10/16/89 City Council MinutesA REGULAR MEETING OF THE KALISPELL CITY COUNCIL, VAS HELD AT 7:30 P.M. MONIDAY OCTOBER 16, 1989 IN THE ' OOUNCIL CHAMBERS AT CITY HALL. MAYOR KENNEDY PRESIDED. - 00LINCILMEN SAVERUD, ATKINSON AMID GUIUgEPMN WERE ABSENT. ALL OTHER CDUNCILME[SERS WERE PRESENT. Mayor Kennedy called the meeting to order and led the Pledge of Allegiance. CONSENT AGENDA Approve Minutes Special City Council Meeting September 25, 1989 Regular City Council Meeting October 2, 1989 Approve Claims City official Reports Treasurer's Report (September) Police Chief " City Judge " Building Official Fire Department Quarterly Report Councilman Schindler raved the consent agenda be approved as presented. Councilman Nystul seconded and the motion carried. BID OPENING Tractor for Parks Department 1. Davies, Inc., Kalispell, 10% bid bond, John Deere 1070 Tractor, Model 80 loader, $13,107.00 2. Stedje Brothers, Kalispell, 10% bid check, Ford 2120 Tractor, Model 7109 Loader, $17,495.00. Also bid Ford 2180 Tractor, Model 7209 Loader; $17,160.00. 3. Parsons Tractor & Implement Co., 10% bid check, Kubota L-33250F Tractor, BF 550 Loader, $12,749.00. Councilman Furlong moved the bids be referred to the Parks Ccmudttee to review and report back. Councilwoman Hafferman seconded and the motion carried. PUBLIC HEARINGS: Fpansion of Redevelopment District Mayor Kennedy called upon City Attorney Neier who explained the purpose of the Public Hearing. Mayor Kennedy then opened the public hearing. Ross Plambeck, of the Ccn=ity Development Department explained what projects could be undertaken in the district. Councilman Furlong explained that, if it is decided the district is expanded, and if parking lots are to be built, no one's property will be taken without appraisals being done and the property owners' cooperation. One citizen asked that Sewer and Water System repairs be given a high priority. Bob Allen, 805 4th Avenue West, favored the project, Janet Denton, 805 5th Avenue West, supported improved parking. Commmity Development Director Gallagher said expansion of the district would not change the people's property taxes. Donna Price, 328 7th St. W., asked how soon she would have to move and how will the value be determined. Mayor Kennedy said the time frame can't be determined now. Councilman Furlong said it would be at least a year. He also said, in his opinion, conde,mation of properties for parking is unthinkable. Judy Bolog, 745 6th Avenue West, was in favor but she wanted to know, if improvements were made to her property, would she get her money out of it. Ed Gallagher said the appraiser would take that into consideration. Someone asked what were the problem with the sewer and water systems in the area. It was explained the systems were getting old, they weren't in in nediate danger but the district expansion would provide alternative sources of funding for replacement of the services. Jim Thomas, 716 & 718 2nd Avenue West, spoke in favor, for all the benefits that would be available. There being no other proponents, Mayor Kennedy called for opponents. Rose Farrell, 625 3rd Avenue West, didn't feel putting in parking lots would solve the traffic problems or the on street parking. Sharon McClean, 532 6th St. W., was not in favor of selling her home and relocating. one man said a survey of students should be done to see if they all need to drive instead of walking or taking the bus. Restrictions should also be considered. Howard Haimler, former Mayor, was against the district expansion and said he has heard a lot of double talk. He felt the school district should handle this themselves. Flo Moore, 620 6th Ave. W., complained about the bus parking lot which is a bad eyesore and suggested the school use that lot for faculty parking. With no further opponents Mayor Kennedy closed the public hearing. Councilman Furlong said tonight's comments would be considered by the CUmumity Development CmaLittee who would make a rec datien to the Council. Emergency Budgets - Retirement Fund, Health Insurance Fund & G. O. Bond Fund There were no proponents or opponents at these public hearings. ADDRESSING THE OOUNCIL 'man Flynn, 747 3rd. Ave. W., complimented Police Chief Clark for refusing the request for a (Beer & Wine) License for the Fairgrounds. Fred Hammel, 505 7th. Ave. W., requested that heavy trucks be banned from Seventh Avenue West and asked that a speed limit be set on that street. Richard Kuhl, of the Air Quality Advisory Cmudttee, requested the council approve the proposed Air Qua -ity ordinance. MAYOR'S REPORTS: Mayor Kennedy reported the City Negotiator and the Police Association will be meeting Saturday at 10:00 and if any councilmember wants to meet with Mr. Klepper before that let Mayor Kennedy know. ACKNOWIEDGEMWrS AMID APPOININENI'S : - none CTI'EE REPORTS: COMMUNITY DEVELOPMENT/PUBLIC BUILDINGS Redevelggnent District F5q n ion Councilman Furlong moved the Expansion of the Redevelopment District be referred to the Ccnm pity Development Committee for discussion and reconriendation to the full council. Councilman. Nystul seconded and the motion carried. Award Bid - Police Department Remodeling to Greg Bain & Co. $44,820.00 Councilman Furlong moved the bid be awarded / and the project once. Councilman Schindler seconded. Councilman Nystul asked for the bid amount, whether it is within budget and what will be done about the deleted items. Project Architect Ken Williams was asked to respond. He said the revised amount of the . bid to be awarded is $44,820.00 which is $18,066 over budget. He also described the work to be donne. Nystul suggested the bid be rejected and tried again Councilwoman Hafferman felt the bullet-proof glass was unnecessary when the City Hall Receptionist, the Mayor and others remain unprotected. Councilman Furlong said the Police Department is open 24 hours a day and is the normal focus of anger if there is any. Ed Gallagher said the budget shortage would be funded from the Redevelopment Line Item. Ken Williams said rebidding wouldn't reduce the cost. The motion carried unanimously. FINANCE/PERSONNEL & FOLICY/IMURANCE Ordinance #1136 - Second Reading, Non Union Salaries Councilman Nystul moved adoption cn second reading of Ordinance #1136, an ordinance amending Ordinance ##1135, fixing the limits of the salary and compensation of the city officials, supervisors and employees pursuant to Title 7, Chapter 4, Part 42, M.C.A., beginning July 1, 1989; repealing all other ordinances in conflict therewith. Councilman Hopkins seconded. Nystul said he was not in favor of the ordinance because it does not address the performance of some of the employees who deserve more than the 1.5% but he will reluctantly vote in favor tonight. The motion carried upon roll call vote with Councilman Furlong voting no. PARKS/PUBLIC LANDS/AMZ XATION/ZONING/BUILDING REGULATION - no report PUBLIC SAFETY/PAWING/GAMBLING Ordinance #1138 — Second Reading, Claremont Street Parking Councilman Schindler moved adoption of second reading of ordinance #1138, an ordinance to amend Section 17-54, Kalispell City Code, to prohibit vehicle parking on the West Side of Claremont Street between Conway Drive and Crestline Avenue, and to provide an effective date. Councilwoman Hafferman seconded. Councilman Nystul spoke against the ordinance. Councilman Furlong agreed it doesn't solve the problem and is a pieced approach. The motion carried upon roll call vote with Councilman. Nystul apposed. Call for Bids - Two Police Cars Councilman Schindler moved to authorize the Police Chief to call for bids for two new Police Patrol Cars. Councilman Nystul seconded and the motion carried. PUBLIC WORKS/AIR QUALITY/AIRPORT Mission LanePbarnent Councilman Hopkins moved the City Council authorize the Public Hearing process to abandon Mission Lane. Councilman Schindler second. It was explained this street is a small piece of property not serving as an active street that only exists because of errors when Summit Ridge was developed. It will revert to the ownership of the adjacent properties and resolve some access problems of the adjoining properties. The motion carried unanimously. Ordinance #1139 - Air Quality, Emission Control Plan - First Reading Councilman Hopkins moved approval of first reading of Ordinance #1139, an ordinance enacting an Emission Control Plan for the City of Kalispell to meet Environmental Protection Agency Standards (PM-10 Standard) by requiring dust abatement and control in the City Limits; prescribing a penalty; and declaring an effective date. Councilman Furlong seconded. Councilman Hopkins explained some paragraphs of the proposed ordinance. Councilman Nystul asked if parking lots were included in Section I and requested explanation of the intent of the section. The council agreed to have City Attorney Neier make editorial changes to Section I to add a definition of parking lots like that found in Section. V. Councilman Schindler spoke in support of the Ordinance and was pleased restrictions have not been placed an wood burning heat systems. Councilwoman Hafferman felt Kalispell was an island being singled out because restrictions have not been placed upon the rest of the county. The motion carried unanimously upon roll call vote. Resolution #3909- City of Kalispell C upliance Policies Councilman Hopkins moved Resolution #3f09, a resolution declaring policies to be followed by the City of Kalispell in an effort to meet Environmental Protection Agency Standards (PM-10). The motion carried unanimously upon roll call vote, Leaf Harvester Councilman Hopkins reported the Leaf Harvester will arrive Wednesday and begin work Thursday. Mayor Kennedy reported there would be'a demxistration Thursday and if all goes well it will be picking up leaves in the city next week. SEWER & WATER Award Bids --Lawrence Park Pumphouse Remodeling Councilman Nystul moved the bid be awarded to Robert Ross Construction in the amount of $29,815.00. Councilman Furlong seconded and the motion carried. Evergreen Sewer Councilman Nystul reported the committee met with the Evergreen Water/Sewer District last week and has scheduled a meeting of the -Council of the Whole Committee Monday October 23, to discuss the annexation issue. Roof Drains Nystul reported the committee is also working on Ordinance ##1029 which deals wit, charges for roof drains that discharge into "the .Sanitary Sewer System. 113ie plant has flooded again because of direct discharge of rain water into the Sanitary ,item.
