Resolution 3389 - Resolution of Intent - Annexation - Montana Power Add 1394 6 REWLUTION NO, 3389 A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL, TO BE KNOWN AS "MONTANA POWER ADDITION NO. 13911, AND TO FIX THE DATE OF PUBLIC HEARING THEREON; TO PROVIDE FOR PUBLICATION OF NOTICE OF SAID HEARING. WHEREAS, Montana Power Company has made petition to the City of Kalispell for.annexation to said City of certain territory to be known as Montana Power . Addition No. 139; and WHEREAS, a preliminary plat thereof has been reviewed and considered in accord with the laws of the State of Montana and the Subdivision Regula- tions of the CIty of Kalispell by the Kalispell City -County Planning Board and said Board has, by communication dated January 8, 1982, recommended that said petition be granted under certain conditions; and it appears that said conditions are or will be adequately satisfied, and that it is to the best interest of the City of Kalispell that said petition be granted, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: 1. It is the intention of the City of Kalispell that territory com- prising Montana Power Addition No. 139., shall be annexed to the City of Kalispell, and shall be zoned B-2 (Neighborhood Professional Business), as provided by the City of Kalispell Zoning Ordinance. Said territory is more particularly described as follows: A tract of land in the Southeast Quarter of the Northeast Quarter of Section 12, Township 28 North, Range 22 West, records of Flathead County, Montana, described as follows: Beginning at a point on the north line of and 30,00 feet west of the Northeast corner of the SEkNEh of said Section 12; thence running West along the north line of said subdivision a distance of 588.00 feet to a point, thence running South on a line parallel with the west line of said sub- division a distance of 220.50 feet to a point, thence -running. East on a line parallel with the north line of said sub- division a distance of 589.30 feet to a point 30.00 feet West of the section line, thence running North on a line parallel with the section line a distance . of 220,50 feet to the place of beginning, EXC EPTING Public Roads and Rights of Way, 2, A public hearing on said petition for annexation will be held by the Kalispell City Council at its regular meeting held in the Council Chambers of the Kalispell city Hall commencing at 7;30 P,M. on the 15th day of March, 1982. 3. The City Clerk-TreasuTer will forthwith prepa-re and publish in the Daily InteT Lake, a daily newspaper published at Kalispell, Montana, proper notice of said public hearing, Said petitioner shall pay all costs of publication of said notice. Highway No. 2 be- ginning on the west section line of Sec. .7, T. 28N., R. 21W., P.M.M. where said section line intersects the intersection of U. S. Highway No. 2 and Neridian Road, thence easterly on and within the boundary of said U. S. Highway No. 2 to the present Kalispell City Limits at the westerly right-of-way of Eighth Avenue West North. This portion of U. S. Highway No. 2 encom- passes approximately 800 feet of highway measured on centerline. TRACT I I That portion of the right-of-way of U. S. Highway No. 2 lying northerly and easterly of the north line of the NE14- SW-1-4, Sec. 8, T. 28N., R. 21W., P.M.M. between the present Kalispell City Limits and the westerly most portion of the Burlington Northern Railway overpass; said portion being approximately 500 feet in length.
