ALL OTHER COUNCILMEN WERE PRESENT„ APPROVE MINUTES Councilman Schindler moved that the minutes of the regular, meettn- of January 3, 1984 and the special meeting of January 9, 1984 be approved as presented. Seconded by Councilman Grainger. Motion carried. CITY OFFICIAL REPORTS City Treasurer for November 1-983 City Judge for December 1984 Potice Chief for December 1.984 Building Off Loial for December 1984 Counr_Llman Nystul moved that the city official reports be approved as presented. Seconded by Councilman Ruiz. Motion carried. ADDRESSING THE COUNCIL Mr. Don Nelson, 264 North Main., representing CttLzens Against Pornography, presented a proposal for revision of the ordinance regarding sale of obscene materials. Mayor McDowell stated that he would call a meeting of the Council as a whole after we seat a new council member to discuss the proposal. Councilman Rutz requested City Attorney Neier review and set out. the differences. COMMITTEE REPORTS FINANCE Councilman Ruiz moved to authorize to call for an audit of city books for the years 1982-83 and 1983-84 by the State division of Local Government Services. Seconded by Councilman Grainger. Motion carried. Councilman Ruiz announced a meeting of the Finance Committee for 4:00 P.M. Thursday, January 19th. The 1983-84 proposed salary ordinance will be reviewed. SEWER & WATER Councilman Nystul reported that the committee met to discuss the three lawsuits in litigation on the treatment plant. One suit has progressed to the point where they will have to make a decision. Expert witnesses will be needed. The EPA will fund the cost of these witnesses on the same percentage basis as the grant, up to $150,000.00. If Council approves a grant amendment, then we can proceed. Councilman Nystul moved that the Mayor and City attorney be authorized to sign a grant amendment. Seconded by Councilman Saverud. Motion carried. Councilman Nystul moved that City Attorney Neier be authorized to start solicitation for legal and teachnical assistance for the suits. Seconded by Councilman Grainger. Motion carried. Water Superintendent Hughes and City Attorney Neier will be reviewing the Greenacres Service As -Built Service Plans and report back. ANNEXATION Councilman Manning moved to approve the Resubdivision of Lot 1, Block 102, Kalispell Original, and instruct the City Attorney to institute utilities and approve the in- stallation of meters for each of the two buildings on the Lot, Seconded by Council- man Saverud. Motion carried. STREET & ALLEY Mayor McDowell announced a TAC meeting for 10:.00 A.M. Tuesday, January 17th, at the Highway Department Office. Urban System priorities that were discussed in August 1980 will be reviewed and updated. SAFETY Councilman Schindler announced a meeting of the safety Committee for January 30th at 4:00 P.M, PARKS, AIRPORT, GOLF COURSE Councilman Nystul-reported-for the.Park Committee that the committee will be meeting with th Airport Association and Project Engineer to discuss the airport construction bids and will bring back a report at the first meeting in February, 166. CITY DEVELOPMENT Councilman Save.rud.reported on a proposed policy statement for guidelines for deter- mining Agency review on Downtown Redevelopment renovation and construction. Zoning ordinance No. 961 relative to the zoning ordinance for the Downtown Redevelopment Agency includes Sec.tion,7.33 d1s.cuss ng.agency approval.. It essentially says that prior to.the issuance of a building permit the agency.; which in Kalispell's case..is the Council,has to review the' .applic.ation..' A deci'sia:n was,made 2 or 3 years ago. that ordinary mai'ntenan,ce type situ'atibns urauld'not _require, that approval, but go through ordinary building permit, process .and;,if necessary, the Architectural.Review Committee. However,:'now we have,.before.uJs a.major new -building that triggers,'this more involve review.. Present were Mayor McDowell, Councilmen Grainger and Shhindler, Chief Stefanic and Rick Perry, representing Perray Enterprises, Inc. Application was made by Perray Enterprises for the purpose of operating keno machines at the Keglers Lounge at 330 lst Avenue West. No one appeared for or against the application. Members of the Committee had no objections. Councilman Schindler asked if they can also operate poker tables. The answer is yes, if they pay the extra fee.. Councilman Schindler noted that this is very close to teen-age bowlers. It will be Mr. Perry's responsibility to see_ -_.- that no one under age uses the keno machine. Councilman Grainger moved to approve the application. Seconded by City:-Atterney Neier. Motion carried.
