Resolution 3431 - Budget - Special Maintenance District 1RFS0T.UTT0N Nn, 3431 A RESOLUTION PURSUANT TO SECTION 7-14-4713, M.C.A., LEVYING AND ASSESSING A TAX UPON ALL PROPERTY IN SPECIAL PARKING MAINTENANCE DISTRICT NO. 1, TO DEFRAY THE COST OF MAINTAINING OPERATING AND IMPROVING SAID SPECIAL PARKING MAINTENANCE DISTRICT. WHEREAS, on the 8th day of September, 1981, the City Council of the City of Kalispell did, by Resolution No. 3365, create Special Parking Maintenance District No. 1 for the purpose of providing the funding of the cost of maintaining, operating, repairing and improving the public off-street parking lot and facility located on Lots 17 through 24, Block 46 of Kalispell, Montana; and WHEREAS, the City Council of the City of Kalispell did resolve z.n Resolution No. 3365 that the annual cost of said District should .ze determined each year depending on the net costs of the mainten- 0.nr_e, operation, repairs and improvements of the off-street parking lot located on Lots 17 through 24 of Block 46 of Kalispell after deducting the revenues received from the rental of automobile parking spaces thereon and the revenues received from rental of -jn-street parking spaces within the District and revenue from other City operated off-street parking lots as may be allocated to -such costs by the City Council. Such annual net costs shall be deter- mi,�(! d,,fixed, levied and assessed annually on an ad valorem basis on all property within the said District pursuant to the authority and procedures set forth in Section No. 7-14-4713, M.C.A.; and NBEREAS, the City Council of the City of Kalispell adopted Re- solution No. 3363 on August 10, 1981, which set forth the formula us:_-d for the Special Parking Maintenance District No. l as follows: l.- All revenues accruing to the City from rental of auto spaces on said "Eagles Lot" for any purpose are pledged first toward payment of the regular payments due on the purchase price committment of the City for the properties comprising said lots until same is paid in full; and any remaining revenues therefrom, until the purchase price is paid, and all revenues derived thereafter shall be then paid to the annual income of the said Special Parking Maintenance District No. 1 should same be created. If Special Parking Maintenance District No. 1 is not created, the Council will appropriate any such surplus revenue to further reduce any unpaid purchase price or to the General Fund. 2. All other revenues accruing to the City from on -- street parking or as the City's share of other public off-street parking lots operated by the City within the boundaries of said Special Parking Maintenance District No. 1, if created, is hereby pledged and al- located in the same amnner as set forth in Paragraph 1, above.. 3. The City Council will on an annual basis determine and allocate the percentage of City revenues from other on -street parking sources and off-street parking sources that is equitable for application towards any unpaid balance of the purchase prase of said "Eagles Lot" and towards the revenues of Special Parking [Maintenance District No. 1. 4. The City Council commits and pledges the said "Eagles Lot" will be used for public off-street automobile parking purposes for as long as it is reasonably necessary for such purpose, and no change in such use will be made un- less and until a Public Hearing is Noticed and held thereon and the Council then finds it in the best in- terest of the City that such use be changed. Said Resolution was a Resolution of Intention to provide for the funding of the cost of maintaining, operating and improving Special Parking Maintenance District No. 1; provide for a maximum estimate of total expenses connected therewith which must be collected by ad valorem taxes; to provide for a protest period; and to set a date for a public hearing for the passing on protest and provide a date for the fixing, levying and assessing of the amount to be raised by ad valorem taxes upon all the property within Special Parking Main- tenance District No. 1; and WHEREAS, the City Clerk --Treasurer dial cause to be published pursuant to Section 7-12-4106, M.C.A., in the Daily Inter Lake, a daily newspaper published in Kalispell, Montana, for five suc- cessz.ve days beginning on the 14th day of July, 1982, "Notice of Intention to Provide Funding of the Cost of Maintenance, Operation and improvement for Special Parking Maintenance District No. 1; and W,11EREAS, a copy of said notice was mailed, pursuant to Section ?v� 7-3.2-4106, M.C.A. , to every person, firm or corporation having real property within the proposed district listed upon the last tax .-s.�sessment rolls for State, County, and School District taxes, at f-lle last known address upon the same day said notice was first Iis1).e.d. 1'._ R AS, on the 4th day of August, 1982, the City Council of t3`= city of Kalispell did meet at 7:30 P.M. in the Council. SCOW THEREFORE, DE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL Off` THE CITY OF KALAISPELL, MONTANA, AS FOLLOWS: 1. To defray the cost of maintenance, operation and im- provment of Special Parking Maintenance District No. 1 of the City of Kalispell, which is more particularly described in Resolution No. 3365, dated September 8, 1981, and on file in the office of the City Clerk --Treasurer, and is hereby levied and assessed against all said property a tax in the total sum of $23,640.00. Said sum includes all cost of maintaining, operating and improving said Special Parking Maintenance Dis- 17r_ict No.. 1 as determined under the formula hereinabove set -- forth. 2. That the cost of maintaining, operating and improving Special Parking Maintenance District No. 1 shall be levied and assessed against each lot: or parcel of land in said Spe- cial Parking Maintenance District No. 1, except public streets and rights -of --way can the basis of 33.6 mills.per dollar of tax valuation_ ` 3. That the costof operating, maintaining and improving said Special Parking Maintenance District No. 1, or the sum of $23,640.00, be in amounts setforth opposite the description of each lot or parcel of land as shown on -the special assessment list in the office of the City Clerk -Treasurer. 1 4. The City Clerk -Treasurer will forthwith furnish copy of this resolution to the City Treasurer as provided by law..
