Resolution 3448 - Budget - SID 33467 RESOLUTION NO. 3448 A RESOLUTION LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 334 TO DEFRAY THE COSTS OF MAKING THE SPECIAL IMPROVEMENTS AUTHORIZED THEREIN. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF KILISPELL, MONTANA, AS FCLLOWS: _,To defray the costs of making the special improvements iorized in that area included with Special Improvement District No. 334 of the City of Kalispell, as more particularly ZQsbribed in Resolution No. 3371 dated October 5, 1981 and on lile in the office of the City Clerk -Treasurer, and is hereby levied and assessed against all said property a tax in the total u m Of $.- 1�.' 0()0. 00 plus interest as hereinafter provided. Said sum includes all costs of making said improvements and as alicyod by Sections 7-12-4169, 7-12-4121, and 7-12-4122 MCA, and As curtified to the City Clerk -Treasurer by the City Engineer upon completion and acceptance of said improvements. Said levy and assessment as is made hereunder against each lot or parcel of land within said district also whall include accruing interest thereon at the rate of 14.50% until paid from the date or registration of bonds sold and issued in accord with Resolution No. 3373, dated October 5, 1981, and if same is not paid in full when so levied and assessed, said sum shall, with interest at 14.50%, be spread over a term of not to exceed ten (10) years, payments to be made in equal annual installments as provided in Resolution No. 3373 dated October 5, 1981. Each lot or parcel of land within said district shall be asnossed as follows: (11 The total cost of paving and curbing within said S 17 pecial Improvement District No. 334 together with all the costs of ennineering and administration on Special Improvement District No. 334; the sum of $14,000.00; shall be assessed against each iot within the district fbr that part of the whole cost which its area bears to the area of the entire district. The description of each lot or parcel within said di5trict and the name of its owner and the amount chargeable thereto in accord with the foregoing method of making and determining the - assessment and the amount of each partial payment thereof, including interest, and the dates when same shall become delinquent is set forlh on Exhibit "A" attached hereto and which, by this reference, do&s become a part hereof. The City Clerk -Treasurer is hereby directed to publish Notice hefoof as proVided by Sections 7-12-4176(3), 7-12-4177, and 1-12-4178 MCA. This council will meet and hear any objections to said levy and assessment and take final action thereon at the ingular meeting of the City Council at the Council Chambers, City Eall, Kalispell, Montana, commencing at 7:30 P.M. on the 20% c'c'Y Of — December r 1982; and said notice shall so provide. WHEREAS, pursuant to authority granted to municipalities opera- ting utility services by Section 69-7-101, M.C.A., the City of Kalispell did consider it proper to amend the fees, schedules, rates, charges and classifications imposed for utility services to its in- habitants and other persons served by the City of Kalispell Sewer UtIlity; and WHEREAS, said proposed amended fees, 5,chedules, rates, charges and'Classifications are reasonable and just and do not contemplate .1 t,ie_ s;aid changes will yield more than a 12% increase in the total a-,,,iount of annual revenue accruing to the City of Kalispell. That the fees, schedules, rates, charges and classi- fications7ip—plicable to the use of the City of Kalispell Sewer S' 1' and other services performed by said utility as set forth f'-`,�hibit "A" attached hereto and by this reference made a part -are found to be just and are hereby established and adopted to be imposed for sewer utility services to the inhabitants of the City of Kalispell and those other persons served by its sewer utility service. SECTION II. The Rules and Regulations for the operation of the City of Kalispell Sewer U-t-ility, adopted by Resolution No. 3386 on the 21st day of December, 198.1, as set out in Exhibit "B", attached hereto and by this reference made a part hereof, remain in effect for the operation of the City of Kalispell Sewer Utility. a
