RESOLliT'ION NO. 3448
A RESOLUTION LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN
SPECIAL IMPROVEMENT DISTRICT NO. 334 TO DEFRAY THE COSTS OF
MAKING THE SPECIAL IMPROVEMENTS AUTHORIZED THEREIN.
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL Or THE CITY OF
KILISPELL, MONTANA, AS FCLLO'v;S :
To defray the casts of making the special improvements
�.�..iorized in that area included with Special Improvement
District No. 334 of the City of Kalispell, as more particularly
ZQsbribed in Resolution No. 3371 dated October 5, 1981 and on
i::i.le in the office of the City Clerk -Treasurer, and is hereby
levied and assessed against all said property a tax in the total
sur; of $ 1l.,000.00 , plus interest as hereinafter provided.
Said sun includes all costs of making said improvements and as
alicyod by Sections 7-12--4169, 7-12--4121, and 7-12-4122 MCA, and

upon completion and acceptance of said improvements.
Said levy and assessment as is made hereunder against each
lot or parcel of land within said district also whall include
accruing interest thereon at the rate of 14.50% until paid from
the date or registration of bonds sold and issued in accord
.with Resolution No. 3373, dated October 5, 1981, and if same is
not paid in full when so levied and assessed, said sum shall,
with interest at 14.50%, be spread over a term of not to exceed
ten (10) years, payments to be made in equal annual installments
as provided in Resolution No. 3373 dated October 5, 1981.
Each lot or parcel of land within said district shall be
as.no sed as follows:
(z, The total cost of paving and curbing within said
Apecial Improvement District No. 334 together with all the costs
of ennineering and administration on Special Improvement District
No. 334; the sum of $14,000.00; shall be assessed against each
iot within the district for that part of the whole cost which
its area bears to the area of the entire district.
The description of each lot or parcel within said district
and the name of its owner and the amount chargeable thereto in
accord with the foregoing method of making and determining the
-assessment and the amount of each partial payment thereof, including
_merest, and the dates when same shall become delinquent is set
forth on Exhibit "A" attached hereto and which, by this reference,
does become a part hereof.
The City Clerk --Treasurer is hereby directed to publish Notice
heroof as provided by Sections 7-12-4176(3), 7-12-4177, and
1-12-4178 MCA. This council will meet and hear any objections to
said levy and assessment and take final action thereon at the
regular meeting of the City Council at the Council Chambers, City
Eall, Kalispell, Montana, commencing at 7:30 P.M. on the 20%
c''c'y of _ December . 1982; and said notice shall so provide.

WHEREAS, the within and foregoing Resolution No. 3448
signed by the Mayor and City Clerk of the Council of the City of
Kalispell, Montana, was filed in the office of said Clerk of the
Council on the 6th _ day of December � , 198 2 , and has
since that date been on file in said office, subject to inspection,
and the Clerk of the Council having given notice of the passing and
filing of said Resolution by publication in the Daily Inter Lake, a
newspaper printed and published in the City of Kalispell, Montas:a,
at least five days before the date set -herein for hearing objec-
tions thereto, and the City Council having been in session -it the
t.ime_ and place for the hearing of objections, and no owner, or
- o,�^a:=L of any owner of lots-, pieces or parcels of land situated
v,i":.Iin said Special Improvement District No. 334 or any others person,
appeared and protested against or objected to the f i1al

RESOLUTION NO. 3449
A RESOLUTION TO ADOPT THE FEES, SCHEDULES, RATES, CHARGES AND CLASS-
IFICATION IMPOSED ON THE CUSTOMERS OF THE CITY OF KALISPELL SEWER
UTILITY.
WHEREAS, pursuant to authority granted to municipalities opera-
ting utility services by Section 69-7--101, M.C.A., the City of
Kalispell did consider it proper to amend the fees, schedules, rates,
charges and classifications imposed for utility services to its in-
habitants and other persons served by the City of Kalispell Sewer
Utility; and
WHEREAS, said proposed amended fees, schedules, rates, charges
and'Classifications are reasonable and just and do not contemplate
��.:iie said changes will yield more than a 12% increase in the total
a-,,,iu nt of annual revenue accruing to the City of Kalispell. Sewer
'7til_ii-y, except to produce the additional amounts necessary to meet
_:,c requirements of bond indentures or loan agreements to finance
City's share of mandated Federal and/or State capital sewer
improvements; and
'EREAS, the City Council did, on the 18th day of October, 1982,
Pe'--iolution No. 3445, set a public hearing to be held on Decem-
?„ 1982, on said proposed amendments to the fees, schedules,
charges and classifications of the Sewer Utility Services- of
City of Kalispell; and gave the necessary Notice thereof as re -
by Section 69-7-111, M.C.A.; and
1^�IHEREAS, due and proper Notice of said Public Hearing has been
ter=vpFl by the City Clerk -Treasurer by publication and mailing as re --
<{:-sired by law; and
WEEREAS, said public hearing was duly held by the City Council
== a public meeting thereof in the Kalispell City Hall beginning at
P.11., on December 6, 1982, and all persons appearing at said

SECTION I. That the fees, schedules, rates, charges and c.lassi-
fic:ations appapplicable to the use of the City of Kalispell Sewer.

City of Kalispell Sewer Utility, adopted by Resolution No. 3386 on
the 21st day of December, 198.1, as set out in Exhibit "B", attached
hereto and by this reference made a part hereof, remain in effect
for the operation of the City of Kalispell Sewer Utility.
