LEGAL DESCRIPTION: Construction of an accessory apartment above
an art studio, located at 494 North Main,
south of California Street on the west side of
Q Main Street, and further described as Lot 1,
Block 238, Kalispell Addition 6 in Section 7,
Township 28 North, Range 21 West, P.M.M.,
Flathead County, Montana.
ZONE: B-1, Neighborhood Buffer District
James and Leslie Clayborn have applied to the City of
Kalispell for a conditional use permit to construct an accessory
apartment above an art studio. Accessory apartments are
conditionally permitted uses in the B-1 zone.
The Kalispell City -County Planning Board and Zoning
Commission, after due and proper notice, on February 13, 2001 held
a public hearing on the application, took public comment and
recommended that the application be approved subject to seven
conditions.
After reviewing the application, the record, the FRDO report,
and after duly considering the matter, the City Council of the City
of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Flathead Regional Development Office, Conditional Use Report
#KCU-01-1 as the Council's findings of fact, and issues and grants
to the above -described real property a conditional use permit to
construct an accessory apartment in the B-1, Neighborhood Buffer
District subject to the following conditions:
1. That the proposal will be developed in substantial
conformance with the approved site plan.
2. That all of the stormwater generated from the new
construction will be maintained on -site.
3. That a small apron be provided along the parking lot to
_the_ north to provide an adequate back-up area.
4. That all of the parking areas be paved in accordance with
a plan approved by the Kalispell Public Works Department.

5. That the project be reviewed and approved by the
Kalispell Fire Department for compliance with the uniform
fire code.
6. That the sidewalk and landscaping in the public right-of-
way be coordinated with the Kalispell Parks and
Recreation Department.
7. That the conditional use permit shall terminate 18 months
from the date of authorization of commencement if the
authorized activity has not begun.
