Resolution 3404 - Resolution of Intention - Annexation - Outlaw Inn Add 1454 5 D RESOLUTION NO. 34o4 RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL, TO BE KNOWN AS THE "OUTLAW INN ADDITION NO. 14511, AND TO FIX THE DATE OF PUBLIC HEARING THEREON; TO PROVIDE THE PUBLICATION OF NO- TICE OF SAID HEARING. WHEREAS, Ronald W. Torstenson and Richard A. Dasen, dba The Outlaw Inn, has made a petition to the City of Kalispell for annex- ation to said City of certain territory to be known as "Outlaw Inn Addition No. 1451 and WHEREAS, the resident freeholders and all other parties having an interest in said property have signed said Petition for Annex- ation or have signed Consents to Annex of said property; and WHEREAS, the property subject to the Petition is contiguous to the City of Kalispell. WHEREAS, the desirability thereof has been reviewed and con- sidered in accordance with the laws of the State of Montana and the subdivision regulations of the City of Kalispell and it appears that it is in the best interest of the City of Kalispell and the inhabitants of the territory that said petition be granted. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I: It is the intention of the City of Kalispell that the territory comprising "Outlaw Inn Addition No. 145", shall be annexed to the City of Kalispell and shall be classified "Resort Business, B--6" as provided by the City of Kalispell Zoning ordi- nance. Said territory more particularly described as follows: A tract of land in the SzSW4 of Section 17, Township 28 North, Range 21 West, M.P.M., Flathead County, Mcitana, described as follows: Beginning at a point 66 feet Southerly from the South- west corner of Block 250 of Kalispell Company's Addi- tion Number Seven to Kalispell, according to the plat thereof on file and of record in the office of the Clerk and Recorder of Flathead County, Montana, and which point is on the Southerly continuation of the West line of said Block 250; thence Southerly along the Southerly continuation of the West line of said Block 250 a distance of 300 feet to a point; thence Easterly at right angles, parallel to the South line of 14th Street in Kalispell, Montana, a distance of 150. feet to a point; thence Northerly parallel to the Southerly continuation of the West line of said Block 250 a distance of 300 feet to the South line of 14th Street in Kalispell, Montana; thence Westerly at 'night angles along the South line of said 14th Street.a distance of 150 feet to the point of beginning. SECTION II. A public hearing on said Petition for Annexation will be held by the City Council at its regular meeting held in the Council Chambers in Kalispell City Hall commencing at 7:30 P.M. on the �_ day of -, 1982. SECTION III. A report required by Section 7-2-4731, Montana Code Annotated, plan: for extension of services, shall be available at the City Clerk -Treasurer Office at least 14 days prior to the 1 u I. date set for said public hearing. SECTION IV: The City Clerk --Treasurer will forthwith prepare and publish in the Daily Inter Lake, the daily newspaper published at Kalispell, Montana, proper notice of said public hearing. Said petitioners shall pay all the costs of publication of said notice.
