REPORT TO: Doug Russell, City Manager FROM: PJ Sorensen, Senior Planner Development Services Department 201 1st Avenue East Kalispell, MT 59901 Phone: (406) 758-7940 Fax: (406) 758-7739 www.kalispell.com/plannine SUBJECT: Resubdivision of Lot 1, Village Heights Professional Center Subdivision — Request for Preliminary Plat Extension MEETING DATE: March 15, 2021 BACKGROUND: This is a request by PTA Development, LLC to extend the Major Preliminary Plat approval for the Resubdivision of Lot 1 of Village Heights Professional Center Subdivision for two years. The preliminary plat for the subdivision was approved on April 2, 2018, with Resolution 5861. Resolution 5861 originally referred to Lots 4A and 4B; the property has had a boundary line adjustment since that time and is now known as Lot 1. Condition No. 2 of the preliminary plat states that "the preliminary plat shall be valid for a period of three years from the date of approval," which is in accordance with Section 28.2.06(E)(7) of the Kalispell Subdivision Regulations. Accordingly, the expiration date for the major preliminary plat is April 2, 2021. The reason for the request is due to the length of time that was necessary to go through the DEQ approval process. The applicant is working towards completing the final plat shortly but requires additional time to fully address all of the required items. The subdivision regulations provide for a two-year extension under Section 28.2.07(D)(7), which allows for an owner to submit an extension request documenting the existence of an unusual hardship, which was shown as part of the attached letter. RECOMMENDATION: It is recommended that the City Council approve Resolution 6016, a resolution extending the Resubdivision of Lot 1 of Village Heights Professional Center Subdivision preliminary plat for an additional two years. WHEREAS, the City Council of the City of Kalispell granted preliminary plat approval for Village Heights on April 2, 2018; and WHEREAS, the developers, PTA Development, LLC and WGM Group, have requested a two- year extension to the preliminary plat of Village Heights due to the extensive DEQ approval process; and WHEREAS, good cause exists for the request for extension by PTA and WGM and it is in the best interests of the city that the extension be given. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION 1. That the application of PTA Development and WGM Group for a two-year extension of the preliminary plat of the Resubdivision of Lot 1, Village Heights Professional Center Subdivision, Kalispell, Flathead County, Montana is hereby approved. PTA Development, LLC began working on the Final Plat process in 2019 and later employed WGM Group to assist in acquiring the DEQ COSA approval and completing the Final Plat in April of 2020. The DEQ COSA approval process took nearly 10 months, due to the complex nature of the mixed municipalities on the Sewer (City of Kalispell) and Water (Evergreen Water District), a change in DEQ regulations that prevented a Municipal Facilities Exemption and COVID related delays. WGM is working to complete and submit the final plat application materials requested, but given the rapidly approaching deadline, we would like to formally request an extension to this preliminary plat.
