ORDINANCE NO. 1196
AN ORDINANCE TO AMEND SECTION 17-48.2, KALISPELL CITY CODE
(ORDINANCES NO.s 741 AND 907) TO PROHIBIT TRUCK TRAFFIC ON CERTAIN
STREETS WITHIN THE CITY OF KALISPELL; AND TO PROVIDE AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS:
SECTION I. That Section 17-48.2, Kalispell City Code is
hereby amended to read as follows:
For purposes of this section a truck is any vehicle
designed or operated for the transportation of property,
and whose body weight or whose combined body and load
weight exceed twelve thousand pounds.
It shall be unlawful for trucks to be operated over and
along Third Avenue East, and Fourth Avenue East, between
the intersection of such streets with Second Street East
and Fourteenth Street East, and over and along all of
Woodland Avenue and South Woodland Drive within the City,
and over and along Center Street East between 4th Avenue
and Woodland Avenue, and over and along 1st Avenue East
between Center Street and 13th Street, and 1st Avenue
East North between Center Street and Idaho Street, and
over and along 6th Avenue East North between Idaho Street
and Oregon Street, and on Oregon Street between Main
Street and Seventh Avenue East North, and on Mission
Street, Charlotte Avenue, and Buffalo Hills Drive south
of Crestline, unless otherwise provided herein.
This section shall not prohibit:
a) The operation of trucks upon such streets where
necessary to conduct business at a destination point
thereon within the city limits, provided, that streets
upon such traffic is permitted are used until reaching
the intersection nearest the destination point.
b) The operation of emergency vehicles upon such
streets.
c) The operation of trucks owned or operated by the
City, public utilities, any contractor or material man
while engaged in the repair, maintenance, or construction
of streets, street improvements or utilities within the
city.
d) The operation of unloaded trucks upon such streets
where such trucks are being driven to the owner's or

operator's premises for storage; provided, that streets
upon which such traffic is permitted are used until
reaching the intersection nearest the destination point.
Such streets above described shall be appropriately
designated and marked as prohibiting truck traffic.
SECTION II. This Ordinance shall be effective thirty days
from and after its final passage by the City Council and
approval by the Mayor.
