08/10/87 SP City Council Minutes555 A SPECIAL MELTING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P. M. MONDAY, AUGUST 10, 1987 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR KENNEDY PRESIDED. COUNCIL MEMBERS NYSTUL, SCHINDLER AM GRAINGER WERE ABSENT. COUNCILMEMBER ROBINSON PARTICIPATED BY TELEPHONE CONFERENCE. ALL OTHER COUNCILMEMBERS WERE PRESENT. Mayor Kennedy called the meeting to order and led the Pledge of Allegiance. APPROVE MINUTES Regular Meeting August 3, 1987 Councilman Manning moved to postpone the approval of the minutes until next meeting. ADDRESS COUNCIL No one asked to address the Council. PUBLIC HEARING Continuation of Budget Hearing Mayor Kennedy asked if anyone wanted to speak in relationship to the 1987-88 fiscal year budget. There were no proponents or opponents. Mayor Kennedy then officially closed the budget hearing. CITY OFFICIAL REPORT'S Treasurer's Report July Police Chief " City Judge " Building Official " Councilman Saverud moved the City Official reports be approved as presented. Councilman Planning seconded and the motion carried. COMMITTEE REPORTS FINANCE & ADMINISTRATION Resolution #3747 Annual Tax Levies for Fiscal Year 1987-88 to be resolved by the City of Kalispell as follows: General Fund 82.03 mills Comprehensive Insurance 10.27 " Retirement 8.12 " Health Insurance 5.97 " General Obligation Bond 2.89 " Fire Truck Capital Improvement 5.00 " Total 114.28 " Councilman Ruiz so moved, Councilman Manning seconded and the motion carried upon roll call vote. Resolution #3738 - Annual City Appropriation for Fiscal Year July 1, 1987 - June 30, 1988: Councilman Ruiz so moved as per exhibit on tax levy requirements, Councilman Saverud seconded and motion carried upon roll call vote. Resolution #3749 - Alter Boundaries of Special Maintenance District #1: Pursuant to authority granted the City Council, Section 7-12-4403 MCA boundaries of Special District #1 hereby altered in all areas within the City of Kalispell as of January 1, 1987, in which maintenance as defined in Ordinance #1035 is being performed directly by the City or contracted therefore. Councilman Ruiz so moved, Councilman Saverud seconded, motion passed on roll call vote. Resolution #3750 - Levying Assessment for Special Maintenance, Streets and Avenues for Fiscal Year 1987-88: Resolution for assessment of cost for maintenance of district in amount of ' $157,980-public hearing held August 5, 1987-therefore be resolved tax be levied in amount of .0027 per foot of lot or parcel of land. Councilman Ruiz so moved, Councilman Saverud seconded and motion passed on roll call vote. Resolution # 3751 - Alter Boundaries of Special Lighting District: By authority granted the City Council, Section 7-12-4335 MCA, boundaries of Special Lighting District hereby to include therein all areas of the City of Kalispell as of January 1, 1987, when they were installed, maintenance to be done by the City or contracted therefore. Councilman Ruiz so moved, Councilman Saverud seconded and motion passed upon roll call vote. 556 Resolution #3752 - Assessment for Lighting Streets and Alleys in the City's Special Lighting District for Fiscal Year 1987-88: Assessment cost estimated to be $44,189 whereas in public hearing held August 5, 1987, therefore now be it resolved that a tax be levied in the amount of $.00102 per square foot. Councilman Ruiz so moved, Councilman Manning then seconded. Councilman Ruiz stated only that the figures be checked with the City Clerk, as there was a discrepancy between the figure as it was written twice, with proper figures established. Motion carried on roll call vote. Resolution #3753 Levying Assessment for Decorative Street Lighting for Fiscal Year 1987-88 in the amount of $8,306: Whereas at public meeting held on August 5, 1987, Council considered all objections made, therefore be it resolved that a tax levied for assessment of decorative lighting in the amount of $1.83 per front foot. Councilman Ruiz so moved. Councilman Hafferman seconded and motion passed on roll call vote. Resolution #3754 Levying Assessment for Storm Sewer Maintenance for Fiscal Year 1987-88 in the Amount of $173,473: Whereas at public hearing held on August 5, 1987, Council resolved that a tax be levied proportionately, on an area basis, in an amount for square foot per lot or parcel of land in the district, except for public streets it right-of-way. Type 1: $.00162, Type 2: $.00324, Type 3: $.00486, Type 4: $.00648. Councilman Ruiz so moved, Councilman Saverud seconded. Mayor asked for discussion. Councilman Ruiz asked DPW Ken Hammer why this had been increased from past years. Hammer stated that there was a $15,000 increase to cover salaries, etc. that used to be charged to Sanitary. He stated, however, that if this assessment passed, he doubted if it would have time to go on the books this year. Councilman Saverud stated that he thought in the past the assessment had covered just Capital Improvements and not Maintenance and Operation. This assessment encompasses the entire amount -expansion as well as maintenance. ' Councilman Ruiz asked that the assessment was last year and DPW Hammer stated $8,000 or $10,000 and this is a dramatic increase. Councilman Saverud asked DPW Hammer why he felt they could not get this assessment on the books this year. Hammer said it involved turning everything over to the County in order for them to go on the records before the taxes come out and he just doesn't feel everything can be updated and turned over to the County in time. Councilman Ruiz discussed the fact that a large percentage of the city has been paying this assessment for a number of years and already established their front footage, now what we're doing is changing the formula and that will definitely reflect for those that are already in place. He stated he does not remember any discussion on this or seeing any numbers on how much it will be this year if this resolution is passed. Councilman Saverud stated that the budget was based on the figure being $187,500 as the projected budget. Councilman Ruiz stated he could not see how when we have been bringing in $13,000-$15,000 a year on this, that we now propose to bring in $173,473. Councilman Saverud stated that for some reason -possibly the Council did not get the assessment made -but the income was down. However, the previous year there had been $72,549 budgeted. Councilman Ruiz stated he felt that there was cash on hand and Council felt they didn't need to assess because of this reserve cash. Council decided to pass resolution on the basis that if figures are not correct, they can rescind it. Mayor Kennedy called for a roll call vote. Motion carried. Resolution # 3755 Intent to Transfer Bond Proceeds from West Side Park Project to Tax Increment Construction Funds in the amount of $74,213: First Alley West Project: Whereas on November 18, 1985, the City Council passed Resolution #3626, issuing and awarding $2,100,000 in Renewal Bonds for purpose of financing a portion of cost for public improvements projects, designated The 1985 Projects. There shall be a public hearing held at the regular City Council meeting on September 8, 1987 at 7:30 P.M. City Hall for these proposed transfer of funds. Councilman Ruiz so moved, Councilman Saverud seconded and motion carried upon roll call vote. 557 Resolution #3756 Declaring an Emergency Budget to Cover Comprehensive Insurance Deficit of $99,722 for Fiscal Year 1987-88: The City of Kalispell appropriated $144,356 for Comprehensive Insurance and the actual cost was $244,078. Emergency warrants can be properlyt drawn against the Comprehensive Insurance. Therefore, be it resolved than an emergenmcy does exist and a public hearing shall be held September 8, 1987 at 7:30 P.M. Councilman Ruiz so moved, it was seconded by Councilman Manning and motion carried upon roll call vote. Resolution approving Emergency Expenditures for 1987 Comprehensive Insurance. Councilman Saverud stated that this resolution states it is to be passed after the public hearing and this should wait for now. Councilman Ruiz withdrew his motion and his second was withdrawn by Councilman Maiming. Resolution #3757 Declaring Public Hearing for Emergency Budget, Comprehensive Insurance: Resolution to set the date for public hearing, September 8, 1987. Councilman Ruiz so moved, it was seconded by Councilman Saverud and motion carried upon roll call vote. PERSONNEL & POLICY Second Reading Salary Ordinance #1108: Resolution to Amend Ordinance #1107, changes for non -union personnel. Councilman Saverud moved for passage of second reading of Ordinance #1108, amending Ordinance #1107, fixing limits of salaries and compensation for City Officials, Supervisors and Employees, pursuant to Title 7-Part 4 MCA, beginning July 1, 1987, repealing all other ordinances in conflict therewith. Councilman Ruiz seconded and carried upon roll call. COMMUNITY DEVELOPMENT Resolution giving Preliminary Approval to Immanuel Lutheran Home Revenue Bonds: Councilman Saverud stated that with only four Council members present and Councilman Robinson is unable to vote on this resolution as she is an employee of the Lutheran Home, Council cannot act on this at this time. This will be addressed at the August 19th meeting. PARKS & PUBLIC LANDS ' Outdoor Display Ordinance: Councilman Manning stated that this has not been reviewed in committee yet. Washington Street Park: Councilman Manning has received correspondence from Bob Cartwright, Manager of the Fair Commission. They are looking for parking for vehicles during the Flathead County Fair and are looking into using Washington Street Park. There was also a letter from the Kalispell Lakers Association, stating their interest in managing that parking lot and using proceeds gained for new Begg Field. City Attorney Neier's opinion was that he could see no reason why they could not do this legally. It is basically up to the City Council as to whether or not to let Washington Park be used for fair time parking. After discussion Council members felt there was not enough time to look into all possible problems that would need to be addressed: the possibility of many other associations wanting the same concession next year, the lack of city funds to put the park back into shape afterwards, the added traffic flow through this neighborhood, which is already very active at fair time and the legality of charging for use of city parks for parking. Councilman Manning moved to allow Washington Street to be used for parking for the 1987 Western Montana Fair. All Council members spoke against the motion. Mayor Kennedy, stating the discussion being finished, asked for a vote, the motion failed. Councilman Saverud moved that the meeting be adjourned, Councilwoman Hafferman seconded ' and the meeting was adjourned at 9:00 P. M.
