04/03/89 City Council MinutesA REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P.M. MONDAY APRIL 3, 1989 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR KENNEDY PRESIDED. ALL COUNCILMEMpERS WERE PRESENT. Mayor Kennedy called the meeting to order and led the Pledge of Allegiance. CONSENT AG=A Approve Minutes - Regular Meeting March 20, Approve Claims Councilman Saverud moved the consent agenda Nystul seconded and the motion carried. ADDRESSING THE COUNCIL No one addressed the council. M be approved as presented. Councilman MAYOR'S REPORTS: First Alley West Project Mayor Kennedy reported all the poles and overhead wiring have been removed in the First Alley West Project and it looks really nice. The rest of the work will be completed this spring. ACKNOWLEDGENEWS AND APPOININENTI`S - None CCCPPEE REPORTS: OCUMMUTY DEVELOPMEN'!'/PUBLIC BUILDINGS -- No Report FINANCE/PERSONNEL & POLICY/INSURANCE Resolution ##3837 - Authorize Ccnunity Development Fund Transfer Councilman Atkinson moved approval of Resolution #3837, a resolution authorizing the City Clerk/Treasurer to transfer funds from Community Development Fund 42880 to UDAG Fund #2886. Councilman Saverud seconded and the motion -carried unanimously upon roll call vote. Police Negotiation Councilman Atkinson requested the council meet in closed session immediately following this meeting to discuss Police Contract Negotiation Strategy. PARKS, PUBLIC LANDS/ADZUMTION/ZONING/BUILDING REGULATION Resolution #3838 = Extension of Services Plan Councilman Furlong moved Resolution #3838, a resolution to adopt an Extension of Services Plan for the City of Kalispell. Councilman Nystul seconded and the motion carried unanimously upon roll call vote. PUBLIC SAFETY/PARKING/GAMBLING - No Report PUBLIC WORKS/AIR QUALITY/AIRPORT - No Report SEWER & WATER Southwest Kalispell Area Construction Project Bid Councilman Nystul moved the bid of L.H.C., Inc., be accepted in the amount $783,647.30 plus an additional amount of $30,348.00 which was an error in the bid. Councilman Atkinson seconded. The City Attorney has an affidavit from L.H.C., Inc., regarding the error. Councilwoman Hafferman reported she would abstain from voting on the bid award as she is opposed to the whole project. The motionn carried without dissent on voice vote. Engineering Contract for Wastewater Treatment Plant Design Councilman Nystul reported the Mayor and City Attorney, as authorized by the City Council, have negotiated terms of a contract with the selected engineer. The Council had not authorized the signing of the contract. Nystul asked City Attorney Neier to explain the teams of the contract which Neier did. Dennis Carver, of Carver Engineering explained the EPA rules and procedures for engineering design contracts. Several councilmembers requested some committee of the council review the contract and make a recommendation. 120 Dennis Carver said he had no prablcm with an additional review but he requested it be done prernptly because time deadlines are critical. After considerable discussion the council decided to review the contract in a council workshop following this council meeting. Councilman Nystul moved the Mayor and City Attorney be authorized to sign the contract subject to the concurrence of the majority of the council sitting in a special work session. Councilman Saverud seconded and the motion carried. ANNOUNCEMENTS MEETINGS: WATER & SEWER COMMITTEE, Tuesday April 4, 1989, 8:00 am. CITY DEVF,LOPMEN!'/PUBLIC BUILDINGS, Friday April 7, 1989, 7:30 am., at Lighter Side Restaurant LEGISLATION Mayor Kennedy asked the councilmembers to read the letter frcxn the League regarding Sales Tax and relay any comments to him to forward to the League. OUT OF STATE Councilman Nystul reported he would be out of state from April 22 to May 9, 1989. Councilman Furlong said he would be absent from April 5 to 16, 1989.
