RESOLUTION OF INTENTION TO PROVIDE FOR THE FUNDING OF THE COST
OF MAINTAINING, OPERATING AND IMPROVING SPECIAL PARKING MAINTENANCE
DISTRICT NO. I; PROVIDE FOR A MAXIMUM ESTIMATE OF TOTAL EXPENSES
CONNECTED THEREWITH WHICH MUST BE COLLECTED BY AD VALOREM TA'!'%ES;
TO PROVIDE FOR A PROTEST PERIOD; AND TO SET A DATE FOR A PUBLIC
HEARING FOR THE PASSING ON PROTEST AND PROVIDE A DATE FOR THE
FI-XING, LEVYING AND ASSESSING OF THE AMOUNT TO BE RAISED BY AD
VALOREM TAXES UPON ALL THE PROPERTY WITHIN SPECIAL PARKING MAIN-
TENANCE DISTRICT NO. I.. I
. WHEREASI the City of Kalispell, on the 8th day of September,
1981, created by Resolution No. 3-365, Special Parking Maintenance
District No. 1, for the purpose of providing the funding for the
cost of maintaining, operating and improving the public off-street
parking lot and facility located on Lots 17 through 24, Block 46 of
the City of Kalispell, Montana; and
WHEREAS, the annual cost of the District shall be determined
each year depending upon the net cost of the maintenance, operation,
repairs and improvements of the off-street parking lot located on
Lot 17 through 24 of Block 46 of the City of Kalispell after deducting
the: revenues received from the rental of automobile parking spaces
thereon and the revenues received from the rental of on -street
parking spaces within the district and revenues from all other city
oper�.Lted off-street parking lots as maybe allocated to such costs
by the City Council. Such annual net costs shall be determined
fixed, levied and assessed annually on an ad valorem basis on all
property within the said District pursuant to the authority and
procedures as set forth in Section 7-14-4713, MCA; and
WHEREAS, the policy of the City Council as adopted by Resolution
No. 3363 on August 10, 1981, will be followed in determining the
net cost of said Special Parking Maintenance District No. I; and
WHEREAS, on the 24th day of June, 1982, the City Council,
pursuant to Section 7-14-4713, did make an Annual Statement and
Estimate of Expenses of said District and caused to be published
notice thereof; and
WHEREAS, it is the duty of the City Council of the City of
Kalispell.to have a hearing on said Statement and Estimate of'
Expenses and adopt it by Resolution of Intention; and
WHEREAS, the total estimate of all expenses connected with
the maintenance, operation and improvement of Special Parking
Maintenance District No. I is estimated not to exceed $40,000.00.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION 1: That it i"s the intention of the City of Kalispell
to provide for the fixing, levying, assessment and collection by
ad valorem taxes the estimated expenses of maintenance, operation
and improvement for the area described in Exhibit "A" attached
hereto and made a part hereof and identified as "Special Parking
Maintenance District No. I".
SECTION II. The Statement and Estimated Expenses as adopted
by the city Council shows that Special Parking Maintenance District
No. I, will require the additional sum of $26,753.56 after all
estimated revenues from various sources are allocated as per.Reso-
lution No. 3363; further it hasbeen determined that the total
cost shall in no event exceed the sum of $40,000.00.
SECTION III. The cost shall be levied and assessed against
each lot or parcel of land in said Special Parking Maintenance
District No I, except public streets and.rights-of-way on the
basis of 56.86 mills per dollar of taxable valuation.

SECTION IV. That on the 4th day of August, 1982, at 7:30 P.M.,
in the Council Chambers of the City Hall, in the City of Kalispell,
Montana, at a regular meeting of the City Council, the City Council
will hear and pass on any protests that may be . made against the
Statement and Estimate of Expenses for the cost of maintaining,
operating and improving Special Parking Maintenance District
No. I.
SECTION V. The City Clerk -Treasurer is hereby authorized and
directed to give proper notice of the passage of this Resolution
by publication to be made in a daily newspaper published in the
City of Kalispell, Montana
