cable television, water or sewer service to the public, the right to the joint use of an easement for the construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and
across each area designated on this plat as "UTILITY EASEMENT" to have and to hold forever.
We hereby certify that the tracts are within a master planned area and that municipal services for water supply, sewage disposal and solid waste disposal are available to said tracts of land; therefore, these

TOUCHSTONE, LLC, hereby waives any and all right to protest which it may have in regards to any attempt to be made by the City of Kalispell, to initiate a special improvement district for update of
roads in the area to the City Standards which are impacted by this subdivision. Provided however, that TOUCHSTONE, LLC understands that it retains the ability to object to the amount of assessment
imposed as a result of the formation of a Special Improvement District. TOUCHSTONE, LLC agrees that this covenant shall run to, with and be binding on the title ofthe real property described above and
