BACKGROUND: This application is a request from Patrick Jentz for a conditional use permit to
allow a second principal structure containing a second dwelling unit on the property at 469 First
Avenue EN. The project would involve removing an existing garage and constructing a new,
approximately 900 square foot house in its place off of the alley along with associated parking
spaces. The property is located in an RA-1 (Residential Apartment) zone. Under Section 27.20.080
of the Kalispell Zoning Ordinance, multiple principal structures are allowed subject to a conditional
use permit. The RA-1 zone has a minimum lot size of 6000 square feet and has a maximum density
of one dwelling unit per 3000 square feet. The subject property is 7000 square feet and would meet
the density requirement.
The property can be described as Lot 9, Block 230 of Kalispell Addition Number 5, as shown on the
map or plat thereof on file and of record in the office of the Clerk and Recorder, Flathead County,
Montana.
The Kalispell Planning Board held a duly noticed public hearing on April 13, 2020, to consider the
CUP request. Staff presented staff report KCU-21-02, providing details of the proposal and
evaluation. Staff recommended that the Planning Board adopt the staff report as findings of fact and
recommend to the Council that the request be granted subject to 5 listed conditions.
One written public comment was received prior to the meeting and one verbal public comment was
submitted at the hearing. The comment concerned having additional renters in the neighborhood and
the impact they would cause. The public hearing was closed and a motion was presented to adopt
staff report KCU-21-02 as findings of fact and recommend to the Kalispell City Council that the
conditional use permit be granted subject to the 5 conditions. Board discussion concluded that the
request was appropriate, and the motion passed unanimously on roll call vote.
RECOMMENDATION: It is recommended that the Kalispell City Council approve a request from
Patrick Jentz for Conditional Use Permit KCU-21-02, a conditional use permit for a second principal
structure containing a second dwelling unit on the property, subject to 5 conditions of approval within
the RA-1 Zoning District, located at 469 First Avenue EN, and more particularly described as Lot 9,
Block 230 of Kalispell Addition Number 5, as shown on the map or plat thereof on file and of record
in the office of the Clerk and Recorder, Flathead County, Montana.
FISCAL EFFECTS: There are no anticipated fiscal impacts at this time.
ALTERNATIVES: Deny the request.

Graham inquired about the sale of bread to feed the ducks at Woodland

Sorensen advised that this annexation would have no control over
whether the store sells bread or not, however he did point out that there
is a city ordinance against feeding the ducks but that is not the
responsibility of the store owner to monitor.

KZTA-21-01 — DOWNTOWN
A request by the City of Kalispell Planning Department on behalf of the
HISTORIC DISTRICT
Downtown Business Improvement District for a text amendment to the
Kalispell Zoning Ordinance for the creation of a Downtown Historic District
Overlay and the addition of the Downtown Historic District Design Standards.
The Business Improvement District received a grant from the Montana
Department of Commerce Main Street Program in 2020 to establish historic
design standards as part of an effort to implement the goals of the Downtown
Plan and Growth Policy. Staff, in conjunction with consultant A&E Architects,
has drafted the proposal.

Giavasis pointed out a few typos in the building materials and color
section. He also noted his concern for murals not being located on front
facing side corner facades. He suggested possibly changing that to no
more than 15% of one of those facades.

subpoint b of 27.21A.040 to say wall murals shall not be located on more
than 15% of the front fagade or the side facing fagade of a side corner lot

existing ghost sign.

Dear East North Resident,
Hello, my name is Patrick. I live at 469 15Y Ave EN. I grew up 3 blocks from here and have been blessed to
continue living in the Flathead Valley. I bought the house I am currently living in in 2017 and have
completed an extensive remodel of the home. Currently I am looking into the possibility of building a
small house behind my current house. The existing garage has seen better days and I want to replace
this with a new living unit.
This new unit will be about the same height as the existing house and positioned behind the house so
that it is mostly hidden form 15Y Ave EN (see attached site plan). I am planning on providing 4 parking
spots off the alley for the new unit and my existing house which will reduce issues with taking up more
parking along 15Y Ave EN.
The zoning in our neighborhood would allow me to build a duplex on my lot but in order to build two
separate houses, which I propose, I have to apply for a conditional use permit from the City of Kalispell
planning department. The planning department reviews all development that happens within the city to
ensure it is in line with the current standards and maintain the integrity of Kalispell being a great place
to work, play, and live in. As part of the conditional use permit, I will be submitting building plans
showing the proposed unit as well as how the project will impact the neighborhood. Once I submit my
application to the planning department, they will notify all property owners who live within 300 feet of
my property to see if they have any comments or concerns. Those property owners and the general
public will be invited to a public hearing held by the planning board to express any concerns. They can
also write a letter before the public hearing. The planning board will then hold a public hearing, accept
any public comments and make a recommendation to the city council. The city council will then review
the project and make a final decision whether or not to approve the project or approve it with special
conditions. I wanted to touch base with you, my neighbors, beforehand to let you know of my plans
and find out if you had any concerns. With this letter I have attached plans of what I am hoping to build
on the back half of my lot. I hope to submit this application to the planning department in March with
planning board review in April. If all goes well my hope would be to break ground in mid -summer.

EVALUATION OF THE REOUEST
This application has been reviewed in accordance with the conditional use review criteria in the
Kalispell Zoning Ordinance. A conditional use permit may be granted only if the proposal, as
submitted, conforms to all of the following general conditional use permit criteria, as well as to all
other applicable criteria that may be requested.

1. Site Suitability:
Adequate Useable Space: The subject property is one standard city lot, containing
approximately 7000 square feet. The entire project site is generally flat with no
significant impediments, thus leaving the entire site developable. When the project is
submitted for a building permit, the specific layout of the site, including parking,
will be addressed.
b. Height, bulk and location of the building: The single family home is existing. An
existing garage off of the alley will be removed in order to allow for the construction
of the second principal structure, which will be about 900 square feet. There are no
issues relating to height, bulk or location of the building in terms of setbacks, lot
coverage, or other property development standards under RA-1 zoning.
C. Adequate Access: The property has frontage on First Avenue EN, although the
primary vehicular access is from the alley. The proposal calls for a paved parking
area for four vehicles off of the alley. There is adequate access for the proposed
additional unit.
d. Environmental Constraints: There are no known environmental constraints, such as
steep slopes, streams, floodplains, or wetlands on the property, which could affect the
proposed use.
2. Appropriate Design:
Parking Scheme/Loading Areas: The proposal calls for a paved parking area for four
vehicles off of the alley. The zoning ordinance requires four parking spaces (two per

dwelling unit), each nine feet by twenty feet, for a total area of 36 feet in width and
20 feet in depth. There is adequate space for the parking needed to accommodate
the proposed additional unit and meet the required five foot side setbacks. Single
family and duplex uses are allowed to install parking immediately off of and backing
into an alley.
b. Lighting: Chapter 27.26 of the Kalispell Zoning Ordinance sets standards for all
outdoor lighting on commercial or residential structures. Exterior lighting installed in
conjunction with the project is required to meet the lighting standards.
C. Traffic Circulation: Access to the property will be installed directly off of the alley in
a typical residential configuration.
d. Open Space: There are no open space requirements associated with this residential
development per se, although there is a maximum lot coverage of 45% that can be
covered with structures pursuant to the zoning ordinance.
Fencing/Screening/Landscapinn : There are no screening or landscaping requirements
associated with one and two family developments, although it is anticipated that
typical residential landscaping, including lawn, will be installed/restored.
f. Signage: There is no signage anticipated as part of this project. Any signage which
may be used will need to comply with all of the sign standards as set forth in Chapter
27.22 of the Kalispell Zoning Ordinance.
3. Availability of Public Services/Facilities:
Police: Police protection will be provided by the Kalispell Police Department. No
unusual impacts or needs are anticipated from the project.
b. Fire Protection: Fire protection will be provided by the Kalispell Fire Department.
Station 61 is approximately 0.7 miles from the subject property, giving good response
time. The addition will be constructed subject to a building permit, ensuring that the
addition will meet building and fire code standards.
C. Water: City water is available and currently serves the property. A new service line
will need to be installed to serve the second structure.
d. Sewer: Sewer service is also available and currently serves the property. A new
service line will need to be installed to serve the second structure.
Storm Water Drainage: The design of the new structure will need to meet building
code requirements. Under the code, there needs to be positive drainage away from
the structure and steps taken to prevent diverting storm water across property lines.
f. Solid Waste: Solid waste pick-up will be provided by the City.

g. Streets: The street frontage is along First Avenue EN. No street improvements are
necessary based on the impact of the project.
h. Sidewalks: There is an existing sidewalk along the full frontage of the property along
First Avenue EN that adequately serves the property. No additional sidewalk
improvements are necessary.
i. Schools: This site is within the boundaries of School District 95. It would be
anticipated that one or fewer students on average would be attending a K-12 school.
Parks and Recreation: No parkland or recreational amenities are required because the
proposal is not a multi -family project or a residential subdivision with parkland
requirements.
4. Neighborhood impacts:
Traffic: There is minimal impact on traffic in connection with the proposed use, which
adds one dwelling unit to the property.
b. Noise and Vibration: The new structure will not create additional noise and vibration

d. Smoke, Fumes, Gas, or Odors: The new structure will not create additional smoke,
fumes, gas or odors beyond what would be expected in a residential context.
Hours of Operation: There are no hours of operation as it is a residential use.
5. Consideration of historical use patterns and recent changes: The property is located in
an existing residential neighborhood near a commercial area along Highway 93. The
neighborhood contains a mixture of single family and duplex uses. This particular block
is intended per the zoning map to be a buffer area between commercial and single family
uses to the east by allowing for multi -family uses as a transition.
6. Effects on property values: No significant impacts on property values are anticipated as
a result of the requested conditional use for the second structure/dwelling unit.
RECOMMENDATION
The staff recommends that the Kalispell Planning Board adopt staff report #KCU-21-02 as findings
of fact and recommend to the Kalispell City Council that the conditional use permit be approved
subject to the following conditions:

CONDITIONS OF APPROVAL
1. That commencement of the approved activity must begin within 18 months from the date of
authorization or that a continuous good faith effort is made to bring the project to completion.
2. That the development of the site shall be in substantial conformance with the submitted
application and architectural/site plan drawings.
3. Prior to construction, the applicant shall apply for a building permit through the City of
Kalispell Building Department to review the proposed structure and improvements.
4. All disturbed areas shall be improved with appropriate landscaping (e.g. lawn) or other
materials.
5. The new structure shall have separate water and sewer service lines installed per city
standards. The applicable impact fees associated with the new service lines shall be paid
by the applicant at the time the building permit is issued.

We are contacting you regarding one of the agenda items that will be up for discussion on Tuesday's meeting. This iterr
is: File #KCU-21-02, which is a request for a conditional use permit to allow a second single-family structure on a lot
within an RA-1 zone. We own a home across the street from this property and we would like to have on record that we
strongly oppose this request.
At this time, there are several rental homes on our block, one of which is already a multi dwelling rental. These
numerous rentals have caused additional traffic on our residential street and a lack of parking due to the number of
residents occupying these rental homes.
We have found that the residents that occupy rentals in our area do not adequately take care of the properties, such as
keeping up with lawn maintenance, winter sidewalk cleaning and general all around home maintenance. We are
concerned that having additional rentals will decrease our property value immensely.
Also, another valid concern is if the request is allowed for this property, it will open the opportunity for others to do the
same thing in our neighborhood.
We respectfully ask that you please take our concerns into consideration when making a decision on the request of this
permit.
