THE REGULAR MEETING OF.THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P.M. MONDAY, DECEMBER
5, 1983 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR MCDOWELL PRESIDED. COUNCILMAN
NYSTUL ABSENT. ALL OTHER COUNCILMEN PRESENT.
Mayor McDowell introduced a guest,..Mr. Doug Ormrod, Deputy Mayor of the second largest
city in New Zealand.
APPROVE MINUTES
Councilman Palmer moved to approve the minutes of the Special Meeting of November 16,
1983 and the Regular Meeting of November 21, 1983 as presented. Seconded by Councilman
Zauner. Motion carried.
PUBLIC HEARING - Street Annexation
Certain streets in the City are partially within the City and partially in the County.
Flathead County has given the City quit claim deed to these streets and the next step
is to annex them.. This hearing concerns eight streets as described in the Resolution
of Intention to Annex #3501.
Mayor McDowell asked for proponents. No one appeared.

No one appeared to address the Council.
COMMITTEE REPORTS
PARKS
Councilman Vidal reported that the Parks Committee hasdiscussed the need for a public
restroom at the Conrad Mansion. As soon as details are worked out as to structure, cost
and .location thelrywill have a recommendation.
COMMUNITY DEVELOPMENT
Councilman Saverud moved to assist Flathead Industries for the Handicapped in the amount
of $32,500.00 for the purchase of land for their plastic project at 54 4th Avenue W.N.
Seconded by Councilman O'Boyle. The payment is part of the grant to be received by the
Community Development Department and was earmarked for this project.
Roll call vote. All.voted aye.
SAFETY
Councilman Grainger moved to award the bid for a 1984 pickup for the Fire Department
to the low bidder, Bob Meier Oldsmobile. Seconded by Councilman Vidal. Motion carried.
Councilman Grainger moved to award the bid for a station wagon for the Fire Department
to the low bidder, Roy Stanley Chevrolet. Seconded by Councilman Ruiz. Councilmen
Vidal, O'Boyle and Saverud voted nay. Motion carried.

tiring on a service pension after 23 years and 6 months service with the Fire Depart-
ment. His retirement is effective December 31, 1983.
Councilman Grainger moved to accept the retirement of Gene Thompson. Seconded by
Councilman Vidal. Carried.
SEWER & WATER
Councilman Ruiz reported that the Sewer & Water Committee, with power to act, awarded
the bid for a sewer cleaning machine to Plains Power & Equipment Company in Missoula.
It is a used machine; pi'i&e is $85,0001.00.
Councilman Ruiz announced that Mark Weston, Water Quality Bureau, will be in Kalispell
at 4:00 P. M. Wednesday, December 14th to meet with the Mayor and Council on further
eligibility for grants for the treatment plant. An interim federal construction in-
spection on the Federal Sewage Works Grant Project has been scheduled for December 15th.
FINANCE
In the absence of Councilman Nystul, Finance Chairman, Councilman Ruiz moved that all
claims for November :found to be in order be paid. Seconded by Councilman Saverud.
Motion carried.
SALARY ORDINANCE
Councilman Ruiz moved first reading of an ordinance setting salaries for City employees
for the fiscal year 1983-84. Seconded.by Councilman Zauner.
Councilman Saverud protested voting on the ordinance because the Finance Committee has
not looked at it.

ANNEXATION
RESOLUTION #3506
Councilman Palmer moved to adopt Resolution 43505 a resolution annexing certain streets
as described in Resolution #3501. Seconded by Councilman Vidal. Roll call vote. All
voted aye.

Councilman Palmer moved to adopt Resolution #3506 a Resolution of Intention to annex
two sections of Highway #93. Seconded by Councilman":Zauner.. Rol.l call vote. All
voted aye.
McCARTNEY ALLEY
Councilman Palmer moved to vacate an alley adjacent to the Emma McCartney property,
which is north of 6th and 7th Streets between Meridian Road and llth Avenue West.
Seconded by Councilman Zauner. The alley does not go clear through from one block to
the other. The .garbage truck leas to back in to pick up garbage. Council felt it
should be reviewed again before vacating. Councilman Zauner withdrew his second
and Councilman Palmer withdrew his motion.
Councilman Palmer announced that the FRDO would present a slide program entitled
"Today is Yesterday's Tomorrow". It will be presented at 7:30 P.M. on December 12th
in the Council Chambers. Everyone is welcome to attend.
Councilman Palmer announced that there will be a discussion on PUD at the regular
meeting of the 19th.
EXTENSION OF SERVICE
Councilman Palmer announced that it is necessary by State Statute to plan for the
future of land contiguous to the city limits as to annexation and extension of ser-
vices. From several studies done in the past and from present and future needs, FRDO
has prepared a policy on extension of services. The City of Whitefish has adopted
the policy and Columbia. -Falls is considering doing so. Water Superintendent Hughes
reported that he has reviewed the report and has two comments'? 1) the suggestion
that the development of additional spring supply in the vicinity of Naffsinger
Springs is definitely not an option available to the City in the forseeable future,
nor would it be in our best interests to consider furthere development near the heart
of our system. Future water -sources would be wells in the outlying areas; and 2) he
believes that a 40 year life for buried pipelines is unreasonable. Modern materials
and installation procedures permit water line life in excess of 70 years and sewer pipe
should approach the same figure in most coses. Since our fund for replacement is
generally inadequate, Mr. Hughes would favor an accelerated depreciation scheduled to
improve our financial picture.
The policy follows the statute in providing a general guide for future annexation and
provides for fire and police protection, garbage, streets and utilities. Our present
Standards for Design has specific regulations or utility service but does not cover
other services.
Councilman Ruiz stated he would rather act on each request as a Council of the whole.
Councilman Vidal stated she thought it important for the Council to review it at a study
session. Action postponed.
STREET & ALLEY
ORDINANCE #1038
Councilman O'Boyle moved second reading of Ordinance #1038 an ordinance to amend the
garbage ordinance to allow 55 gallon barrels for city parks only. Seconded by Council-
man Vidal.
Lanny Scovel, job steward, stated that in the past 15 months, 4 of the garbage crew
habe been injured, 3 attributed to heavy garbage cans. The present ordinance desig-
nates 50 pound maximum for garbage cans. Mr. Scovel has been trying to work out a
solution for over the maximum cans.
Councilman Palmer asked if he had talked to Street Foreman Clements. He replied that
he had talked to him but to no avail.
The parks do not have their own garbage crew. There are handles on the 55 gallon
barrels and can be picked up by two men. Clements stated he has always instructed his
crews to use 2 men when dumping these barrels.
Parks Superintendent Drent explained that he cannot have dumpsters because of the.dan-
ger to children. Regular 30 gallon cans are stolen. These barrels were in the parks
when he assumed his position 10 years ago. The County and Forest Service use the same
type. There are 86 barrels to empty in the summer and abbut 20 the remainder of the
year.
Councilman Pa.Imer asked if the union had submitted a formal written document on the
complaint to Superintendent Clements and the reply was "no". 156.
Scovel said, "if you change the ordinance, you are.not negotiating"
Mayor McDowell stated there would be no argument about garbage tonight. Crews will
use two men to empty barrels until an alternative is found. Mayor McDowell asked
that the issue be taken back to committee.
Councilman Vidal withdrew her second. Councilman O'Boyle withdrew his motion.
Councilman O'Boyle commented on the, fact that there were 34 more votes for the pool
bond issue than voted for councilmen. Also, that Ward I has too many voters com-
pared to the bther wards and it is time to draw new boundaries.
Councilman Grainger moved to adjourn. Seconded by Councilman Zauner. Motion
carried.
