�3,'�essments therein provided for, and all thereof, be and. the
same are hereby levied and assessed accordingly, and that the first
,-)f -_7zaj.d assessments are now due and payable to the City Treasurer
of the City of Kalispell, Montana, and same will become delinquent
on __ November �O 1 19 83 , at 5:00 P.M. of said day, and hereafter
the ann.ual payments as required sball become delinquent on the last
J av o -F November of each year for which said annual amount is
6ue at 5:00 p.m. of said day.
The City Clerk is also hereby ordered to deliver to the Kalispell
City Treasurer a certified copy of this and the within and foregoing
Resolution No. - 3451 within two (2) days after its passing.
