RESOLUTION NO. 3410
RESOLUTION TO CONSIDER THE ANNEXATION OF TERRITORY TO THE_
CITY OF KALISPELL TO BE KNOWN AS THE "HUTTON ADDITION NO. 148"
AND TO FIX A DATE OF PUBLIC HEARING THEREOF; TO PROVIDE FOR
PUBLICATION OF A NOTICE OF SAID HEARING.
WHEREAS, Jack Hutton, Jr. and Evelyn P. Hutton, the
resident freeholders of certain real property (hereinafter
described) outside the corporate boundaries of the City of
Kalispell, Montana, being contiguous thereto, have filed with
the City of Kalispell a petition bearing the signatures of
51% of the resident freeholders in the hereinafter described
property stating that they desire to have said real estate
annexed to the City of Kalispell and requesting a Resolution
of Intent to Consent to Annexation of the hereinafter described
real estate to the City of Kalispell; and
WHEREAS, the Board of Trustees of the Flathead Valley
Community College have acquired an option to purchase real
property herein described from the owners, to -wit: Jack Hutton,
Jr. and Evelyn P. Hutton, husband and wife as'joint tenants; and
WHEREAS, at a special meeting of the Board of Trustees of
Flathead Valley Community College, held at 7:30 P.M., May 25,
1982, at Blake Hall, Kalispell, Montana, a motion was made and
seconded and duly passed by the Board of Trustees of Flathead
Valley Community College directing and authorizing Donald A.
Gatske, Ph. D., the President of Flathead Valley Community
College, to take the necessary steps in pursuit of annexing
the herein described to the City of Kalispell; and
WHEREAS, pursuant to said authority said Donald A. Gatske
has petitioned on behalf of the Board of Trustees of the
Flathead Valley Community College the City Council of the City
of Kalispell, Montana, requesting the City to consider the
annexation of the herein described real property; and
WHEREAS, the City of Kalispell is desirous of annexing
the within described property and that it is in the best
interest of the City of Kalispell that said petition be con-
sidered by the City Council of the City of Kalispell.
NOW AND THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF KALISPELL AS FOLLOWS:
SECTION I. It is the intention of the City of Kalispell
that certain territory comprising the "Hutton Addition No. 148"
shall be considered for annexation to the City of Kalispell.
Said territory is more particularly described as follows:
The Southwest Quarter of the Southwest Quarter
of Section 31, Township 29N, Range 21W, Montana
Principal Meridian, subject to any and all cov-
enants of record, consisting of approximately
37.88 acres, more or less.
SECTION II. A public hearing on said petition for annex-
ation will be held by the Kalispell City Council at its regular
meeting held in the.Council Chambers, Kalispell City Hall com-
mencing at 7:30 P.M. on the 19th day of July , 1982.
SECTION III: The City Clerk -Treasurer shall forthwith
prepare and publish in the Daily Interlake, a daily newspaper
published at Kalispell, Montana, proper notice of said
public hearing.
