Councilman Ruiz reported the committee recommended acaeptance.of.=the bid from.thefirm
of Clark, Walsh and Torgerson for the review. of the ability.of the District to pay off
the bonds because of the lower maximum, and so moved. Councilman-Springer'seaonded and

Councilman Ruiz reported.the,_committee recommended the Valley Bank fixed rate:'bid of
T45%,. First, Jnter:statdf.s oid; although . higher, was not a.repurchase agreement and.
would only be protected in the; .amount. of -50% of the excess , of- $100,000 in 'the account.
The Repurohase Agreement would be 100% secured.
After lengthy diseu.ssion:of the .merits .of full.protection,Councilman Ruiz moved'the
fixed rate.bid:of Valley Bank be.approved.: Council�a-ri::Palmer .seconded. , With 'a tie
vote of three to.three, Mayor'McDowell.voted in favor:and the motion carried.
SEWER & WATER
Councilman Nystul moved the Mayor: be authorized to sign an agreement for sewer
services for the "Grandview Drive Extension of Services" submitted by Thomas Dean &
Hoskins, contingent;;upon the signing.of the usual waiver of protest of annexation ' and
notice of'.::. -withdrawal :from the rural-:.fire :.diatrio-t... Councilman Springer seconded ;and

ANNEXATION
Ordinance 1067 - Mattson Zone Change
Councilman Manning :read ordinance #1067, .'an ordinance amending the city zoning and so
moved.. 'Councilman-:Nystul seconded:.and the ordinance passed upon roll call vote.
Councilman,Manning read the letter from the Flathead- County Commissioners stating they
had° moved Millpw: Gl:on::Drive and ,its •- extension :to`445alle be eliminated asan arterial
highway from the Flathead City/County Master Plan -.'to -th.e - year 2010: and the plan be
returned. to the City of Kalispell for public hearings before it is returned to the
Planning Board:.
He moved the Mayor be;, authorized to; send a letter tv .trhe= Cammissionevs:•stating the City
will not hold a publ o'.hearing, the -city has acted in accordance with the law, and upon
. rebommendation _, o fi the: City/ County- Planning � Board, : ohd--, if the Commissioners ' do not feel . .

and.the city would be more than willing to consider aany>alternate arterial: route -that
would cover that on of the planning area. Councilman Palmer seconded.
Councilman Springer spoke in favors. of, the motion and objected to the Commission
not being`- able t6 ,make a decision:and then Rthrow:it back to the city.and the media
takes.the position. we are the ones who haventt done. our homework." The motion
carried.

Decorative street Lights
The committee has delayed awarding the bid until they were sure the lights would fit
the base and they are now satisfied.
Councilman Palmer reviewed the figures provided by D.P.W. Hammer for the present
estimate of costs to complete the purchase and installation of the lights. He moved
the bid be awarded with the full understanding that we would be using some money From
the Tax Increment Budget earmarked for the Fifth Avenue West North project.
Councilman Nystul seconded. There was a lot of discussion of financing options if the
original budget is not sufficient. The conclusion was the difference could come from
Tax Increment somewhere. All money left in the light district should be spent first.
Councilman Palmer clarified his motion by stating the additional costs would come from
Tax Increment in general; not from the Fifth Ave. W. N. project. Motion carried.
Ordinance 1068
Councilman Palmer reported Northwestern Telephone had requested a 10 minute parking
zone so customers can run in and pay their bills. Councilman Palmer moved first
reading of Ordinance 1068, an ordinance establishing 30 minute parking zones on all
oorners on First Avenue Fast and First Avenue West from First Street through Fourth
Street. Motion carried upon roll call vote with Councilman Springer voting no.
Garbage Rates
Councilman Palmer moved the City Attorney draft a resolution addressing the changes
necessary in our garbage policy and providing commercial rates for anything more than
four residential units. Councilman Nystul seconded. Councilman Ruiz requested we not
call apartment complexes commercial accounts; keep them defined as residential
accounts. Motion carried.
SAFETY - no report
PARKS
Councilman Manning reported the Parks Advisory Committee recommended,the City pursue
developing two ball fields at Begg Park and he so moved. Councilman Springer,seeonded
and the motion carried.
ANNEXATION - continued
Councilman Manning moved the City Attorney be authorized to set a public hearing date
for the Bed and Breakfast ordinance. Councilman Nystul seconded and the motion
carried.
MISCELLANEOUS
Councilman Ruiz asked where we were on Phase I of the Fifth Avenue West Project.
D.P.W. Hammer reported it is still being engineered but the contractors appear
interested in starting this winter if possible.
Mayor McDowell reported Councilman Grainger had requested permission to be out of town
November 18 to December 1.
