CITY OF KALISPELL, MONTANA,
There will be a gpicial Meeting of;the City Council Monday, October 29, 1984
at 3:30 P. M.� in the Council Chambers at City Hall for the following purpose:
DETERMINE COURSE OF ACTION FOR .THE SAFETY OF THE PUBLIC,
M&M BT_1ILDING, AS WELL AS TO RESTORE BUSINESS TO NORMAL,
SECOND STREET EAST.
We, the undersigned., being all of the members.of,the City Council, do hereby
waive notice of the date and purpose of the-Special.Meeting of the City Council
to be held Monday, October 29, 1964 at 3:30 P. M. in the Council Chambers at
City Hall and consent to the transaction of the above and any other business
that may properly come before the City Council.

Building Official Petersen explained the abatemeht procedure. Letters are sent by
the City Attorney to all property owners - owners are allowed 30 days in which to
appeal - if no appeal and the building is riot removed, the City has the right to
knock down and charge the property owners. At this point, the owners are willing
if insurance is paid, but the insurance is being held up because of' -charges or alle-
gations of arson. Petersen continued by saying this is our only choice, the building
is not safe and the procedure can be stopped if the owners take some action. There is
a chance that demolition will start this week, but the letters should go out right
away in case there isono action.
Councilman Springer moved to authorize the City Attorney to send the letters.
Seconded by Councilman Schindler.
Councilman Ruiz. questioned Council action on the matter. He stated that the Council
only makes policy. This i�; an administrative action for the Mayor and department heads
involved. Let them go ahead with whatever they determine necessary for public safety.
He stated he did not wish to vote on something he knows nothing about.
Councilman Palmer explained that he and Councilman Schindler met with department heads
on Friday to discuss the street closure on Second Street. At this time there is one-
way traffic going west. For a time after the fire, Second Street was totally closed
but Mayor McDowell determined that it would be safe to allow traffic in the outside
lane going west. DPW Hammer and Building Official Peteresen felt it should be totally
closed. This meeting was called to try to resolve what is best for public safety.
Question called. Motion carried.
Council agreed that a letter should be written to the property owners of Harmons,
Jack's Tavern and Mr. B's Kiddie Shoe and�all insurance companies involved to take
care of hanging air conditioners and broken glass and any other modification to make
it safe:
DPW Hammer stated that he feels the street should be closed, property owners given
30 days notice to do something, and then take Council action if nothing is done.
Councilman Saverud moved to adjourn at 4:00 P.M.
