THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P.M. MONDAY
FEBRUARY 3, 1986 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR KENNEDY PRESIDED. ALL
COUNCIL MEMBERS WERE PRESENT.
Mayor Kennedy called the meeting to order and led the Pledge of Allegiance.
Mayor Kennedy welcomed and introduced special guest Amy Jaumotte.
APPROVE MINUTES
Councilman Nystul moved the minutes of the January 20, 1986 regular meeting be approved
as presented. Councilman Schindler seconded and the motion carried.
ADDRESSING THE COUNCIL
No one requested to address the council.
COMMITTEE REPORTS:
WATER & SEWER
Resolution 3634
Councilman Nystul presented Resolution 3634, a resolution authorizing Mayor Kennedy to
act in behalf of the City in administering EPA Grants and moved its adoption.
Councilman Saverud seconded and the resolution passed upon roll call vote.
ANNEXATION, ZONING & BUILDING REGULATION - no report
PUBLIC WORKS
Friendship House Handicap Loading/Unloading Zone
Councilman Ruiz moved a Handicapped Loading Zone be authorized for the Friendship House
on Sixth Street West. Councilman Nystul seconded and the motion carried.
Resolution 1068
Councilman Ruiz moved acceptance of second reading of Resolution #1068, a resolution
establishing parking limitations on First Avenues East and West. Councilman Schindler
seconded and the motion carried upon roll call vote.
' PUBLIC SAFETY
City Attorney Opinion on Proposed Pornography Ordinance
Councilman Schindler reported on the City Attorney's research. C. A. Neier reported we
could alter an ordinance enacted by initiative or referendum after it had been in force
for two years.
Councilman Schindler recommended we repeal our ordinance and adopt the state law.
Councilman Ruiz suggested we keep the ordinance we presently have, which was approved
by the electorate.
Councilman Saverud favored updating our present ordinance to comply with recent court
decisions.
The County Attorney apparently has ruled the county ordinance does not apply in
Kalispell.
Councilman Schindler requested further action be tabled and the committee prepare
recommendations to be presented at the February 18, 1986 council meeting.
Ordinance 1073
Councilman Schindler presented Ordinance 01073, an ordinance limiting parking on Second
Street East at its intersection with Fourth Avenue East, and moved its approval.
Councilman Nystul seconded and the motion carried upon roll call vote.
PARKS AND PUBLIC LANDS
Councilman Manning reported there would be an informal meeting for the transition of
the chairmanship of the committee. The meeting will be held on Thursday February 6,
1986, at 4:00 pm.
COMMUNITY DEVELOPMENT & PUBLIC BUILDINGS
Report on Hockaday Expansion
Councilman Saverud moved the City approve in principle, the expansion of the city owned
building that is currently leased to the Hockaday Art Center. This motion assumes a
new lease will be entered into between the City and the Hockaday Art Center. The
motion does not necessarily assume the City will. participate in any further funding,
nor does this approval eliminate the need for the Architectural Review Committee and
the Building Department approval.. Councilman Schindler seconded and the motion
carried.
ME
Senator Max Baucus will hold a public meeting in the Council Chambers regarding tax
reform. The meeting will be held Tuesday February 11, 1986 starting at 10:00 am.
There will also be a Kalispell Center Mall tour Tuesday February 11, 1986, at 4:00 pm.
The tour will start from the First Interstate parking lot.
PERSONNEL & POLICY
Ordinance 1074
Councilman Grainger moved Ordinance #1074, an ordinance fixing salaries of City
employees. Councilman Schindler seconded.
Don Halver reported the Lieutenant of Police salary is the 1984-85 rate. Councilman
Ruiz explained the Lieutenant was not satisfied with the salary offered and would not
accept it until the Police Bargaining Unit has settled with the City. Mayor McDowell
and the Employment Committee had approved leaving his salary at last year's level.
The Police salaries are at the 84-85 level and a salary ordinance amendment will be
passed when their salaries are settled.
There was some discussion of whether there was still a Deputy City Clerk Position. The
Mayor and City Attorney will investigate further.
The motion passed upon roll call vote.
Councilman Ruiz felt we should pass a salary ordinance at budget time and if we have
not yet settled, then pass another ordinance when contracts are settled. He felt we
should not be operating in a fiscal year without a salary ordinance.
Councilman Grainger announced there would be a closed Personnel and Policy Committee
Meeting on Thursday February 6, 1986 at 11:00 am to hear a grievance.
FINANCE & ADMINISTRATION
Approve Claims
Councilman Palmer moved the claims found in order by the committee be approved for
payment. Councilman Nystul seconded and the motion carried.
MISCELLANEOUS
Approve License Bonds
Councilman Grainger moved the License Bonds found in order by the City Attorney be
approved. Councilman Nystul seconded and the motion carried.
License Bonds approved:
CONTRACTOR BOND AMOUNT
Allen Electric Electrical Contractor 1,000.00
Delbert L. Maltby Electrical Contractor 1,000.00
Grizzly Electric Service Electrical Contractor 1,000.00
Councilman Grainger requested the City Attorney have all bonds set up to expire on
December 31, in accordance with the expiration date of the licenses.
The meeting was adjourned at 8:25 pm.
