A RESOLUTION OF INTENTION TO ANNEX TERRITORY TO THE CITY OF KALISPELL,
TO BE KNOWN AS ARNDT ADDITION NO.-128 AND TO FIX TIE DATE OF PUBLIC
HEARING THEREON; TO PROVIDE FOR PUBLICATION OF NOTICE OF SAID HEARING.
WHEREAS, Robert F. Arndt, et al. have made petition to the City
of Kalispell for the annexation to said City of certain territory to
be known as Arndt Addition No. 128; and
WHEREAS, a preliminary plat thereof has been reviewed and con
sidered in accord with the laws of the State of Montana and the subdi-
vision regulations of the City of Kalispell by the Kalispell City -
County Planning Board and said Board has, by communication dated Feb.
24, 1981, recommended that said petition be granted under certain con-
ditions; and it appears that said conditions are or will be adequately
satisfied, and that it is to the best interest of the City of Kalis-
pell that said petition be granted,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
1) It is the. intention of the City ofKalispell that territory
comprising Arndt Addition No. 128 shall be annexed to the City of
Kalispell and shall be classified B-3 (General Commercial) as pro-
vided by the City of Kalispell Zoning Ordinance. Said territory is.
more particularly described as follows:
A tract of land lying and being in the NE4NW4,
Section 20, Township 28 North, Range 21 West,
P.M.M., Flathead County, Montana, and more par-
ticularly described as follows, to -wit:
Commencing at the N4 corner. of Section 20, thence
North 89' 214 00" West, a distance of 367.60
feet to the Westerly R/W of 5th Ave. East,
thence along said R/W
South 13° 211 East, a distance of 396.60 feet to
the true point of beginning of the tract here-
in described; thence along said R/W
South 130 21' East, a distance of 181.15 feet;
thence leaving said R/W -
South 76* 39' West, a distance of 559.00 feet to
the Easterly R/W of 3rd Ave. East, thence
along said R/W
North 13° 21' West, a distance of 192.8 feet;
thence leaving said R/W
North 76' 39' East, a distance of 226.0 feet;
thence
.South 130 21' East, a distance of 11.65 feet;
thence
.North 76' 39' East, a distance of 333.0 feet to
the True Point of Beginning.
2) A public_ hearing on said petition' for annexation will be held
by the Kalispell City Council at its regular meeting held in the Coun-
cil of the Kalispell City Hall commencing at 7:30 P.M. on the 20th day
of April, 1981.
3) The City Clerk will.forthwith prepare and publish in the
Daily Inter Lake, a daily newspaper published at Kalispell, Montana,
proper notice of said public hearing. Said petitioner shall pay all
costs of publication of -said notice.
