Resolution 3437 - Call for Construction Bids, SID 33542 RESOLUTI014 NO. _3 `f 3 A RESOLUTION PROVIDING FOR THE CALL FOR CONSTRUCTION BIDS FOR SPECIAL IMPROVEMENT DISTRICT NO. 335. WHEREAS, the Mayor and City Council of the City of Kalispell, in -compliance with the statutes o; the State of Montana, did, on the 21st day of June, 1982, create Special Improvement District No. 335 of the City of Kalispell for the purpose of constructing a paved driving surface and gravel surface shoulder on West Arizona Street in all of that area included in, and in accordance with the terms and conditions as specified in Resolutions No. 3401 and No. 3413; and WHEREAS, the City of Kalispell Director of Public Works has prepared plans.and specifications for said construction. NOW THEREFORE, BE IT HEREBY RESOLVED: 1. That the City Clerk -Treasurer forthwith call for bids for construction in accord with the laws of the State of Montana. 2. That the Notice of said call for bids be in the substan- tial form of and contain the provisions. of Exhibit "A" attached hereto.. At a meeting of said Council at said time and place said bids received will be publicly opened and read; bids received thereafter will not be considered. The work involved is for the construction of work for SID #335, created on June 2.1, 1982, by Resolution No. 3413 and is specified in plans and specifications as outlined and on file at the following address: Department of Public Works, . P.O. Box 1035, Kallispell, Montana 59901. Said Resolution and Resolution "n. 3401 contain more particular description of said district and are on file i�. the City Clerk's office, Kalispell City Hall. Each bidder must display his current Montana Contractor's License, class 7r.d number . All bids must expressly covenant that if the bidder shall be awarded the ccznt?:act the bidder will, within 30 days z.!"ter such award, enter into a formal n::i=racL and give good sufficient bond to secure the performance of the terms and 40 condi.tions of the contract; otherwise, the bidder shall pay unto the City of K�:_'.j st ell the difference in money between the amount of the bid of the said bi.:`d(-__r and the amount for which the City of Kalispell legally contracts with zznot!-.er party to supply said property if the latter amount is more than the former, but in no event shall the bidder's liability or the liability of the t•llirety of such bidder exceed the penal sum of 10% of the bid. All bidders shall, as bid securtiy, accompany the bid with such sum, to -wit: 10% of the bid, in law- fil money of the United States, or a cashiers check, certified check, bank money o.C1,:r, or bank draft, in any case drawn and issued by any banking corporation in- 'coirporated under the laws of the State of Montana or by a national banking r . as:=ojciation located in the State of Montana, or by an acceptable bid bond or bonds executed by a surety corporation authorized and licensed to do business in the State of Montana, or certificates of deposit or money market certificates is!�ued by any bank or savings and loan association licensed to c2o business in ;�ontana. Any such bank instrument or bond shall be payable directly to the City of Kalispell. A bond or similar bank instrument will be required of the successful bidder in the amount of one -hundred percent (1000) of the aggregate of the proposal for the faithful performance of the contract, pay all laborers, mechanics, sub -- contractors, material men and suppliers on said project; and, further, said con- tractor must provide protection of the City of-Kalispell.against the liability of accidents. 14 A successful biddcr will also be required tc comply with Secti.ck 39-3-??3, M.C.A.; also, a successful bidder will have to abide by Federal and State of Montana minimum wage and fringe benefit laws, particularly Section 18--2-401, et seq., M.C.A. If a contract is awarded, the bidder whose bid is accepted and who shall thereafter refuse to enter into and execute the proposed contract, as stated in said covenant, shall absolutely forfeit such monies or bank instruments to the City of Kalispell, and becomes immediately liable on said bid bond to said sum. The Money, bank instrument or bid bond, as the case may be, shall be returned to those bidders whose bid is not accepted. A reasonable charge may be made for copies of the bid documents. The successful bidder will be furnished additional copies thereof without charge as requited. The successful contractor will be required to carry Workmen's Compensation t.nCer Plan Number Three of the Workmen's Compensation Act of Montana, and upon aival settlement with the contractor, the City of Kalispell will deduct all un- Paid premium assessments for the Industrial Accident Fund, which the contractor ':= s nat paid on the labor employed by him but for not more than the amount of the contract. The City of Kalispell may accept the lowest responsible bid, but the Council ruse=:os +he right to waive any technicality or informality and accept any bid wl i.ch may he deemed best- for the interests of the said district and the City of Kalispell. The City Council may reject any and all bids or proposals should it 10cm this for the public good, and also reject the bid of any party who has been Ql_ Aquent oz unfaithful in any former contract wit b the City of Kalispell., and tf:a City shall reject all proposals or bids other than the lowest regular proposal or bid of any responsible bidder and may award the contract for said work or im- provement to the lowest responsible bidder at the price named in said bid.
