08/24/89 SP City Council Minutes16 163 A SPECIAL MEETING OF THE KALISPELL CITY COUNCIL WAS HEED AT 5:30 P.M. M1DNDAY AUGUST 24, 1989 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR KENM= -PRESIDED. COUNCILMEN SCHINDLER, GUNNERSON AND NYSTUL WERE ABSENT, COUNCILMEN ATKINSON WAS LATE, ALL OTHER COUNCIL E BERS WERE PRESENT. Mayor Kennedy called the meeting to order at 5:30 and noted there was lack of a quorum. Councilman Atkinson arrived at 5:38 and provided the quorum. COLLEGE SPECIAL ASSESSMENTS REPORT Clerk/Treasurer Halver explained he had requested Mayor Kennedy add this item to the Agenda when he discovered on Wednesday August 23 that the new F.V.C.C. Carpus property was not being assessed for Storm Sewer and Street Maintenance. He said that this was put on the agenda hurriedly to meet the 24 hour notice requirement and because all tax assessments must be turned in to the County Ccuputer Center by September 1, 1989. Halver said since he asked this item be added to the agenda he has talked to City Attorney Neier and Public Works Director Hammer and it appears the City cannot waive these assessments and therefore this is primarily a report to the council at this time. City Attorney Neier then reported the only apparent option open to the Martins and the College was de -annexation, the assessments must be charged against all property within the city limits. Dr. Howard Fryett, President of Flathead Valley Cam -unity College, said he just became aware of the assessments this afternoon and asked some questions about the assessment rates and procedures. He also said the site handles all the storm runoff, it doesn't go into the city system. RESOLUTION #3901 -- Call for Special Election -- City Manager Petition Mayor Kennedy recognized citizen Cary Weyrauch who asked why a special meeting had to be held to consider this resolution. Councilman Atkinson explained that the petition validation had just been completed and in order to vote an the issue in conjunction with the regular November election the Council must declare the need for an election by today (75 days before the election). Councilman Atkinson moved Resolution #3901, a resolution calling for a special election on the question of adopting an alternative form of City Government for the City of Kalispell, to be held on the 7th day of November, 1989 in conjunction with the City General Election. OounciLT n Saverud seconded. Councilman Atkinson requested the language of Exhibit "A" be changed to drop the words "Alternative Yes" and "Alternative No" from the wording -of the Official Ballot. He also asked for other changes of the wording which City Attorney Neier said would not comply with State Law. Neier said he would drop the words requested if the Election Administrator approves. The resolution carried unanimously by the members present. Councilwcm-an Hafferrran stated she was voting in favor of the resolution because the voters have a right to choose but she will vote against the City Manager change.
