A RESOLUTION TO APPROVE AS A SUBDIVISION OF THE CITY OF KALISPELL,
MONTANA, RESUBDIVISION OF SOUTH, MEADOWS ADDITION NO. 89.
BE IT RESOLVED BY -THE CITY COUNCIL OF THE CITY OF KALISPELL, MON--
TANA:
SECTION 1. That pursuant to the petition of Jerry G. Begg, filed
with the City Council of the City of Kalispell, and the submission
to said Council by said petitioners of a preliminary plat reflect-
ing the survey and designation of that territory within the City
of Kalispell which said petitioners request be approved as a subdi-
vision therein, and pursuant to those provisions of Title 76, Chap-
ters 2 and 3, MCA, as amended, that are applicable thereto and the
duly adopted and enforced subdivision regulations of the City of
Kalispell., the Council and Mayor do hereby approve that said terri-
tory shall become and be a subdivision of the City of Kalispell to
be known as:
RESUBDIVISION OF SOUTH MEADOWS ADDITION NO. 89
SECTION 2. The City Council, in considering this request, has found
from the preliminary plat and evidence relating thereto, that appro-
val of said subdivision is in the public interest, and in making
such finding, the Council has considered and weighed: (a) basis of
need for the subdivision; (b) expressed public opinion; (c) effects
on agriculture; (d) effects on local services; (e) effects on tax-
ation; (f) effects on wildlife habitat, and (h) effects on the
health and safety.
SECTION 3. As a condition of said approval, however, petitioner
must agree to the following terms and conditions:
A) That the area is rezoned from "Residential
(Mobile Home) R-4 MH" to "Residential (Mo-
bile Home) R-5 MH".
B) That the alignment of existing and proposed
street intersections be brought into com-
pliance with the street design standards of
Section 5.2.11, Table 5-3 of the Subdivi-
sion Regulations of the City of Kalispell,
(i.e. minimum offset distance).
C) That.the 30-foot deadend street to Lot #81
be changed to become a part of Lot #81.
D) That the "street lots", to -wit: #10, 34, 48,
and 68 be dedicated to the City for future
street use, when needed.
E) That South Meadows Drive from Sunny View
Lane to Airport Road be improved to City
standards.
F) That the storm drain easement granted on the
original subdivision plat be amended to re-
flect the appropriate lot numberson the re --
subdivision plat, and the easement be shown
and dedicated on the final plat of the resub-
division.
G) That all sewer and water systems within the
resubdivision be constructed to City stan-
dards and the subdivider comply with Sec.
#6.9.1 of the Subdivision Regulations until
same are finished and accepted by the City.

SECTION 4. Park requirements having been met upon original subdi-
vision of South Meadows Addition No. 89, no additional park dedi-
cation or cash in lieu thereof is required. Also, all property
included in this subdivision shall retain the zoning classification
as presently applied thereto until changed by official City Coun-
cil action.
SECTION 5. Upon preparation of a final plat in accord with the
foregoing conditions, and upon approval thereof as provided by law
and proper filing thereof in the office of the Flathead County
Clerk and Recorder, said territory shall be a subdivision of the
City of Kalispell.

OF KALISPELL, MONTANA, THIS 15TH DAY OF JUNE, 1981.
