The above described tract of land is to be known and designated as the AMENDED LOTS 16 & 17, MOUNTAIN VISTA ESTATES PHASE 4A.
I also certify that this division is made for the purpose of relocating a common boundary line between a single lot within a platted subdivision
and adjoining land outside a platted subdivision. A restriction or requirement on the original platted lot or original unplatted parcel continues to
apply to those areas pursuant to Section 76-3-207(1)(e), MCA.
The area that is being removed from one tract of record and joined with another tract of record is not itself a tract of record [Parcel A]. Said area
shall not be available as a reference legal description in any subsequent real property transfer after the initial transfer associated with the amended
plat on which said area is described, unless said area is included with or excluded from adjoining tracts of record pursuant to
24.183.1104(1)(f)(iii)(C), ARM.
We hereby certify that this division creates parcels of land that have no existing facilities for water supply, wastewater disposal, and solid waste
disposal other than those that were previously approved by the reviewing authority under Title 76, chapter 4, part 1, if:
no new facilities will be constructed on the parcels (Lots 16A & 17A);
and the division of land will not cause approved facilities to violate any conditions of approval. Therefore, this division is exempt from review
by the Department of Environmental Quality pursuant to ARM 17.36.605(2)(b)(i)&(ii).
The undersigned hereby grants unto each and every person, firm or corporation, whether public or private, providing or offering to provide
telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the right to the joint use of an easement for the
construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and across each area designated on this plat as
"Utility Easement" to have and to hold forever.
