Resolution 3363 - Pledge re Public Parking Revenuei�48: RESOLUTION NO. 3363 A RESOLUTION TO PLEDGE ALL PUBLIC PARKING REVENUE FROM "EAGLES LOT` AND OTHER PARKING AREAS WITHIN SPECIAL PARKING MAINTENANCE DISTRICT NO. 1 AND STATING COUNCIL WILL DESIGNATE EQUITABLE PORTIONS OF PUB - LTC PARKING REVENUE FROM OTHER AREAS TO PAY TOWARD PURCHASE PRICE INSTALLMENTS ON "EAGLES LOT" AND REMAINDER TO REVENUES OF SPECIAL PARKING MAINTENANCE DISTRICT NO. 1, IF CREATED, PLEDGING "EAGLES LOT" TO PUBLIC PARKING. WITNESSETH: WHEREAS, the city has been committed to purchase lots 17, 18, 19, 20, 21, 22, 23 and 24 of Block 46 to Kalispell, known as "Eagles Lot" for public off-street auto parking purposes; and it was origin- ally intended that the purchase price of said lots would be paid from the sale of Bonds through a Special Improvement District formed for that purpose, but, due to protests made against it, said Special Im- provement District was not created; and it is to the best interests of the city that said "Eagles Lot" be retained and paid from some other source but sources therefor are very limited; and WHEREAS, there is now in the process of creation, Special Park- ing Maintenance.District No. 1 for the purpose of funding the net costs of maintenance, operation, repairs and improvement of said "Eagles Lot"sand the annual payments of the City for the purchase price of said "Eagles Lot" should and will be considered part of the oper- ating costs of said lot; and WHEREAS, the establishment of said "Eagles Lot" is of primary benefit to the area included within the said Special Parking Mainten- ance District No. 1, and of substantial benefit to other portions of the Downtown Redevelopment Area, it is proper that the parking rev- enue of the city from said District and the Downtown Redevelopment Area should be allocated and pledged by the City toward the payment of said purchase price; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWSz 1) All revenues accruing to the City from rental of auto spaces on said "Eagles Lot" for any purpose are pledged first toward pay- ment of the regular payments due on the purchase price commitment of the City for the properties comprising said lots until same is paid in full;and any remaining revenues therefrom,until the purchase price is paid,and all revenues derived thereafter shall be then paid to the annual income of the said Special Parking Maintenance District No. 1 should same be created. If Special Parking Maintenance Dis- trict No. 1 is not created, the Council will appropriate any such sur- plus revenue to further reduce any unpaid purchase price or to the General Fund. 2) All other revenues accruing to the City from on -street park- ing or as the City°s share of other public off-street parking lots operated by the city within the boundaries of said Special Parking Maintenance District No. 1, if created, is hereby pledged and allo- cated in the same manner as set forth in Paragraph 1, above. 3) The City Council will on an annual basis determine and allo- cate the percentage of city revenues from other on -street parking sources and off-street parking sources that is equitable for applica- tion towards any unpaid balance of the purchase price of said "Eagles Lot" and toward:, the revenues of Special Parking Maintenance District No. 1. 4) The City Council commits and pledges the said "Eagles Lot" will be used for public off --street automobile parking purposes for as long as it.is reasonably necessary for such purpose, and no change 1 1 1 i1 g in such use will be made unless and until a Public Hearing is Noticed and held thereon and the Council then finds it in the best interest of the City that such use be changed. Under any circumstance the City will be bound by any contract or agreement it may have with any agency of the United States Government as a result of any loan or grant therefrom assisting the City in the development of said "Eagles Lot" as a public parking lot.
