W I T N E S S E T H: WHEREAS, Katherine M. Erickson, also known as Katherine Miller, the owner of Lot 2, Block 218, Kalispell Townsite Company's Addition #3, has petitioned for the approval of the amended plat of said premises to be known as the "Amended Plat of Lot 2, Block 218, Kal- ispL,ll Townsite Company's Addition 0", and all persons having an inL-erest in said premises have, in writing, consented to the amend- ed plat of said premises, as required by Section 76-3-613, M.C.A., an(, WHEREAS, said plat amendment does qualify for summary review under the City of Kalispell Subdivision Rdgulations, and WHEREAS, the Flathead Regional Development office has reviewed and xecommended the City approve such plat amendment, and WHEREAS, the City Council, in considering this request has -.cztnd, from the preliminary plat and evidence relating thereto, ',-hat said plat amendment is in the public interest, and in making finding, the Council has considered and weighed (a) the �,)asj.s for the need for the plat amendment; (b) expressed public o�,,inion; (c) effects on agriculture; (d) effects on local services; fe ) effects on taxation; (f) effects on wildlife habitat, and (-�,) effects on th� public health and safety. N(TN THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY ()P ��'ALITSPELL, MONTANA, ECTION 1. The petition of Katherine M. Erickson, a/k/a Kath-- ��r i lie Miller, for an approval of the "Amended Plat of Lot 2, 131ock Kalispell Townsite Company's Addition #3" of the City of K.F.1- i�.ilpell, Montana, subject to the f'ollowing conditions- 1. That the landowner/developer waive the right to protest S.I.D.'s for curbs, sidewalks and storm drainage im- provements, and e_ Separate water and sewer services be provided for each lot. SECTION II. That the requirement5 for improvement drawings, Section 2.3, Subdivision Regulations of the City of Kaii-spell, is- hereby waived due to existing public facilities. 5ECTIONT III. The classification of said premises under the N ,,all.spell Zoning Ordinance shall not be changed by this action. SECTION IV. Thatno portion of said premises need be dedi- catL�od to the City for park purposes, and is exempt in accord with Section 76-3-606 (3), M.C..A.
