01/04/82 City Council MinutesTHE REGULAR MEETING OF THE KALISPELL CITY.E OUNCIL WAS HELD AT 7:30 P.M. MONDAY, JANUARY 4, 1982 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PRESIDED. COUNCILMAN DALEY EXCUSED BECAUSE OF ILLNESS, COUNCI'WN' ER.EXCUSED BECAUSE HE HAD TO BE OUT OF TOWN ON BUSINESS. i 1 APPROVE MINUTES Councilman O'Boyle moved that, the minutes of the Regular Meeting of•December 21, 1981 be approved'as presented.'Seconded. by Councilman Zauner. City Attorney Donahue told the Council and audience that when the city -,attorney was created as a full-time position, one of the objectives he had in mind was to acquire a full working law library. A few isolated books were owned by the City that were use- ful, but not enough for a day-to-day library, Through the generosity of the late Honorable Judge E.B. Foot, retirbd District Judge, 600 usable law books were donated to the City law.library and about as many were not usable, some of which were sold and some are stored in the basement of City Hall. Many of the books belonged to Judge Foots fatEb.r:, C. H. Foot, a pioneer attorney, and many of the books bear his name. Since then, we have added to the collection and it is now a full working library. One day Mrs. Foot, widow of Judge Foot, brought in several old licenses issued to C. H. Foot. One is dated 1892, issued by Missoula County, which covered this area at that time, and which cost $10.00 per year. The 1894 and 1895 licenses were issued by.the City of Kalispell, and the.fee was $5.00 per year, payable $1.25 per quarter. The licenses will be framed as a momento of early days and will hang in the office of the City Attorney. Mayor Happ asked that a letter of thanks be written to Mrs. Foot and City Attorney Donahue for their contribution to the history of Kalispell. Councilman O'Boyle presented Mayor Happ with a parking meter head as a souvenir She thanked the Council and stated that she would put her coins in the meter head for her retirement. OLD BUSINESS ORDINANCE #1000 Councilman Ruiz moved second reading of Ordinance #1000, an ordinance to establish a city administrative fee issuance of industrial development revenue bonds: Seconded by Councilman O'Boyle. Roll call vote. All voted aye. COMMITTEE REPORTS FINANCE Councilman Ruiz moved that all December bills found to be in order by the Finance Committee be paid. Seconded by Councilman Zauner. CITY DEVELOPMENT Councilman Vidal had no report, SEWER 4 WATER Councilman Granmo reminded Council members thata permanent ordinance on the new sewer rate schedule will have to be passed within 90 days when the emergency ordin- ance expires. MISCELLANEOUS Mayor Happ thanked the Council people and department heads she has worked with for their help and cooperation. A special thanks to Councilman Ann Smith, Chairman of the Annexation Committee, for her many hours on annexation and zoning, Mayor Happ thanked Councilman Lauren Granmo for his many hours of work on the Sewer & Water Committee. A big "thank you" to Councilman Forrest Daley, "Mr, Parks", 1 7 LJ 7 LJ Mayor Happ presented certificates of appreciation to Councilmen Granmo and Smith, City Attorney Donahue and herself. She stated that the City is being left better than we found it. OATH OF OFFICE Mayor Happ administered the Oath of Office to Judge Paul Willis. Judge Paul Willis administered the Oath of Office to Mayor -Elect LeRoy E. McDowell; Councilman -Elect Gary W. Nystul, Ward I; Councilman Gayle J. Vidal, Ward II; Councilman - Elect Wayne P. Saverud, Ward 111; and Councilman -Elect Paul R. Palmer, Ward IV. ELECT COUNCIL PRESIDENT Councilman Palmer nominated Councilman O'Boyle for Council President. Councilman Ruiz moved that nominations be closed. Councilman O'Boyle elected Council President by acclamation. Mayor McDowell named the following committees, first name being chairman: Annexation: Employment: Finance: Parks, Recreation & Airport: Sewer --Water: Safety: Street & Alley Sanitation: City Development & Public Buildings: Palmer, Saverud, Grainger Zauner, Grainger, Nystul Nystul, Ruiz, Saverud Vidal, O'Boyle, Palmer Ruiz, Zauner, Nystul Grainger, Palmer, Vidal O'Boyle, Ruiz, Zauner Saverud, O'Boyle, Vidal NEW BUSINESS ORDINANCE #1001 Councilman O'Boyle moved first reading of Ordinance #1001, an ordinance to amend Section 17-96 of the City Code to "Alley between First Avenue East and Main Street between Fourth Street East and First Street East from north to south", to "Alley between First Avenue East and Main Street between Fifth Street East and First Street East from north to south". Seconded by Councilman Nystul, Roll call vote. All voted aye. Community Development Director, Ed Gallagher, stated he would be in Helena on January 7th and 8th to attend the meeting on State Task Force for state participa- tion for small cities community development block grant programs. The second session will start January 18th. Councilman Nystul reported that Chapter 15 of the Kalispell City Code sets out some small licenses for pop and cigarette machines and others. These are summarized as follows, with reference to section number: 15-5 Circuses: $50.00 per day; 15-6 Cigarettes: $5.00 per year; 15-7,8, and 9 Soft Drinks: $2.00 per year; Billiard or pool tables: $1.00 per quarter; Restaurant and rooming houses: $2.00 per year; 15-10 Bowling Alley: $2.50 per alley per quarter; 15-11 Moving Picture theatre:$25.00 per year; 15-12 Traveling Merchant: $15.00per day to $600.00 per quarter; 15-13 Shooting galleries: $5.00 per quarter; 1S-14 Doll racks, can. rack: $5.00 per month; 15-15 Roller skating rinks: $5.00 per month. As indicated by the low charges, the revenue probably does not cover the time and costs involved to issue many of these. Data will not be available for a week or so on how many of each license and the revenue generated this past year. Because these licenses are now being renewed, Councilman Nystul:mdved to have the City Treasurer not issue any licenses listed in Chapter 15 of the City Code until we have a report at the next meeting. Any checks received are to be held. Any licenses already paid for will be adjusted as appropriate after the study. Seconded by Councilman Saverud. After discussion, it was felt that it would be better to wait until next year and to include a study of license and permit bonds with the review on licensing, Councilman Saverud withdrew his second. Councilman Nystul withdrew the motion, Councilman O'Boyle moved that the request of Councilman Zauner to be excused from Council duties between January 16yh and the 24th be granted, Seconded by Councilman Vidal. Motion carried. Councilman Palmer stated that he is formally resigning from the Parking Commission and asked that Mayor McDowell replace the position. Mayor McDowell announced there would be a meeting -of the Council as a whole at 6:30 A.M. Friday, January 8th at the Outlaw Inn. Appointment of a City Attorney and other matters will be discussed. Council members were reminded of a local workshQfQr new-!y elbcted' and appointed officials, in Columbia Falls at 10:00 A,M. Thursday, January 7t.4, Councilman Palmer expressed his appreciation for the work done by Councilman Daley during his 10 years on the Council. Mayor McDowell thanked everyone for their support in the past and for the future. It takes all of us working together, sharing ideas and keeping open communications as time goes on. He added that his goal is working together and thinking of others rather than ourselves. There being no further business, Councilman Saveru4 moved to adjourn. Seconded by Councilman O'Boyle. Carried.
