CALL TO ORDER Mayor Johnson called the meeting to order at 7 p.m. Mavor - Mark Johnson: Present in council chambers Council Member - Kari Gabriel: Present via video conference Council Member - Sandy Carlson: Present via video conference Council Member - Sam Nunnally: Present via video conference Council Member - Chad Graham: Present via video conference Council Member - Kyle Waterman: Present via video conference Council Member - Ryan Hunter: Present via video conference Council Member - Tim Kluesner: Present via video conference Council Member - Sid Daoud: Present via video conference Staff present included City Manager Doug Russell, City Clerk Aimee Brunckhorst, Development Services Director Jarod Nygren, and Senior Planner P.J. Sorensen. B. DISCUSSION ITEMS 1. Accessory Dwelling Units 01- a City Manager Russell provided background regarding the process that the city has gone through in considering accessory dwelling units. Senior Planner P.J. Sorensen provided the staff report on this item. Mr. Sorensen explained in which parts of the city accessory dwelling units (ADU) are currently allowed and where permitting ADU's would be added with this proposal. He then described the recommendations for respective conditions brought before the Council for discussion. 07:08:04 PM (00:10:29} Councilor Waterman requested that the maps be sent out via email. He then asked questions regarding zoning and parking. 00:12:42 Councilor Nunnally asked how many properties could be impacted if these recommendations were put into place. He then asked about current non -conforming properties. 00:15:49 Councilor Graham asked further about non -conforming properties and consequences. He then asked whether the Planning Board discussed addressing long-term rentals versus short term rentals. He asked for the reasoning behind the square foot cap. 00:24:40 Councilor Graham spoke to the discussions that the Planning Board had regarding ADU's. He then asked questions regarding limits related to further accessory dwellings. 00:30:04 Councilor Daoud asked for details regarding the 2% cap regarding short-term rentals that is currently in place. He then asked about public comment that has been received. 00:32:56 Councilor Graham asked Council what they thought about sending out a mailing to all owners in the R-4, R-5 Zoning Districts. He would also like to see this changed to an administrative use permit. Councilor Daoud provided discussion on Councilor Grahams request. 00:35:46 City Manager Russell spoke to how changes would need to be brought forth. Council and staff discussed Councilor Grahams suggestions further. 00:39:06 Councilor Daoud asked questions regarding the current administrative conditional use permit process. 00:42:09 Mayor Johnson provided discussion on the possibility of an administrative CUP process. 00:43:38 Councilor Daoud provided further discussion. 00:43:54 Councilor Hunter thanked staff for the work in preparing this recommendation. He then provided discussion regarding ADU's. He would like to see minimum parking restrictions eliminated for ADU's. He provided discussion regarding noticing. Councilor Hunter then provided discussion in opposition to an administrative CUP process. 00:51:04 Mayor Johnson provided discussion on public notification and planning processes and spoke regarding the advantages of an administrative CUP process. 00:54:01 Councilor Daoud asked questions regarding the current proposal and how the proposal would change if an administrative CUP process was added. 00:57:01 Councilor Hunter provided further discussion regarding density. 00:57:40 Councilor Graham provided discussion on requirements. 01:00:10 Councilor Hunter provided further discussion. 01:02:35 Councilor Daoud provided discussion. 01:04:51 Councilor Nunnally provided discussion. C. PUBLIC COMMENT Mayor Johnson opened public comment. Seeing none, he closed public comment. CITY MANAGER, COUNCIL. AND MAYOR REPORTS City Manager Russell provided the following report: City offices will be closed next Monday for Martin Luther King Jr. Day. The council will meet Tuesday, January 19, instead of Monday. The Montana League of Cities and Towns have brought several items of concern forward to members regarding current legislation being discussed in the State legislature. Legislation of concern includes House Bill 107 which would limit the ability for elected mill levies. Senate Bill 77 and 78 are also of concern and would impact special districts. He spoke regarding how that would affect municipalities. One positive legislation coming forward would include a redistribution of some of the state bed tax. E.
