Resolution 3402 - Special Lighting District No 1RESOLUTION NO. A RESOLUTION OF INTENTION TO CREATE SPECIAL LIGHTING DISTRICT NO. to BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION I.. That it is the intention of the City of Kalispell, Montana, pursuant to Title 7, Chapter 12, Part 43, M_C_A., to create a Special Improvement Lighting Distsrict No. I for the following de- scribed -property: Area 1 Lots 2 through 12 inclusive, and the fronting 25' of Lot #1 in Block #35 of the Kalispell Original Townsite. Area 2 Lots l through 12 inclusive, in Block #46 of the Ralisp.ell Original Townsite. Area 3 Lots 1 through 7 and the fronting 25' of Lots 8 through 12 inclusive in Block 55 of the Kalispell Original Townsite. Area 4 Lots 1 through 11 inclusive and the fronting 25' of Lot 12 in Block 66 of the Kalispell Original Townsite. Area 5 Lots 2 through 11 inclusive and the fronting 25' of Lots 1 and 12 of Block 475 of the Kal-ispell Original Townsite. Area 6 Lots 14 through 23 inclusive, and the fronting 25' of Lots 13 and 24 in Block #76 of the Kalispell Original Townsite. Area 7 Lots 14 through 23 inclusive and the fronting 25' of Lots 13 and 24 of Block 465 of the Kalispell Original Townsite. Area 8 Lots 14 through 24 inclusive, and North 150' of Lot #1 and the fronting 25' of Lot #13 in Block #56 of the Kalispell Original Townsite. Area 9 Lots 13 through 24 inclusive and the Southern 150' of Lot #12 in Block #45 of the Kalispell Original Townsite. Area 10 Lots 13 through 23 and the fronting 1250 of Lot #24 in Block #36 of the Kalispell Original Townsite 447 SECTLkj Lam. That t.�a ge�,-cr��� c�s�.�ucL`� o� 4.� z��p�uv� mer.� to be made in said proposed Special Improvement Lighting District is the construction, erection and first year maintenance for 44 historical -decorative lights within the above stated district. SECTION III. That the estimated cost of such improvements is $75,000.00. SECTION IV. That the estimated cost of maintenance and supplying electrical current for the first year is $1,200.00. SECTION V. That the entire cost and expense of said im- provement shall be assessed against the entire district and each lot or parcel of land bordering or abutting upon the streets wherein the improvements are to be made is to bear the costs in proportion to the lineal feet abutting or bordering the streets whereinabove delineated. SECTION VI. That said assessment shall be paid in full upon the completion of the contract, or shall be paid in sixteen (1.6) equal semi --annual installments, hereby extending over a period of eight years. Said assessment shall constitute a fund to be known as Special Improvement Lighting District No. I. SECTION VII. That said improvements shall be paid for in Special Improvement Lighting District warrants issued against said district in sums of $100.00, or multiples thereof, each, bearing interest at a rate that is no greater than allowed by the law of the State of Montana from the date of registration until called for redemption or paid in full. SECTION VIII. That on the 4th day of August, 1982, at 7:30 P.M., in the Council Chambers of the City Fall of the City of Kalispell, Montana, at a regular meeting thereof, the City Council will hear and pass on any protests that may be made against the making of said improvements or the creation of said district. SECTION IX. The City Clerk is hereby authorized and directed to give the proper notice of the passage of this resolution by publication and mailing as required by law, such publication to be made in a daily newspaper published in the City of Kalispell, Montana.
