Resolution 3442 - Adopts Amendments to Land Use PlanrV3 tl r"d RESOLUTION NO. 3442 A RESOLUTION TO REVISE CERTAIN RECOMMENDED AMENDMENTS . TO THE KALISPELL LAND USE PLAN AND TO ADOPT AMENDMENTS TO THE KALISPELL LAND USE PLAN. WHEREAS, the City Council of the City of Kalispell, Montana, did on the 21st day of October, 1974, adopt the Comprehensive Plan for the Kalispell Planning area, and WHEREAS, the City -County Planning Board included in its Work Plan and operation Program for Fiscal Year 1981-82 an "update of the -Kalispell Comprehensive Plan to include amendments which reflect desirable changes resulting from unforseen circumstances and changing trends"I and WHEREAS, during the fiscal year 1981-82, the Flathead Regional Development Office did review and evaluate the Kalispell Comprehensive Plan amendments in terms of environmental impact, site potentialities and availability of services; and thereafter did draft its report and recommendations and direct said report and recommendations to Ealispell City -County Planning Board, and ��,'TJEREAS, the Kalispell City -County Planning Board did on the 13 th da �y of july, 1982, at 7-30 P.m., in the Council Chamber,-, of the City Kalispell, Montana, hold a public hearing after proper notice, �!-c-ceived public comment upon the report and recommenda-tions of Flathead Regional Development Office, and 1 7 JIEREAS, after consideration of the report, recommendations and s� 'T lc�,jostions elicted at said public hearing, the Kalispell City -County I - _­1 D n i'J1 ;Ang Board did by Resolution (#KPA-82-003), pursuant to Section 76-1-603, M.C.A., recommended to the City Council of the City of Mon -Lana, and the Board of County Commissioners of Flathead, Montana, that the Kalispell Tand Use 21,an -be avaendaed, a.11d '__!_-]'REAS on the 13th day of August, 1982, the Board of County Cc.,:, mii_!�,­,ioners, Flathead County, I-4ontana, did adopt ResolutJon 0.11�' Intent 4ir46S, Fimending the Comprehensive Plan for the Kalispell Planning a rid '­�"_RREAS, the City Council of the City of Kalispell considered 4_ 1— aavisable that they consider the recommendations of the Kalispell City -County Planning Board and adopt a Resolution of Intention to revise or reject recommended amendments to the Kalispell C`c.-�,­,�,,rehensive Plan for the Kalispell Planning Area (Resolution No. 3L40), and WHEEREAS, on the 14th day of September, 1982, the Board of 07,'unty Commissioners, Flathead County, Montana, adopted Resolution 4465-A, amending the Comprehensive ?Ian for the Kalispell Planning Area as follows: 1. The area South of Highway #2 to Ashley Creek from Dern Road to the Lumber Company be designated "Urban" with a "greenbelt" along the lcngth of Ash-lEy Creek. 2. The area bounded by Three and Four Mile Drive, Stillwater Road and Northridge - Sunset Addition be changed to "Urban". 3. The area of the Bluffs subdivision and the Connie Morse property (as of this date of July 13, 1982), be desig- nated as "Suburban". 4. The area between Kings Way and B.N.R.R. (Plum Creek properties), be.designated "Industrial". - 5. The area between Kings Way and the Whitefish River and along West Evergreen Drivebe'desigpated as "Suburban". I 6. The area East of:Hillcrest Estates and the end of Riverside Drive be designated as "Suburban" with a greenbelt along the'Whitefish River. 7. The area West of River Road to B.N.R.R. and the area South of Westwood Lane and Stillwater River be designated "Suburban". 8. The area North of East.Reserve Drive, between Spring Creek and Alpine Lane, be designated " Suburban". 9. The area of Panoramic Heights and Sunrise Terrace I & 2 be designated "Suburban" with 250-300 foot depth of Commercial in the vicinity of the inter- sections of Panoramic Drive, Harbin Hill and Sun- rise Drive with old Highway #2. 10. The area North of Solberg Drive between Spring Creek Drive and Helena Flats Road be designated "Suburban". il. The intersection of Bernard Road and U.S. 42 be designated "Commercial". 12.. The area along LaSalle Road (now U.S. #2), from K-Mart to Evergreen School and from Earl's Tire Center to two lots North of the intersection of Evergreen Drive be designated "Commercial" to a depth of 200 feet from the roadway. 13. The area along U.S. #2 near Montclair Drive and Flathead Drive and South of U.S. #2 from Seaman Mobile Homes to Golden Wheels be designated ItCommercial". The area along the South side of U.S. #42, North of the Conrad Recreational area be designated "Commercial". 15. The area East of the intersection of Northridge Drive and 93 North be designated "Commercial" with a greenbelt buffer. 1G. Residential uses within the proposed Commercial and Industrial districts designation shall not be limited in reconstruction, construction or alteration of residential and attended structures. 17. The plan change boundaries are recognized to be subject to reasonable alteration at the time of formal zoning action. WHEREAS, on the 20th day of September, 1982, the City Council of the City of Kalispell,'Montana, met and considered the Resolution No. 3440. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, THAT THE COMPREHENSIVE PLAN FOR THE KALISPELL PLANNING AREA, REFERRED TO ABOVE BE AMENDED AS FOLLOWS: A. Amend Figure III -I, Chapter 3, Page 9, as follows in re,ference to attached Exhibit "A": 1. Area North of East Reserve' Drive, between Spring Creek and Alpine Lane, be designated "Suburban". 2. The area of Panoramic Heights and Sunrise Terrace I & 2 be designated "Suburban" with 250-300 foot depth of Commercial in the vicinity of -the intersections of Panoramic Drive, Harbin Hill, and Sunrise Drive with Old Highway #2. 54 3. The area North of Solberg Drive between Spring Creek Drive and Helena Flats Road be designated "Suburban". 4. The intersection of Bernard Road and U.S. #2 be designated "Commercial". 5. The area along LaSalle Road (now U.S. #2), from K-Mart to Evergreen School and from Earl's Tire Center to two lots North of the intersection of Evergreen Drive be designated "Commercial" to a depth of not less than 200 feet nor more than 500 feet from the -roadway. 6. The use of land, which existed prior to the enactment of this Resolution and which is main- tained after the effective date of said Resolution, even though it does not comply to the use re- strictions applicable to the area in which it is situated is permitted and the use shall not be limited so as to prohibit the continuation, repair, renovation, maintenance and reconstruction of the use. 7. Residential uses within the proposed Commercial and In6ustrial. district designation shall not be limited in recon5truction, construction or alteration of residential and attended structures. 8. The plan change boundaries are recognized to be subject to reasonable alteration at the time of formal zoning action.
