RESOLUTION NO. 3424
A RESOLU`1'ION TO APPROVE, AS A SUBDIVISION OF THE CITY OF KALISPELL,
THE RESUBDIVISION OF LOT 10, BUFFALO HEAD ADDITION NO. 92 OF THE CITY
OF KALISPELL TO BE KNOWN AS BUFFALO HEAD TOWNHOUSES NO. 10 OF. THE
CITY OF KALISPELL.
W I T N E S S E T, H:
WHEREAS, Stanley W. Pine, d/b/a Buffalo Head Properties, a
Partnership, the owner of Lot 10, Buffalo Head Addition No. 92, of
'.-he City of Kalispell, has petitioned for the approval of the resub-
;:1_1,vision of said premises to be known as Buff:aio Head Townhouses
10, and all persons having an interest in said premises havc,
3.,, writing, consented to the resubdivision of said premises, as ze-
,,.ri:ired by Section 76--3-613 M.C.A., and
WHEREAS, said resubdivision does qualify for summary review
.l approval under the provisions of the Subdivision Regulations of
t]ka City of Kalispell as now in effect, and
WHEREAS, the City Council of the City of Kalispell in a regu-
lazx:ly scheduled meeting on the 19th day of July, 1982, did waive
t:he submission of the preliminary plat and improvement drawings, and
14111EREAS, the Director of Public Works has written that all City
improvements were installed under S.Z.D. No. 328, and
;' r�.her that a change from condominium to townhouse buildings should
.-iio- result in any forseeable impact upon public facilities, and

No..3201., no further need for variance or conditional
pe-rimits are necessary as long as the plan is followed, and
1EREAS, it appears that the plan of development is being_ fol-

WHEREAS, the City Council in considering this request has
f(--,nd that said resubdivision is in the public interest, and in
such findings, the Council has considered and weighed
a. the basis of the need for the subdivision
b. expressed public opinion
C. effects on agriculture
d. effects on local services
e. effects on taxation
f. effects on wildlife habitat
g. effects on the public health and safety
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA,
SECTION I. The petition of Buffalo Head Properties, a partner-
ship, for the resubdivision of Lot 10, Buffalo Mead Addition No. 92
is hereby approved and same shall hereafter beicnown as Buffalo Head
.Cownhouses No. 10 of the City of Kalispell, Montana.
SECTION II. The classification of said premises under the
.alispell Zoning Ordinance shall not be changed by this action.
SECTION III. That no portion of Said premises need be dedicated
t-o the City for park purposes, and, in accord with Section 76-3-606
M.C.A., said petitioner shall forthwith pay to the City of Kalispell
for park.purposes, in lieu thereof, the sum of $ None, inasmuch as
the park requirment was met -.upon the original subdivision.

SECTION IV_ Upon payment of the aforesaid sum for park pur-
poses, and upon proper filing of the final plat of said resubdivision
in the office of the Flathead County Clerk and Recorder., said pre-
mises shall be a subdivision of the City of Kalispell.
PASSED AND APPROVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
ICALISPELL, THIS 4th DAY OF August , 1982.
