GENTLEMEN:.
There -will be a Special Meeting of the City Council, Tuesday, May 24, 1983, at 4:00
P:. M. in the Council Chambers at City Hall for the following purpose:
To authorize the City Clerk and City Attorney to.publish notice of a Public Hear-
ing on the modification of the Urban Renewal Plan (Downtown Redevelopment Plan)
for the Cit,y.of Kalispell pursuant to.Section.7-15-42-4214 M. C. A.
We, the undersigned, being all of the members of the City Council, do hereby waive
notice of the date and purpose of the Special Meeting of the City Council to be
held Tuesday, May .24, 1983 at 4:00 P. M. in the Council Chambers at City hall and_
cans€:mt to the transaction of the above and any , other business that may properly
come before the City Council.

MEN GRAINGER AND ZAUNER ABSENT. ALL OTHER COUNCILMEN PRESENT.
City Attorney Neier explained that on May 13, 1983 the Flathead County Commissioners
. passed a resolution approving the land use plan as.requested by BNRR (Glacier Park
Company) for an a,rea.:within the Downtown,Redevelopment Area: This resolution will be -
tone effective Jute 1�b 1983. Two more steps are:to be completed before any activity.

may proceed. 1) The Ordinance covering the Redevelopment.,Plan has to be amended
and 2) The Zoning Ordinance must be amended. 'these are two separate and distinct
activities. The Zoning Commission has acted and sent..a recommendation to the City
on March 3rd. We have waited until the land use plan change was passed by the City
Council and County Commissioners. The zoning laws require the City Council to have
a public hearing after notice and state law covering Urban Renewal requires a public
.hearing by the governing body after notice by publication and mail to area property
owners.
Neier has prepared a time table to cover these steps and advised this Special Meet-
ing so the Cleric can be authorized to advertise and send notices to amend the Down-
town Redevelopment Plan and also call for a public hearing on the zoning change.
There will be two public hearings on June 20th, with the first notice being pub-
lished June 2nd and the second notice June 9th.
Community Development Director Gallagher stated that the application for the change
was submitted in December. Sax months is an adequate.time frame to come to public
hearing.
Councilman.Saverud moved that the City Clerk and City Attorney be authorized to
publish and mail notice for a public hearing concerning an amendment to the Downtown
Redevelopment Ordinance and to publish notice for a public hearing concerning an
amendment to the zoning ordinance. Seconded by Councilman Palmer.
Councilman Nystul explained that the public hearings will involve firm proposals on
traffic, utilities, streets and other matters concerned with zoning.
Councilman Ruiz objected to the motion because he stated he felt he had not had
enough information or time.
Councilman Palmer replied that the information had been out for some time.
Gallagher stated that state law covers the Redevelopment Plan for residents in a
100 block area. They must be noticed and heard and that is when you ask questions.
Councilman Ruiz stated that he was not familiar with the proposal and would like
more time.
Gallagher stated that this is the first time the Redevelopment Plan has been amended
since the ordinance was enacted in 1979, so no one is familiar with the proceedings.
Councilman Palmer explained that the Annexation Committee asked City Attorney Neier
to make the timetable. The Urban Renewal Plan has to be changed first and then
zoning has to conform.
Councilman Nystul explained that the hearings should be held the same night because
the information is the same for both hearings and the same people are concerned.
Question called. Roll call vote. Councilman Ruiz voted nay. Motion carried.
Councilman Nystul moved to adjourn. Seconded by Councilman Saverud. Carried.
