Resolution 3346 - Discontinue Alley01 0 RESOLUTION NO. 3346 A RESOLUTION FINDING THAT IT IS NOT TO THE DETRIMENT OF THE PUBLIC INTEREST THAT AN ALLEY IN KALISPELL ORIGINAL TOWNSITE, BLOCK 21, BE DISCONTINUED AND ORDERING THAT SAME BE VACATED AND CLOSED, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MON- TANA: WHEREAS, at a regular meeting of the City Council on the 15w day of June 1981, a petition, in writing was presented to said Council requesting the discontinuance and vacation of the fol- lowing described alley within said City, to -wit: That alley in Kalispell Original Townsite, Block ' 21, County of Flathead, State of Montana, accord- ing to the plat recorded with the Flathead County Clerk and Recorder, which alley bisects Block 21 from North to South, subject to existing utility easements. WHEREAS, at said meeting, upon motion duly made, seconded and passed by said Council, the City Clerk was ordered to publish Notice -that said petition would be acted upon at a meeting of said Council o be held on the 6th day of July , 1981, as provided by Sec- tion #7-14-4114, M.C.A.; and said Notice was duly published, as re- quired by law, at least one week prior to the date set for acting on t�aid petition; and WHEREAS, on this 6th day of July , 1981, the Council hav- ing duly met and convened and heard both proponents and opponents of said petition, NOW THEREFORE, the Council finds that after due consideration of all facts and data presented to it orally and in writing, that it is not to the detriment of the public interest that said petition be granted and said alley be discontinued. The Council further finds that said petition should be granted and that said alley be discon- tinued and vacated. The Council hereby orders the above --described alley be discon- tinued and vacated forthwith as provided by law; the City does, how- ever, reserve for utility purposes any and all utility uses exist- ing in said alley with the right to continue all utility plant and equipment therein and the right of ingress and egress for mainten- ance, repair, removal or replacement thereof.
