RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL,
TO BE KNOWN AS THE "GERARD ADDITION NO. 14411, AND TO FIX THE DATE
OF PUBLIC HEARING THEREON; TO PROVIDE THE PUBLICATION OF NOTICE OF
SAID�HEARING.
WHEREAS, a Gerard Building Company has made a petition to the
City of Kalispell for annexation to said City of certain territory
to be known as'"Gerard Addition No. 144"; and
WHEREAS, the resident freeholders and all other parties having
an interest in said property have signed said Petition for Annexa-
tion or have signed Consents to Annex of said property; and
WHEREAS, the property subject to the Petition is contiguous to
the City of Kalispell.
WHEREAS, the desirability thereof has been reviewed and consi-
dered in accordance with the laws of the State of Montana and the
subdivision regulations of the City of Kalispell and it appears
that it is in the best interest of the City of Kalispell and the
inhabitants of the territory that said petition be granted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL AS FOLLOWS:
SECTION I: It is the intention of the City of Kalispell that
the territory comprising "Gerard Addition No. 144", shall be annexed
to the City of Kalispell and shall be classified "General Commercial
B-3" as provided by the City of Kalispell Zoning Ordinance. Said
territory more particularly described as follows:
A Tract of Land in the SE-14 SE4, Sec. 12, T 28 N.R. 22W,
P.M.N. and more particularly described as follows;
Commencing at the SE Section Corner of Sec. 12, thence
S 89 16' 40" 264.00 feet; thence N. 0 30' E 103.00 feet
to the true point of the beginning of the tract herein
described; thence continuing N 030' W 530.00 feet; thence
S 89 161 40" 234.00 feet to the true point of beginning
containing 3.21 acres of land.
SECTION II: A public hearing on said Petition for Annexation
will be held by the City Council at its regular meeting held in the
Council Chambers in Kalispell City Hall commencing at 7:30 P.M. on
the 17th day of May , 1982.
SECTION III:, A report required by Section 7-2-4731, Montana
Code Annotated, plan for extension of services, shall be available
at the City Clerk -Treasurer Office at least 14 days prior to the
date set for said public hearing.
SECTION IV: The City Clerk -Treasurer will forthwith prepare
and publish in the Daily Inter Lake, the daily newspaper published
at Kalispell, Montana, proper notice of said public hearing. Said
petitioners shall pay all the costs of publication of said notice.

BY THE MAYOR ON THE 5th DAY OF APRIL, 1982.
