05/07/84 City Council Minutes192. THE REGULAR MEETING.OF,THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P. M. MONDAY, MAX 7, 1964 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR McDOWELL PRESIDED. ALL COUNCILMEN PRESENT. APPROVE MINUTES Councilman Nystul moved that the minutes bf the regular meeting of April 16, 1984 and the Special Meetings of April 12 and 30 be approved .as presented. Seconded by Council- man Schindler. Motion carried, OPEN BIDS - Special Lighting District No. iI Bonds No bids were presented. Referred to Finance Director Swanson to solicit. PUBLIC HEARING Pursuant to notice mailed to all Customers of the Kalispell Water and Sewer system and published, in the Daily Inter Lake April 16 and 23rd and May 1, 1984, this is the time and place set for hearing proposals to increase the revenue of the two Utilities. Municipal Utilities such as Water and Sewer Services provided by Cities operate under Montana Code Sections'69-7-101 et. seq, as presently written; These regulations provide in part that municipalities have the power and authority to regulate, establish and change as they consider proper, rate charges and fees imposed for service. Those charges shall be reasonable and just and may not be raised to yield more than a 12% increase in total annual revenue unless needed to cover .federal and state mandated improvements. At this time we will open the meeting for discussion of the proposed increase`in Sewer Revenues, Please confine your questions to Sewer related items. At the completion of this discussion we will open the matter of the Water Revenues for discussion. It should be pointed out that the sewer rate adjustments proposed here related only to the Sanitary Sewer and are rot,in any way related to Storm Sewer Assessments. SEWER RATE Mr. Tom Flynn, who did the sewer and water rate study, reminded the public that this rate increase proposal relates only to sanitary sewer:i not storm sewer. Mayor McDowell asked for propoments. No one appeared. Tfayor McDowell asked for opponents. Henry Oldenburg, Flathead County Commissioner, stated that a constituent in the Ever- green area had some questions. Are you going to accept maintenance of Evergreen sewer lines as the City is doing south and north of the City? Are you going to run your sewer lines to them? What will their rates be? Will you treat them equally? Mayor McDowell explained that we have a contract with the people to the north to meet their hook-up. The rate is 125%, as are all outside city limits rates. The uzer assumes cost of connection and maintenance. Councilman Nystul explained that distrtadt, -d6:r4-fin .6f!-bo .nE:assume, their own maintenance. In case of extension of our own lines, we maintain. Councilman Palmer stated that these questions are not revelant to this hearing. Councilman Ruiz explained that we are working with Evergreen on their sewer problem and have loaned our name to an EPA Grant for their study. Suggested that these questions be referred to the Sewer and Water Committee. Michael Stochafsky, 382 Yodeling Ridge Road, owner of a 4-plex within.the City, statdd that he did not .like the method of our rate structure on multiple units. He stated that he thought there should be just one meter and pay for what goes through that -.meter, rather than 4 basic rates. Mr. Flynn explained that this rate structure has been used since 19.66 and has been approved by the PSC. The ohly way to:get it changed would be to go to District Court, unless the Council chooses to change it. Councilman Nystul added that the composition of the rate structure was made by the Council 20 years ago, has worked satisfactorily within the rules and regulations of the PSC and can see no need for a change. There is no meter at all in Mr. Stochafsky's 4-plea and he is being charged minimum on each unit. If he were to meter it, he may find it will cost more. There being no further comments, Mayor MCDOvYell declared the sewer rate hearing closed. WATER RATE HEARING Mayor McDowell asked for proponents. There were none. Mayor McDowell asked for opponents. ADDRESSING THE COUNCIL f John Burton, representing flathead County Library, addressed the Council regarding financial aid for the library in the 1984-85 budget. He stated that he is looking for the same funding as they receive from Wiitefish, Columbia Falls and Bigfork. Councilman Ruiz set 4:00 P. M. Thursday,'May loth for a Finance Committee meeting to hear Mr. Burton's presentation. All Council Members are urged.to attend. COMMITTEE REPORTS INSURANCE Councilman Grainger reported that Mayor McDowell, Councilman Saverud and he met with insurance people to discuss deletion from fire insurance only of the warming house and restroom in Woodland Park and the bleachers in Griffin Park. The warming house is half concrete; the restroom is steel and the bleachers are 44 years old. There is $1,000.00 deductible on each. Councilman Ruiz asked for the difference in premium if we delete. That is not known as yet. Councilman Grainger moved that he and Councilman Saverud be allowed to work on dele- tions. Seconded by Councilman Springer. Motion carried. FINANCE Councilman.."Ruiz reported that the Finance Committee has reviewed April. claims and moved that all those found in order be paid. Seconded by Councilman Palmer. Motion carried. Councilman Ruiz moved that DPW Hammer be authorized to call for bids for gasoline and diesel fuel. Seconded by Councilman Manning. Motion carried. SEWER & WATER Councilman Nystul reported th4t:he will present a Change Order on plant construction at a later date. Councilman Nystul reported that the Sewer & Water Committee recommend that our present engineering firm be engaged to make changes in the headwork for nutrient removal. In a telephone conversation with the Water Quality Bureau today, they have advised that we are under a 60 day time frame to get --our grant application submitted. Councilman Nystul moved that Stahly Engineering be engaged to do the preliminary engineering and the grant application for the Head Wa,rdr5 Modification,. Secondary Clarifier and Nutrient Removal at the Waste Water Treatment Plant. Seconded by Councilman Saverud. Motion carried. ANNEXATION L ORDINANCE #1043 �. Councilman Manning moved first reading to enact Ordinance #1043 an ordinance to amend the City of Kalispell's Zoning Ordinance, Ordi.nance #885, as amended,':.by adding thereto Chapter 8 entitled: Change of zoning to Planned Unit Development District (PUD) or the creation of a Planned Unit Development District. Seconded by Councilman Palmer. Roll call vote. All voted aye. 194. RESOLUTION #3521 Councilman Manning moved to adopt Resolution #3521 a resolut!6n approving the Resub- division of Pack Addition #91, #165. Seconded by Councilman Nystul. Roll call vote. All voted aye. STREET & ALLEY; Councilman Palmer moved that Director of Public Works Hammer be authorized to ad- vertise for bids for road oil, plant mix, gravel and asphalt. Seconded by Council- man Springer. Motion carried. Councilman Palmer moved that Directcrri6f Public Works Hammer be authorized to ad- vertise for bids for sidewalk and curb construction for 1984. Seconded by Council- man Nystul. Motion carried. SAFETY ORDINANCE #104,31R Councilman Schindler moved to enact ordinance #104�4an emergency ordinance to pro- hibit vehicle parking within 30 feet.of:"the intersection on the east side of Third Avenue East at the intersection of Third Avenue East and Third Street East; to de- clare an emergency, to provide for the installation in the affected area and to re- quire the Mayor to proclaim ordinance in force when done. Seconded by Councilman Springer. Councilman Graimger spoke of the need to prohibit parking in other areas of the City, such as near the high school. It was explained that this intersection has had so many near misses, that the Assistant Police Chief had brought it to the attention of the Safety Committee and Mayor McDowell and upon inspection, agreed that it is dangerous. There is a great deal of traffic on Third Avenue East and a vehicle must pull out into the center to see any oncoming traffic. Question called. Roll call vote. Councilman Springer abstained. All other Council- men voted aye. Emergency Ordinance enacted. PARKS Councilman Springer had no report. CITY DEVELOPMENT Councilman Saverud reported that the committee met..and reviewed the UDAG and it has been signed and sent in. Regarding the downtown mall, the Developer is awaiting word from the federal govern ment as to the status of industrial revenue bonds.. If satisfactory, bond will be sold and work will begin. Seconded by Councilman Grainger.- Motion carried. Councilman Nystul reported that the street lights are installed on Garland And Sherry Lane and would like to thank and commend Bob Park of. PP&L and John Harp, o6ntfAe t6r, tor. a good job. sewer & Water Committee will commence this Monday,meeting at 4:00 P. M. each week. 195. Councilman Grainger moved that Mayor McDowell be permitted to be out of state from June 5th through the 23rd for guard camp. Seconded by Councilman Springer. Motion carried. Councilman Grainger moved that Councilman Springer be allowed to be out of the City for 11 days beginning May 8th for the purpose of campaigning. Seconded by Council- man Palmer. Motion carried.
