05/18/87 City Council Minutes526 THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P.M., MONDAY, MAY 18, 1987 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR KENNEDY PRESIDED. COUNCILMAN GRAINGER WAS ABSENT, ALL OTHER COUNCILMEMBERS WERE PRESENT. Mayor Kennedy called the meeting to order and led the Pledge of Allegiance. APPROVE MINUTES Regular Meeting May 4, 1987 Councilman Nystul moved the minutes be approved. Councilman Schindler seconded and the motion carried. BID OPENINGS: Griffin Field Improvements: 1. LHC, Incorporated, License 5459A, 10% Bid Bond 104,760.15 Alternate 98,145.46 2. Sandon Construction Co., 6841A, 10% Bid Bond 98,834.35 Alternate 92,821.00 Councilman Manning moved the bids be referred to the Parks and Public Lands Committee with power to act and Councilman Nystul seconded the motion. After some discussion, Manning moved to amend the motion to include the Finance and Administration Committee. Councilman Nystul seconded the amendment and it carried with Councilwoman Hafferman opposed. The amended motion carried with Councilwoman Hafferman opposed. Hockaday Center Additions: 1. Robert W. Ross Building Contractor 1278A, 10% Bid Bond Base Bid $ 105,280.00 Alternate - 21,050.00 2. Greg Bain & Company 5087A, 10% Bid Bond Base Bid 108,600.00 ' Alternate - 19,826.00 3. Swank Enterprises 2146A, 10% Bid Bond Base Bid 118,460.00 Alternate - 25,640.00 Councilman Schindler moved the bids be referred to the Community Development and Public Buildings Committee with power to act. Councilman Nystul seconded and the motion carried with Councilwoman Hafferman opposed. PUBLIC HEARING Community Development Block Grant Proposals Councilman Saverud reported there had been 2 previous public hearings on April 23, 1987 and May 5, 1987. He said both were well attended and there was considerable public input with the majority in favor of the Community Development Block Grant Proposal of the Southwest area sewer reconstruction. Gary Fisher, 1244 4th Avenue West resident, spoke in favor of the Block Grant. He said the Southwest area has had bad drainage problems. The water pipes have been breaking regularly for 19 years and the sewer problem is getting worse. Phyllis Leonard, 1506 7th Avenue West, she also has a rental at 1217, stated her and all her neighbors use sump pumps. She said the neighborhood has a very critical need. She shut the rental down in March because the problem is so bad. ' Patty Courter, 1545 6th Avenue West, said her septic system backs up. In summertime she cannot water the lawn, there is no water pressure at all. Jan Tow, 1228 4th Avenue West, said she is in real estate. All Realtors are aware of the high water table in this area. It makes houses difficult to sell. She said if this grant is approved, it will enhance property value and make houses easier to sell. Celeste Fisher, 1244 4th Avenue West, said she uses 2 seperate septic systems and cannot use the washer at all. i 527 PhillKasperson, 1405 5th Avenue West, said with the water and seepage, some are suffering more than others. He said it is unfortunate in this day and age we have to exist under these situations. With an annexation the many people represented here would be more than glad to have you participate in this Block Grant. He added the property value is negligible except for being taxed, then it seems to be awfully high. He said to try to improve or sell property in this area is next to impossible. Councilman Saverud asked the audience for a show of hands in favor of the Block Grant. There were 38 in favor and none in opposition. ' The N{ayor closed the Public Hearing. CITY OFFICIAL REPORTS Treas rer's Report April Police Chief " City I udge11 Building Official " n Nystul moved the reports be approved as presented. Councilman Schindler and the motion carried. •�y WATER & SEWER Repor on EPA letter Councilman Nystul reported the Committee requests the Mayor send a letter to the Water Quality Bureau to clarify their letter regarding the time table. Also the Committee urges the Mayor to insure the staff is following up on the letter in response to the HES 1 tter of March 30, 1987 as $140,000.00 reimbursement is involved in that. PARKS& PUBLIC LANDS Recommendation on Bruckhauser Pool Schedule Councilman Manning read the new proposed rate schedule for Bruckhauser Pool. He said it had been over 10 years since an increase in fees. Councilman Manning moved the new schedule be accepted. Councilman Nystul seconded and the motion carried. 1 Fees: Daily Season Pass ldren & Students $ 1.00 $ 20.00 It (18 & Over) 2.00 25.00 ily Pass 45.00 Week Session (35 min. classes) $10.00 Week Session (45 min. classes) $12.00 Summer Tennis Program Councilman Manning reported Mike Allen requested using the City Courts for a tennis program this year. The Committee would like to consider having our own program. Cathe Mortenson who runs the pool is also qualified to run the tennis program. If we could have her do it, it would possibly get the prices down more affordable. Councilman Manning moved Cathe Mortenson pursue a tennis program for the summer 1987. Councilman Nystul seconded the motion. Councilman Nystul clarified this would be a beginning level of young students. Counc ]man Ruiz asked if there would be any added expense. Councilman Manning stated the money acquired from the fees would pay for the instructors. After) discussion, Councilwoman Hafferman amended the motion to include: "Under the condition the program is self supporting and no financial hardship to the City." Councilman Schindler seconded and the amended motion carried. New Griffin Field Improvements Counci man Manning stated in the event the bids on the current phase be rejected, the call f r bids may need be repeated, otherwise the call for bids would be for the next phase. 528 Councilman Manning so moved a call for bids for the next appropriate phase of the Griffin Park. Councilman Nystul seconded the motion. After discussion, Councilman Schindler and Hafferman voted no and the motion carried. Committee Meeting Councilman Manning announced there will be a combined Parks & Finance Committee meeting May 19, 1987 at 4:00 p.m. To review the Griffin Field Improvement bids. FINANCE & ADMINISTRATION ' Approve Claims Councilman Nystul moved the claims found in order be paid. Councilman Saverud seconded and the motion carried. Resolutions on Fund Transfers Resolution 3726 A resolution authorizing the City Clerk/Treasurer to transfer funds from the Bruckhauser Pool Construction Fund to the General Fund in the amount of $38.03. Councilman Nystul so moved Resolution 3726. Councilman Ruiz seconded and the motion carried with roll call vote. Resolution 3727 A resolution authorizing the City Clerk/Treasurer to transfer funds from the Government Study Commission Fund to the General Fund in the amount of $12,704.39. Councilman Nystul so moved the adoption of Resolution 3727. Councilman Saverud seconded and the motion carried with roll call vote. Intercap Resolution -Telephone System Resolution 3726 A resolution authorizing participation in the Montana Economic Development Board Intermediate Term Capital Program. Councilman Nystul so moved adoption of Resolution 3728. Councilman Ruiz seconded the motion. With the roll call vote, the motion carried unanimously. PUBLIC SAFETY Recommendation to Eliminate Parking Space Northwestern Telephone area Councilman Schindler reported the Police Chief and Committee recommended elimination of parking space on the north side of the corner of West Washington Street and Highway 93. The request has been made by Northwestern Telephone. Councilman Schindler so moved and Councilwoman Hafferman seconded the motion. Councilman Ruiz asked if the Four Seasons had been notified. Councilman Schindler said the Four Seasons had not been notified. He added Police Chief Stefanic recognized it a traffic hazard. Councilman Ruiz said he thought Four Seasons should be notified. Councilman Schindler said he would do so and report back at the next meeting. Councilwoman Hafferman withdrew the second and Councilman Schindler withdrew the motion. Request to Move Handicapped Parking Spaces Councilman Schindler reminded the Council of the request to move some handicap spaces from the front of the block to the rear. He reported the project was in process. Report on Dog Fines Councilman Schindler reported City Judge Willis is in the process of raising the fines on dog related problems. He said in conjunction with possible funding of a full time dogcatcher, the dog problem should improve. Committee Meeting Councilman Schindler announced there would be a Committee meeting on Wednesday, May 20, 1987 at 4:00 p.m. He said the Committee has asked Chief Stefanic to give his feelings on where he feels the department is today and what he feels are it's possibilities and where it should go in the future. The committee felt his thoughts on the subject might enlighten the Council as far as the possibility of selecting a new chief. He said any one interested may attend. 529 - no report CO TY DEVELOPMENT Block Grant Applications Councilman Saverud reported the Committee recommends to proceed to make application for a Block Grant for the Southwest Sewer Project. Councilman Saverud moved the Council authorize the staff to make application for a Community Development Block Grant in order to fund the necessary Sewer & Water project ' in the Southwest area of Kalispell. Councilman Schindler seconded the motion. Councilwoman Hafferman spoke against the motion. She said grants cost everyone money. Councilman Ruiz asked if the entire project was a Block Grant. man Saverud said the City has already underwritten the cost of the facility He said it was approved several months ago up to $17,000. He said it is a joint between Block Grant monies, EPA and possibly some other sources including County f. Development staff member Susan Moyer explained the funding in detail. Development Director Gallagher further explained the Block Grant process and ion with the homeowners. He a�so commended all of his staff on a tremendous job on going door to door, collecting the necessary data. He said it was a credit to the staff that such good responnsse by the people, here tonite , are trying to improve Kalispell. The audience applaIuded. Afterlfurther discussion, with Councilwoman Hafferman voting no, the motion carried. Natio al Merit Award Councilman Saverud read a letter from the U.S. Housing and Urban Development indicating that Kalispell has been awarded a certificate of National Merit to the U.S. Department of HTDusing and Urban Development's National Recognition Program for Community Devel pment Excellence. He said the representative from HUD will be in Kalispell on June 9, 1987. There will be a no host luncheon, to which all are invited, at 1:00 p.m., at Cavanaugh's for a brief awards assembly. Report on West Side Park Project CouncLlman Saverud reported the Committee awarded the Demolition bid to LHC Inc. He said the preliminary site plan was reviewed and forwarded to the Parks Department for review and approval. Hockaday Center Grant Councilman Saverud announced the Montana Arts Council has awarded the Hockaday Center a $20,000.00 grant for the next biennium. He clarified this grant is for operating funds, not the construction. Councilman Schindler seconded and the motion carried. Al;1CLWGYLN'UI;GM�Nl'S, ANNUUM:EMhNTS & APPOINTMENT'S Keith�Engerbretson, Shade Tree Commission Appointment Mayor Kennedy announced the proposed appointment of Keith Engebretson to fill the vacan y by the resignation of Dale Haarr. man Nystul so moved the appointment. Councilman Schindler seconded and the carried. I 530 Pic Olsen Commendation Mayor Kennedy commended Pic Olsen, Chief Operator at the Waste Water Treatment Plant, for completing a correspondence course on Supervisor Management in the Water and Waste Water field. The Mayor congratulated Pic on the many hours of extra work. Montana League of Cities and Towns Mayor Kennedy announced Wednesday, May 20, 1987 at 10:00 a.m., the Montana League of Cities and Towns will be in town to present a summation of the Legislative action that took place this year. He said this will be a good update on the effect the legislation had on the City and local governments. Report on Police Chief Search I Mayor Kennedy announced the deadline for applications for Police Chief is Wednesday, May 20, 1987 at 5:00 p.m. Councilman Nystul expressed his concern for the lack of sufficient notice in the region, not to discount any of the applicants within house, but said it's our duty to the taxpayers to get adequate solicitation. Councilmember Appointment Councilman Schindler stated the deadline for the Councilperson application was May 15, 1987. He said the meeting to review the applicants will be May 26, 1987 at 7:30 p.m. Farewell Dinner for Chief Stefanic Councilman Schindler announced the Farewell Dinner for Police Chief Marty Stefanic will be Friday May 22, 1987. Cocktails will be served at 6:30 p.m. and dinner at 7:00 p.m. The cost will be $8.50 per person, with dancing afterwards. R.S.V.P. is needed by May 21, 1987 to Markie Sabol. ADJOURN Councilman Schindler moved the meeting be adjourned.
