A REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P.M. MONDAY JULY
6, 1987, IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR KENNEDY PRESIDED.
COUNCIL MEMBERS SCHINDLER AND ROBINSON WERE ABSENT. ALL OTHER CDUNCILMEMBERS WERE
PRESENT.
Mayor Kennedy called the meeting to order and led the Pledge of Allegiance.
APPROVE MINUTES
Regular Meeting June 15, 1987
Special Meeting June 22, 1917
'Councilman Grainger moved the minutes of both meetings be accepted as presented.
Councilman Saverud seconded and the motion carried.
ADDRESSING THE COUNCIL
Mayor Kennedy introduced Georgia Lomax, the new director of the Flathead County
Library.
Georgia said she wanted to introduce herself and expressed an invitation to everyone to
use the Library services and offer any comments or suggestions they may have.
No one else asked to address the council.
PUBLIC HEARING
Fourth Avenue West Street Closure
Mayor Kennedy opened the Public Hearing and called for opponents and proponents. There
being none the hearing was declared closed by Mayor Kennedy.

All bidders were Licensed Montana Contractors and submitted 10% bid bonds
Councilman Nystul moved the bids be referred to the Community Development and Finance
Committees to report back to the council. Councilman Saverud seconded.
After discussion, Councilman Nystul moved to amend the motion to refer the bids to
Public Works and Finance Committees. Councilman Saverud seconded the amendment, and
the amendment carried. The amended motion then also carried.
COMMITTEE REPORTS:
COMMUNITY DEVELOPMENT
Hockaday Art Center Bid
Councilman Saverud reported the committee reviewed the bids and awarded the bid to the
low bidder, Robert W. Ross Construction, in the amount of $73,487. This bid is within
the cash available. The committee also agreed that if additional money is available
within 90 days, some of the deducted items can be added back into the base bid at the
bid amount.
Immanuel Lutheran Home Industrial Revenue Bond
Councilman Saverud reported the committee voted approval of the Bonds proposed with the
understanding that the fee of $2.50 per $1,000 issued, as called for in Ordinance 1000
be complied with and the city has no obligation towards payment of the bonds.

Councilman Ruiz asked if the committee intended to waive the fee. Saverud said they
did not intend to waive it for this project.
Ruiz asked if all zoning was in place and Building Official Jackson said he has only
received preliminary plans but didn't see any problem so far.
Councilwoman Hafferman asked why they wanted to go through the City and what is the
city's responsibility. Saverud answered they are going through the City for the tax
advantage and the city has no obligation.
Resolution 3732
Councilman Saverud moved adoption of Resolution 3732, a resolution providing for the
giving of notice of a public hearing on a proposed project for Immanuel Lutheran Home
and the issuance of First Mortgage Housing Refunding Revenue Bonds. Councilman
Grainger seconded.
The motion passed upon roll call vote.
HUD Award
Councilman Saverud presented a letter from Governor Schwinden to Ed Gallagher and asked
it be entered in the minutes.
Dear Mr. Gallagher:
I was sorry to miss the HUD award luncheon, but I understand it was a
memorable event. The national recognition was a hard-earned and well deserved
acknowledgement of your professional abilities. The local tribute came from
the heart. Few men are ever so doubly honored.
Wishing you a speedy recovery and looking forward to your next Kalispell
development project.

PERSONNEL & POLICY
Resignation - Building Official
Councilman Grainger read a letter of resignation from Ken B. Jackson, Building
Official, effective July 23, 1987 and moved acceptance of the resignation. Councilman
Manning seconded.
Councilman Nystul praised the work Ken Jackson had done.
Mayor Kennedy also praised him and wished him good luck in his new job.
The motion carried.
Post vacancy - Building Official
Councilman Grainger moved authorization to post the Building Official job vacancy.
Councilman Ruiz seconded and the motion carried.
Temporary Building Official
Councilman Grainger moved the Mayor be authorized to appoint a temporary Acting '
Building Official. Councilman Nystul seconded and the motion carried.
Retirement - Parks Superintendent
Councilman Grainger moved the acceptance of the retirement of Parks Superintendent
Pieter Drent effective July 31, 1987. Councilman Ruiz seconded.
Councilman Nystul praised the years of dedication of Pieter Drent and the efficiency of
his budget administration.
Mayor Kennedy stated the flowers and ducks in Woodland Park represented a living
memorial to Pieter Drent and he wished him well in his retirement.
The motion carried.

Griffin Field Construction Supervision
Councilman Grainger moved Public Works Director Hammer and the Public Works and Parks
Committees take over responsibility for the Griffin Field construction project
effective upon Pieter Drent's retirement July 31, 1987. Councilman Ruiz seconded and
the motion carried.
Retirement - Detective Sergeant
Councilman Grainger approval of the retirement of Sergeant Dick Stotts effective July
31, 1987. Councilman Saverud seconded.
'Mayor Kennedy praised him for his good work in his twenty years of service and wished
him good luck.
Councilman Nystul requested we note that Dick Stotts was one of the early pioneers in
polygraph and his use of that skill has benefitted crime prevention in the valley.
The motion carried.
Appointment of Police Sergeant
Councilman Grainger moved the appointment of Ray R. Dyer to Police Sergeant effective
July 7, 1987. Councilman Saverud seconded and the motion carried.
Appointment of Firefighter
Councilman Grainger moved the appointment of Terry Eaton to the position of Firefighter
Trainee with a one year probationary period effective July 20, 1987. Councilman Nystul
seconded and the motion carried.
Negotiator 1987-88
Councilman Grainger moved Don K. Klepper be appointed as the City Negotiator for the
1987-88 negotiations at the same rate of $50.00 per hour. Councilman Manning seconded
and the motion carried.
Committee Power to Negotiate
Councilman Grainger moved the Personnel and Policy Committee be given the authority to
'continue to act between the Council and Negotiator for the 1987-88 negotiations.
Councilman Saverud seconded and the motion carried.
PUBLIC WORKS
Resolution 3733 - Street Abandonment
Councilman Ruiz reported the owners of over 75% of the property along the street, The
City of Kalispell and School District #5, have petitioned closure of a portion of
Fourth Avenue West between Fourth and Fifth Streets West.
Ruiz moved adoption of Resolution 3733, a resolution to abandon the above described
portion of street. Councilman Saverud seconded.
The motion carried upon roll call vote with Councilman Grainger voting no.
WATER & SEWER
Resolution 3734 - Woodland Park Sewer Project - Change Order #2
Councilman Nystul moved adoption of Change Order #2 by Resolution 3734. Councilman
Ruiz seconded.
Councilmen Grainger and Nystul discussed the change orders and total project costs.
The motion carried unanimously on roll call vote.
Woodland Park Sewer Project - Statement of Completion
Councilman Nystul moved the Mayor be authorized to sign the statement of completion
letter to EPA, on this project - SID 337. Councilman Manning seconded and the motion
carried.
First Alley West
Councilman Nystul and the consulting engineer, Jay Billmayer, explained the current
status of this project. Nystul stated the City share of installing conduit underground
would be $100,000 with the city paying another $100,000 upon the placing of the cables
in the conduit.
Jay Billmayer explained the costs of the project. Nystul said the total completed
project would cost an estimated $527,000.
Councilman Nystul asked if the Community Development Committee wanted to discuss these
figures and Councilman Saverud said he thought the Tax Increment Advisory Committee

should review the project as Tax Increment Funds are being asked for funding a large
part of this project.
PARKS & PUBLIC LANDS
Depot Park Reservation
Councilman Manning moved approval for the Jaycees and The Homestead House to use Depot
Park for a "Slave Auction". The date would be August 1, 1987, from 11:00 AM until 3:00
PM. He assumed they would be using the pavilion. Councilman Nystul seconded and the
motion carried
Committee Meeting
Councilman Manning scheduled a joint meeting between Parks and Personnel for July 20,
1987 at 3:00 pm.
FINANCE & ADMINISTRATION
Approve Claims
Councilman Nystul moved the Claims found in order, and listed in the Accounts Payable
Register, be approved. Councilman Ruiz seconded and the motion carried.
Resolution #3735 - Primary
Councilman Nystul asked City Attorney to explain the proposed resolution and he did.
Councilman Nystul moved adoption of Resolution #3735, a resolution declaring that a
Primary Election for Municipal Council Seats need not be held. Councilman Manning
seconded.
Councilman Ruiz asked why there were two filing deadlines and City Attorney Fier
explained.
After further discussion, the resolution carried upon roll call vote.
Budget Schedule
Councilman Nystul asked about the budget schedule. Mayor Kennedy asked how the council
wants the budget handled. Nystul said they wanted the Mayor to develop and present the
preliminary budget. ,
PUBLIC SAFETY - no report
ANNEXATION
Second Reading - Ordinance #1102
Councilwoman Hafferman moved passage of second reading of Ordinance #1102 - Proposed
Changes in the Municipal Code. Councilman Grainger seconded and the motion carried on
roll call vote.
Second Reading - Ordinance #1103
Councilwoman Hafferman moved passage of second reading of Ordinance #1103 - Proposed
Changes Uniform Mechanical Codes - Chapter 12. Councilman Saverud seconded and the
motion carried on roll call vote.
Second Reading - Ordinance #1104
Councilwoman Hafferman moved passage of second reading of Ordinance #1104 - Proposed
Changes in the Municipal Code - Chapter 21. Councilman Nystul seconded and the motion
carried on roll call vote.
Second Reading - Ordinance #1105
Councilwoman Hafferman moved passage of second reading of Ordinance #1105 - Proposed
Amending the City Code. Councilman Grainger seconded and the motion carried on roll
call vote.
ACKNOWLEDGEMENTS, ANNOUNCEMENTS AND APPOINTMENTS
Councilman Nystul announced he would be out of state from July 26, 1987 to August 28, '
1987.
