12/20/82 City Council Minutes434 THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD IN THE COUNCIL CHAMBERS AT CITY HALL AT 7:30 P. M. MONDAY, DECEMBER 20, 1952. -MAYOR McDOWELL PRESIDED. ALL COUNCILMEN WERE PRESENT. APPROVE MINUTES Councilman Nystul moved that the minutes.❑f the Regular Meeting of December b, 1982 be approved as corrected. One correction is that Lee Tower will address the next Parks Committee Meeting. The Employment committee report will now read "a factfinder has been selected". CITY OFFICIAL REPORTS Treasurer for October 198.2 Police Chief for November 1982 City Judge for November 1982 Building Official for November 1982 Councilman Nystul moved that City Official reports be accepted. Seconded by Councilman Ruiz. Carried. PRESENTATION Attorney Charles R. White, on behalf of Alice Hileman Davey, presented the City of Kalispell with two pictures which are hanging on the Council Chambers walls. On the east wall is a picture of Swift Current Lake, with the back side of the Garden Wall in the back- ground, and the picture on the south wall portrays St. Mary's Lake. Mr. Hileman took these pictures sometime in the early 1900's. At that time, MT.. Hileman was the official photo- grapher for Glacier National Park, appointed by the National Park Service. The picture tinting was done by a Mr. .lames Anderson, who was an accomplished photographer in his own right. Mr. Hileman operated a photography shop in the.building which used to be the Alton Pearce Drug. The Hileman family owned the building and sold it to Mr. Pearce. Mrs. Hileman Davey had looked for a long time for a place for these pictures and the new Council Chambers seemed to be the appropriate place, and.:she was happy that.the city officials accepted the pictures. Mr. White stated that to him: and to others who have hiked, picnicked and vaca- tioned in the Park, these are probably the most scenic areas in our nation. Mrs. Davey passed away in Kalispell this morning and this was her last gift. On behalf of the City of Kalispell, Mayor McDowell thanked Mr. White for the pictures. An appropriate.plaque with pertinent facts and the donor's name will be added to the pictures. Councilman O'Boyle added his thanks for a very fitting gift and a fine donation. Councilman Nystul asked that an appropriate letter be written to the family to thank them for the gift. PUBLIC HEARING - S.I.D. #334 RESOLUTION #3448 There being no opposition, Councilman Nystul moved finaladoption of Resolution #3448, a resolution levying and assessing a tax upon all property in the Special Improvement Dist- rict No.334 to defray the costs of making the special improvements authorized herein. Seconded by Councilman Vidal. Roll call vote. All voted aye. COMMITTEE REPORTS STREET & ALLEY Councilman O'Boyle reported that slides of a side arm loader for garbage was viewed last week: It is a one man operation, looks good, but the big question is money. The com- mittee will meet early next year to discuss the purchase. PARKS Councilman Vidal reported that the pool study by the Smith firm, -of Bellevue, WA, was done last week, along with a meeting of the Parks Committee, Mayor McDowell, Park Superin- tendent Drent and a member of his crew. They talked lots of ideas but nothing conclusive. The report will be submitted by the middle or end of January. COMMUNITY DEVELOPMENT Councilman Saverud reported that Building Official Alan Petersen has received his cer- tificate of ICBO confirmation. Councilman Saverud reported that Kalispell's redevelopment has brought special recognition. John Beale, from the Denver office of HUD, had high praise for community cooperation and effort on two redevelopment projects, funded in part with HUD grants. the Kalispell Down- town Redevelopment Plan and the Elrod School Neighborhood Revitalization Project. Both have been awarded national recognition. ( rk John Beale was in Kalispell this morning specifically to present certificates of merit to individuals connected with the two projects. Receiving certificates were Mayor LeRoy McDowell, former Mayor Norma Happ, Dale Haarr of Haarr Brothers and president of the Kalispell.Development Corporation, Steve Olson of First Northwestern National Bank and Chuck Mercord of First Federal Savings & Loan, presidents of the two local lending in- stitutions that loaned money for the redevelopment projects; Ray Thon of Taylor, Thon, Thompson and Peterson, architects for The Elms, a 42 unit apartment complex for the elderly, built as part of the redevelopment project; and Ed Gallagher, director of the City's Community Development Department. Beale said Kalispell was the only city in the six -state Rocky Mountain region to receive certificates of merit or recognition for two separate projects. He complimented the city and.the business community for working cooperatively on the projects,.something he said, that "is very unusual and is happening in only a few select communities". "You are achieving exceptional -results," he said, noting that HUD's $243,000 grant has resulted in $1.8 million in investments in improving Kalispell's downtown area. That $243,000 was used to obtain lower interest rates for improving commercial properties and encourage in- vestment. Beale said 110 new private sector jobs were created by the project. "Not only should you feel proud", he said, but there are other communities that will want to know how Kalispell made it work. "You've done a terrific job." Investment in the Elrod project, Beale said, totaled $3 million, most of it private sec- tor money. As many as 108 housing units were involved, SAFETY Councilman Grainger moved that the Fire Chief be authorized to call for bids for a new ambulance. Seconded by Councilman O'Boyle. Motion carried. Councilman Grainger reported that delivery on the two new police cars had been set back because of the strike at the Chrysler plant. The strike is over now. SEWER & WATER Councilman Ruiz reported that the Sewer Water Committee met last 'Tuesday. After dis- cussion on the sewer rate, the committee recommended the 12% raise be approved. RESOLUTION #3449 Councilman Ruiz moved to adopt Resolution #3449, a resolution to raise the sewer rate 12%. Seconded by Councilman Nystul. Roll call vote. All voted aye. Councilman Ruiz announced a meeting of the Sewer & Water Committee for tomorrow at 4:00 P. M. to discuss the proposals on the Hardy Cross Water System Study. FINANCE RESOLUTION #3450 Councilman Nystul-smQ�re&to- adopt ResQlution ,1#3450 a resolution levying and assessing a tax upon all property in the Special Improvement District No. 333 and authorizing the City Clerk to publish notice for a public hearing thereon. Seconded by Councilman Saverud. Roll call vote. All voted aye. RESOLUTION #3451 Councilman Nystul moved to adopt Resolution #3451, a resolution levying and assessing a tax upon all property in the Special Improvement District No. 335 and authorizing the City Clerk to publish notice for a public hearing thereon. Seconded by Councilman O'Boyle. Roll call vote. All voted aye. Councilman Nystul reported -that Ed Gallagher, Bill Swanson, County Assessor Long and he attended a forum on tax increment in Helena on December 10th. It was interesting and educational. Four bonding companies were represented and Bill Johnstone, with Dorsey & Marquardt was there. Councilman Nystul stated that he visited with Don Peoples, Chief Executive for Silver Bow County, who feels the Coalition for Cities and Counties will be doing a good job lobbying the next legislature for additional funds. Councilman Nystul stated that he has changed his mind about joining the Coalition and asked the Council to reconsider. $10,000.00 was budgeted in Revenue Sharing for updating our code books. The proposal for the books is between $6,000 and $8,000. Coalition dues could be paid from this budgeted item. Councilman Nystul moved to appropriate $1,000 from Revenue Sharing funds to participate in the Coalition Program. Seconded by Councilman Vidal. Councilman Ruiz spoke against the motion by saying we had better priorities. If we feel we do not benefit enough from our membership in the League of Cities & Towns, we should pull out. r� � d M.. Councilman Nystul stated that we are looking at two organizations. The League serves us year around with various services, but the Coalition has one specific purpose and that is working with:.the legislature to find ways and means for more funds for cities and counties. Councilman 0' Boyle stated that we are getting support from the larger cities and counties through the Coalition, while the League is working with all sizes of cities down to the smallest: -.towns. Councilman Ruiz stated that we have lost the business inventory tax and the motor vehicle tact and feels we should continue to adjust our living on our own tax base instead of con- tinually reaching out. Councilman O'Boyle stated that we either find more sources of'revenue or consolidate with the county. Councilman Saverud stated that he agrees with what has been said, but we cannot walk away. Our problems stem from commitments the past legislatures have forced on us and we must be very vigilant during this legislative session to make sure they do not do something to us that we cannot afford. Councilman Zauner asked if 6 or 8 cities have enough clout. Also, we have stated we do not have any money for raises, -yet we keep finding funds for other things. Director of Finance Swanson stated that we are in rough shape financially. Try them this year and if they/not help, get out. The legislature has eliminated about $600,000 of our income and we need something to offset this. All the major cities, except Kalispell, and some counties belong to the _Coalition - about 16 units. Question called. Councilmen O'Boyle, Vidal, Saverud, Grainger, Nystul voted aye. Councilmen Ruiz, Zauner and Palmer voted nay. Motion carried. Councilman Palmer asked that a very strong letter be sent to the League of Cities & Towns, telling them it is their ultimate responsibility to help us and we will not hesitate to withdraw if they do not.. EMPLOYMENT Councilman Zauner reported that he has received word from the Kalispell Police Association that they will go to mediation. ANNEXATION Councilman Palmer stated that there was not a quorum at the last City County Planning Board meeting and on this last official meeting of the year, he had no report. MISCELLANEOUS Mayor McDowell announced a no -host luncheon tomorrow at the Outlaw Inn with.the local legislators. He urged everyone who can to attend. The Economic Development Association will meet from 8:30 A, M. to 11:30 A.M. tomorrow with Gary Buchanan and staff. Councilman Vidal welcomed a visitor, Crissy Hughes, a young person interested in city government and politics. Councilman Nystul moved that Councilman Grainger be permitted to be out of the state to attend a school in Denver from January 9 to January 19. Seconded by Councilman Ruiz. Carried. Councilman Palmer reported he will be out of town from December 23 through the 29th. Councilman Zauner reported he will be out of town from January 8 through the 13th. Councilman Palmer, Council representative to the Chamber of Commerce, reported that the Chamber has a very strong legislative committee, headed by Cal Robinson, and recommended that we write the committee a letter, stating our objectives and asking for their support. Mayor McDowell wished everyone a very Merry Christmans and a happy and prosperous New Year. Councilman Grainger moved to adjourn. Seconded by Councilman Palmer. Carried.
