A RESOLUTION PROVIDING -FOR THE CALL FOR CONSTRUCTION BIDS FOR
SPECIAL IMPROVEMENT DISTRICT NO. 335.
WHEREAS ' the Mayor and City Council of the City of Kalispell,
in -compliance with the statutes oil the State of Montana, did, on
the 21st day of June, 1982, create Special Improvement District
No. 335 of the City of Kalispell for the purpose of constructing
a paved driving surface and gravel surface shoulder on West
Arizona Street in all of that area included in, and in accordance
.With the terms and conditions as specified in Resolutions No. 3401
and No. 3413; and
WHEREAS, the City of Kalispell Director of Public Works has
prepared plans.and specifications for said construction.
NOW THEREFORE, BE IT HEREBY RESOLVED:
1. That the City Clerk -Treasurer forthwith call for bids
for construction in accord with the laws of the State of
Montana.
2. That the Notice of said call for bids be in the substan-
tial form of and contain' the provisions of Exhibit "A"
attached hereto..

HEREBY GIVEN, that sealed proposals for the
construction of paved
driving surface
and gravel surface shoulder on West Arizona
Street for the City
of Kali spell, Montana, will be received by the City Council
at Kalispell, -Montana,
iintil 7:30 P.M.,
September 7, 1982 All proposals
shall be addressed to
the City Clerk,
City of Kalispell, and plainly marked "SID
n"335 Construction".
At a meeting of
said Council at said time and place said bids received will be
publicly opened
and read; bids received thereafter will not
be considered.
The work involved is for the construction of work for SID #335, created on
June 21, 1982, by Resolution No. 3413 and is specified in plans and specifications
as outlined and on file at the following address: Department of Public Works,
P.O. Box 1035, Kallispell, Montana 59901. Said Resolution and Resolution
!To. A401 contain more particular description of said district and are on file
Lhe City Clerk's office, Kalispell City Hall.

All bids must expressly covenant that if the bidder shall be awarded the
cczntract the bidder will, witbin 30 days, e-.!Tter si3�ch award, erter into a formal

condi.tions of the contract; otherwise, the bidder shall pay unto the City of
K�:_Ijspell the difference in money between the amount of the bid of the said

z�not!-.er party to supply said property if the latter amount is more than the
former, but in no event shall the bidder's liability or the liability of the
��llirety of such bidder exceed the penal sum of 10% of the bid. All bidders shall,
as bid securtiy, accompany the bid with such sum, to -wit: 10% of the bid, in law-
ftil money of the United States, or a cashiers check, certified check, bank money
oC1,C.v, or bank dra"ft, in any case drawn and is5ued by any banking corporation in-
'coirporated under the laws of the State of Montana or by a national banking
as-ociation located in the State of Montana, or by an acceptable bid bond or
bonds executed by a surety corporation authorized and licensed to do business
in the State of Montana, or certificates of deposit or money market certificates
S!�Ued by any bank or savings and loan association licensed to r4o business in

tana. Any such bank instrument or bond shall be payable directly to the City
of Kali -spell.
A bond or similar bank instrument will be required of the successfu I bidder
in the amount of one -hundred percent (100%) of the aggregate of the proposal for
the faithful performance of the contract, pay all laborers, mechanics, sub-
contractors, material men and suppliers on said project; and, further, said can -
tractor must provide protection of the City of _Kaiispell.again9t the liability
of accidents.

A successful biddcr will also bc rcquired tc comply with Sectick 39-3-??3,
M.C.A.; also, a succes5ful bidder will have to abide by Federal and State of
Montana minimum wage and fringe benefit laws, particularly Section 18-2-401,
et seq., M.C.A.
If a contract is awarded, the bidder whose bid is accepted and who shall
thereafter refuse to enter into and execute the p;oposed contract, as stated in
said covenant, shall absolutely forfeit such monies or bank instruments to the
City of Kalispell, and becomns immediately liable on said bid bond to said sum
The Money, bank instrument or bid b6nd, as the case may be, shall be returned
to tho5e bidders whose bid is not accepted.
A reasonable charge may be made for copies of the bid documents. The
auccessful bidder will be furnished additional copies thereof without charge as
requiyed.
The successful contractor will be required to carry Workmen's Compensation
vnCer Plan -Number Three of the Workmen's Compensation Act of Montana, and upon
fival. settlemAt with the contractor, the City of Kalispell will deduct all un-
Paid premium assessments for the Industrial Accident Fund, which the contyactor
has.nat paid on the labor employed by him but for not more than the amount of the
contract.
The City of Kalispell may accept the lowest responsible bid, but the Council
ruservos +he right to waive any technicality or informality and accept any bid
wlich may he deemed best for the interests of the said district and the City of
Kalispe3l. The City Council may reject any and all bids or proposals should it
10cm this for the public good, and also reject the bid of any party who has been
jQlAquent oz unfaithful in any former contract witb the City of Kalispell, and
tka CiLy shall reject all proposals or bids other than the lowest regular proposal
or bid of any responsible bidder and may award the contra ct for said work or im-
proveMent to the lowest responsible bidder at the price named in said bid.
